The United States Supreme Court is due to decide whether to issue a stay of execution, which Texas state lawyers insist should go ahead.

If the Supreme Court does not intervene, Leal's fate will lie in the hands of Governor Rick Perry of Texas, who is currently pondering whether to join the 2012 presidential race.

Texas executes more prisoners than any other US state. In his 10 years in office Mr Perry has refused clemency in 230 executions, almost half the 470 executions in Texas since the death penalty was reinstated in 1974.

Among other evidence against Leal, a bite mark was matched to him and the victim's bloody blouse was found at his home. Leal told police that she had attacked him and had fallen and lost consciousness.


Even Leal's lawyers concede that it was "plausible" he was responsible for Miss Sauceda's death. But they contend that if he had been given consular assistance rather than a state-appointed defence lawyer he would probably have been convicted of manslaughter.

The Obama administration, adopting a similar stance to the one taken by President George W Bush's, believes executing Leal could endanger Americans abroad who are also entitled to consular assistance under the Vienna Convention.

"This case implicates United States foreign-policy interests of the highest order," said Donald Verrilli, Mr Obama's Solicitor General in an amicus brief filed in the Supreme Court case.

"The imminent execution of petitioner would place the United States in irreparable breach of its international law obligation."

Executing him, he said, "would have serious repercussions for United States foreign relations, law enforcement and other co-operation with Mexico, and the ability of American citizens travelling abroad to have the benefits of consular assistance in the event of detention".

There is legislation pending in the US Senate would allow federal courts to review cases of condemned foreign nationals to determine whether the lack of consular help made a significant difference in the outcome of their cases.

The United Nations, Amnesty International and a number of former diplomats and military officers have requested that the sentence be commuted to life.

Mr Perry has commuted the death sentences of 31 inmates. Of these, 28 involved cases in which the defendant was a juvenile at the time of the crime and Mr Perry acted after a Supreme Court ruling on the issue.

Polls show that about 65 per cent of Americans favour the death penalty. Mr Perry's enthusiastic backing for the death penalty would be unlikely to be an issue that could harm him in the Republican primaries. It could, however, became an issue in a general election against Mr Obama, who supports the death penalty but is much more willing to consider exclusions.

Well it appears that he has personally stepped in along with the State Dept and Mexico because of the violation of the 1963 Vienna Treaty. 

Texas doesn't have follow the treaty because of a Supreme Court ruling but it appears its due to the danger imposed on American Tourists if they are jailed in another country.  I don't think Rick Perry is going to put a stay on the execution because of the election season but we will see

Crime reporter and blogger Tina Trent says that President Obama’s intervention on behalf of an illegal alien killer can be traced back to a 2003 conference that featured Bernardine Dohrn, Van Jones, and representatives of the Soros-funded Open Society Institute. “The purpose of the conference was to find ways to insinuate international (read: United Nations) laws and resolutions in American legal arenas, as Sandra Babcock is attempting to do to free her client, Humberto Leal,” Trent reports on her blog.


 Babcock is the attorney for a killer described in liberal media reports as “a Mexican national” who is in fact an illegal alien convicted of the 1994 kidnapping, rape, and murder of 16-year-old Adria Sauceda in San Antonio, Texas. Leal was scheduled to be executed on Thursday night in Texas before the Obama Administration intervened on his behalf, claiming his rights as an illegal in the U.S., under an international treaty, had not been protected. Leal has had the benefit of 45 different hearings and appeals and his guilt is beyond question.

The issue that Obama is concerned about is whether this illegal alien was able to contact the Mexican embassy in order to protect his “rights” under international law.

Trent reports, “Humberto Leal’s defense attorney, Sandra L. Babcock, of the terrorist-sheltering law school at Northwestern University, has an interesting vitae. Ms. Babcock’s research interest is imposing international law on the American justice system, a hobby she practices with her colleague, terrorist-cum-law-professor Bernardine Dohrn.”

“If President Obama, his friend Bernardine Dohrn, and Jimmy Carter get their way, the police are going to find their hands tied in ten different ways, and our criminal justice system will soon be utterly subservient to whatever the hell they dream up at the U.N.,” Trent says of the Obama Administration’s intervention in the case.

In intervening on behalf of Leal, Obama is acting on behalf of the government of Mexico.

Indeed, Babcock’s work has been funded by the government of Mexico. According to Babcock’s biography, “From 2000-2006 she served as director of the Mexican Capital Legal Assistance Program, a program funded by the Mexican Foreign Ministry to assist Mexican nationals facing capital punishment in the United States. For her work, she was awarded the Aguila Azteca, the highest honor bestowed by the government of Mexico upon citizens of foreign countries, in 2003.”


