Tripoli, Libya (CNN) -- The 42-year rule of Moammar Gadhafi appeared on the verge of collapse early Monday, with rebel supporters making it to the same Tripoli square where regime loyalists had congregated for months.

But in a possible indication that the fight is not over, celebrations in Tripoli's Green Square gave way to tension Monday morning after rebels told CNN that they'd heard Gadhafi army forces were heading their way. CNN could not confirm any movement of Gadhafi forces.

A large fire, meanwhile, could be seen rising over the capital around 4 a.m. Monday from about 10 miles (16 kilometers outside the city).

The uncertainty came hours after news broke that two of Moammar Gadhafi's sons -- Saif al-Islam and Saadi -- had been arrested by opposition forces. Jumma Ibrahim, a rebel spokesman based in Libya's western mountain region, said both were captured in Tripoli.

The dust has not yet settled over the Libyan capital of Tripoli since rebels took control over the weekend.

But already, a draft constitutional charter for the transitional state has appeared online (embedded below). It is just a draft, mind you, and gauging its authenticity at this point is difficult. There is also no way to know whether this draft or something similar will emerge as the final governing document for a new Libyan regime.

As both the Morning Bell and Washington in a Flash noted today, Heritage Fellow Jim Phillips recently pointed out that Islamist forces “appear to make up a small but not insignificant part of the opposition coalition,” and must be prevented “from hijacking Libya’s future.” Parts of the draft Constitution allay those fears, while others exacerbate them.

Much of the document describes political institutions that will sound familiar to citizens of Western liberal democracies, including rule of law, freedom of speech and religious practice, and a multi-party electoral system.

But despite the Lockean tenor of much of the constitution, the inescapable clause lies right in Part 1, Article 1: “Islam is the Religion of the State, and the principle source of legislation is Islamic Jurisprudence (Sharia).” Under this constitution, in other words, Islam is law. That makes other phrases such as “there shall be no crime or penalty except by virtue of the law” and “Judges shall be independent, subject to no other authority but law and conscience” a bit more ominous.

I knew it! I knew it! I knew it! I screamed at the TV today listening to John McCain proclaim the so-called Libyan rebels were “his heroes”.

CBS News:

McCain said he was in Benghazi “to get an on-the-ground assessment of the situation” and to meet with opposition leaders and members of the rebel military.

“They are my heroes,” McCain said of the rebels as he walked out of a local hotel in Benghazi.

He also said today the rebel Transitional National Council deserves recognition as the legitimate voice of the Libyan people.

I do not know what McCain’s game is or if he is just that painfully naive BUT he…has…got…to…go.

Reporting from Benghazi, Libya, CBS News correspondent Allen Pizzey said the arrival of McCain is exactly the kind of VIP trip the Transitional National Council has been looking for.

They seen him coming a mile away.

McCain told Pizzey that what he really thinks should happen is that $30 billion in assets that are already frozen that belong to Libya, should be released to the Transitional National Council so that they can get this part of the country working.

Even better! Let’s bankroll what would be a burgeoning Islamic regime!

He [McCain] said nations need to provide the council with “every appropriate means of assistance,” including “command and control support, battlefield intelligence, training and weapons.”

As if this was not bad enough:

WASHINGTON (AFP) – President Barack Obama plans to provide Libya’s rebels with up to $25 million in urgent, non-lethal aid, a senior US diplomat told lawmakers in a letter obtained by AFP on Wednesday.

A memorandum attached to the letter said the aid could include vehicles, fuel trucks, ambulances, medical equipment, protective vests, binoculars, and radios.

Al-Qaeda number two broaches Libya in new video

WASHINGTON (AFP) – Al-Qaeda number two Ayman al-Zawahiri incites Muslims to rise up against both NATO and Moamer Kadhafi’s forces in a newly released video apparently taped before the Western intervention in Libya.

Zawahiri, wearing a white robe, was speaking in a one hour and nine minute video produced by Al-Qaeda?s media arm, as-Sahab, according to the US-based SITE Intelligence Group, which monitors Islamic extremist websites.

SITE said Zawahiri split his lecture into three distinct parts, addressing in turn the uprisings in Libya, Egypt and Tunisia.

“I want to direct the attention of our Muslim brothers in Libya, Tunisia, Algeria, and the rest of the Muslim countries, that if the Americans and the NATO forces enter Libya then their neighbors in Egypt and Tunisia and Algeria and the rest of the Muslim countries should rise up and fight both the mercenaries of Kadhafi and the rest of NATO,” he said, according to SITE.

Zawahiri stated Al-Qaeda’s backing for the ousted Tunisian and Egyptian presidents and also accused the Egyptian government of “separation from Islam” and “subservience to the West,” the monitoring group said. >>>

Former Massachusetts Gov. Mitt Romney (R) demanded on Monday that the new, emerging Libyan government extradite the convicted Lockerbie bomber to the United States.

Amid signs that Libyan leader Moammar Gadhafi's government is close to collapse, the Republican presidential candidate demanded that Abdelbaset al-Megrahi be sent to the U.S. "so justice can finally be done."

"It is my hope that Libya will now move toward a representative form of government that supports freedom, human rights, and the rule of law," Romney said in as statement. "As a first step, I call on this new government to arrest and extradite the mastermind behind the bombing of Pan Am 103, Abdelbaset Mohmed Ali al-Megrahi, so justice can finally be done.”

Al-Megrahi was convicted in Scotland for the 1988 bombing of Pan Am Flight 103, a flight from New York to London. All victims of the bombing were killed, including 189 American citizens.

Al-Megrahi was sentenced to life imprisonment, but was released in mid-2009 on compassionate grounds because he was said to be suffering from terminal cancer. U.S. lawmakers were angered when al-Megrahi was greeted in Libya with a hero's welcome; he survives to this day.

The issue of extradition is particularly important to voters in the New York metro area, from which a number of the American victims of the Pan Am bombing had lived. Democrats and Republicans alike from the area have demanded that al-Megrahi be sent back to prison.

Romney is the only GOP presidential candidate to make mention of al-Megrahi in reaction to the tumult this weekend in Libya; the other candidates have been more muted. The issue is especially politically difficult for those Republicans in the race who had opposed the NATO-led intervention on behalf of anti-government insurgents that President Obama had supported earlier this year.

"The crumbling of Muammar Ghadafi’s reign, a violent, repressive dictatorship with a history of terrorism, is cause for cautious celebration," said Texas Gov. Rick Perry (R), the only other candidate to issue a statement as of early Monday afternoon.

"The lasting impact of events in Libya will depend on ensuring rebel factions form a unified, civil government that guarantees personal freedoms, and builds a new relationship with the West where we are allies instead of adversaries," he said, making no mention of Obama in the statement.

One of Moammar Gadhafi's sons whom the rebels claimed to have captured appeared tonight with the Libyan strongman's troops, telling reporters that his father was safe in Tripoli and that the balance of power has shifted.
 
"We have broken the backbone of the rebels. It was a trap," Seif al Islam Gadhafi told the BBC. "We gave them a hard time, so we are winning."
 
Seif al Islam was seen laughing, carried on the shoulders of government soldiers and riding on a tank near the Rixos Hotel, where many foreign journalists are staying.
 
When asked by reporters whether Gadhafi was safe, Seif al Islam laughed and said, "Of course."