Dohrn is the former leader of the communist terrorist Weather Underground who, with her husband and fellow terrorist Bill Ayers, hosted a fundraiser for Barack Obama when he ran for the state Senate in Illinois.


She praised the followers of mass murderer Charles Manson and Manson himself as a “true revolutionary.” Dohrn and Ayers signed a document, “Prairie Fire: The Politics of Revolutionary Anti-Imperialism,” dedicated in part to Sirhan Sirhan, the Marxist Palestinian who killed Robert F. Kennedy. This endorsement played a role in the University of Illinois denying Ayers, who had been a professor of education at the school, emeritus status after he retired.


For her part, Dohrn was jailed for seven months for refusing to cooperate with a grand jury investigating the murder of two policemen and a security guard in the 1981 Brinks robbery. She is accused by former FBI informant Larry Grathwohl, based on a meeting he had with Ayers, of planting the bomb that killed San Francisco Police Sergeant Brian V. McDonnell in 1970. Dohrn denies the charge.


Van Jones, listed as being “invited” to the international law conference, is the former Obama official and self-proclaimed communist who voiced doubts that Muslims carried out the 9/11 terrorist attacks.

Trent notes that Babcock and Dohrn were listed by Northwestern as experts on human rights issues when the Chicago City Council adopted a resolution in support of ratification of the United Nations Convention on the Rights of the Child. This treaty gives a U.N. body the power to pass judgment over how parents raise their children.

Trent says that in 2003, along with the A.C.L.U., The Jimmy Carter Center, Human Rights Watch, Amnesty International, the Center for Constitutional Rights, and the Soros-funded Open Society Institute, sponsored a conference called Human Rights at Home: International Law in U.S. Courts. The official description said one purpose was that of “Ensuring U.S. accountability for violating international human rights principles…”

Dohrn was on the program, discussing “women and children’s issues.” Another participant was Harold Koh, now Obama’s State Department legal adviser and one of those pushing for Leal’s international “rights.”


In 2004, Dohrn spoke to the Baltimore branch of the Soros-funded Open Society Institute on the subject of discipline in schools. In 1999, according to Dohrn’s curriculum vitae, she spoke at New York University under the auspices of the Open Society Institute on the subject of “Families in a Free Society.” Another Weather Underground terrorist, Linda Evans, who was pardoned and released from prison by President Clinton, received a “Soros Justice Fellowship” to promote the rights of criminals.



Trent explains the Leal case: “As per her academic research and this movement, Babcock is now claiming that the police failed to inform Leal of his right to Mexican consular support when he was arrested. Allegedly, this failure violated the rules of the International Court of Justice at the Hague: Leal, as a ‘Mexican national,’ should have simply been able to call ‘his’ embassy and the entire mess—the body, the rock, the stick, the bloody clothes, et. al. could be whisked away like some New Guinean ambassador’s parking tickets.”


She adds, “But there’s one little problem: Humberto Leal has lived in the United States, apparently illegally, since he was two. Talk about wanting it both ways: Leal was an American until the moment he murdered Adria Sauceda. That changed in the brief space between bashing in a young girl’s head and wiping down the doors of his car. Now he’s a ‘Mexican national,’ a term everyone from the President to the New York Times to “human rights” organizations (Leal’s rights, not Sauceda’s) is using with no irony and no explanation, as they lobby to cloak a killer in layers of special privileges while simultaneously lobbying to prevent police from inquiring about immigration status.”



Trent explains the predicament into which the Obama policy is putting the police. “The police will have to determine if someone is a foreign citizen in order to offer them consular rights, but they’ll also be forbidden to ask if someone is a foreign citizen in the interest of not discriminating against illegal immigrants, a lovely Catch 22 dreamed up by academics. This cliff we’re careening towards is permanent demotion of Americans’ legal rights on their own soil.”

Trent also criticizes coverage of the case by the liberal media, noting that The New York Times “gawkingly refers to Humberto Leal merely as a ‘Mexican citizen,’ as if he wandered over the border one day and ended up smashing a girl’s head in with a rock, his decades of residency in the U.S. tacitly denied.”

A website devoted to Leal and his case lists a number of articles and editorials in support of his “rights,” several of them from The New York Times and The Washington Post.

The planned execution Thursday of a Mexican national has prompted a flurry of appeals on his behalf, including a rare plea from the White House, because of what it could mean for other foreigners arrested in the U.S. and for Americans detained in other countries.

Humberto Leal, 38, is awaiting a ruling by the U.S. Supreme Court on whether to block his lethal injection in Huntsville. He was sentenced to die for the 1994 rape and murder of 16-year-old Adria Sauceda of San Antonio.

The appeal contends that authorities never told Leal after his arrest that he could seek legal assistance from the Mexican government under an international treaty, and that such assistance would have aided his defense. Leal moved to the U.S. as a toddler.

Leal's attorneys have support from the White House, the Mexican government and other diplomats who believe the execution should be delayed so his case can be thoroughly reviewed.

"There can be little doubt that if the government of Mexico had been allowed access to Mr. Leal in a timely manner, he would not now be facing execution for a capital murder he did not commit," Leal's attorneys told the Texas Board of Pardons and Paroles in a clemency request rejected

Tuesday. "Unfortunately, Mexico's assistance came too late to affect the result of Mr. Leal's capital murder prosecution."

President Barack Obama's administration took the unusual step of intervening in a state murder case when it asked the Supreme Court last week to delay Leal's execution for up to six months. The U.S. solicitor general told the court that Congress needed time to consider legislation that would allow federal courts to review cases of condemned foreign nationals to determine if the lack of consular help made a significant difference in the outcome of their cases.

The legislation, backed by the U.S. State Department and the United Nations, would bring the U.S. into compliance with the Vienna Convention on Consular Relations provision regarding the arrest of foreign nationals.

Lower courts already rejected the pleas, agreeing with the Texas Attorney General's office that since the legislation hasn't been passed and signed into law, it doesn't apply. At least two measures like it failed earlier in Congress.

"Leal's argument is nothing but a transparent attempt to evade his impending punishment," Stephen Hoffman, an assistant attorney general for the state of Texas, told the Supreme Court.

Arturo Sarukhan, Mexico's ambassador to the U.S., wrote numerous congressional members and Texas officials calling attention to the legislation and the case and urged Gov. Rick Perry to stop the punishment.

Perry had the authority to issue a one-time 30-day reprieve but made no decision while the courts remained involved.

Prosecutors said on the night she was killed, Sauceda was drunk and high on cocaine at an outdoor party in an undeveloped neighborhood of San Antonio and was assaulted by several males. At some point, prosecutors said, Leal showed up and said he knew her parents and would take her home and explain the situation to them.

Witnesses said Leal drove off with Sauceda around 5 a.m. Some partygoers found her brutalized body later that morning and called police, prosecutors said. When officers arrived, they found Sauceda's head battered by a 30- to 40-pound chunk of asphalt and evidence that she had been bitten, strangled and raped. A large stick that had a screw protruding from it was left in her body.

Leal, a mechanic, was identified as the last person seen with her. He was questioned and arrested.

A witness testified Leal's brother appeared at the party, agitated that Leal had arrived home bloody and saying he had killed a girl. Testifying during the trial's punishment phase, Leal acknowledged being intoxicated and doing wrong but said he wasn't responsible for what prosecutors alleged.

The question of protection for foreign nationals under the international treaty isn't new.

President George W. Bush in 2005 agreed with an International Court of Justice ruling that Leal and 50 other Mexican-born inmates nationwide should be entitled to new hearings in U.S. courts to determine if their consular rights were violated at the time of their arrests. The Supreme Court later overruled Bush, negating the decision from the Netherlands-based court.

Jose Medellin, condemned for participating in the rape-slayings of two Houston teenage girls, in 2008 raised a Vienna Convention claim similar to the one pending for Leal. It failed and he was executed.

I was working in intake with the nurses and as he reached out to grab the meds he decided to grab the nurse instead.  I won't say exactly say what happened but I neutralized him and me and a few others threw him into Red Pod after he got out of the hospital.  He's on death row currently and actually has 3 death sentences but it keeps getting stayed.  He was suppose to be executed in 2008 but they stopped it.  

There's a lot more people I had to deal with but I understand more than anyone else what type of criminals are out there

Humberto Leal , a Mexican illegal alien was finally executed Thursday evening for the 1994 rape-slaying of 16-year-old Adria Sauceda, whose brutalized nude body was found hours after he left a San Antonio street party with her. She was bludgeoned with a chunk of asphalt.

Leal was executed after the U.S. Supreme Court (by a 5-4 vote) turned down a appeal by President Barack Obama to stop the execution due to complaints by the Mexican Government and the U.N. justice court that he had not properly received “consular access” before his trial.

As with his lawsuit against Arizona over its mere upholding of Federal laws with SB1070, his unilateral approval for access for Mexican drivers in the U.S., and his virtual amnesty for “Dreamer” illegal aliens, Obama once again chose Mexico over the American people. This last disgraceful act by Obama was a slap in the face to the Sauceda Family – who had waited far too long for justice, as well as the People of Texas, whose sovereignty clearly means nothing to him.

After the Supreme Court ruled against Obama and Leal, the Texas Gov. Rick Perry also refused to stop the execution – thus sealing this savage’s fate. In his last minutes, Humberto Leal said he was sorry and accepted responsibility.
