An individual with alcoholism has a disability which is protected under the ADA .. . An employer may not refuse to hire a qualified individual because of his or her alcoholism, and may not punish an alcoholic employee more severely than non-alcoholic employees for the same conduct.
Reasonable accommodation for alcoholics: Although employers must provide reasonable accommodation to alcoholics in appropriate cases, an employer is never required to provide an accommodation to facilitate employee alcoholism or tolerate substandard performance resulting from alcoholism.
For example, an employer need not allow an employee to come in late on Monday mornings due to weekend binges. Reasonable accommodation may include, however, allowing an alcoholic employee time off to participate in a rehabilitation program or attend Alcoholics Anonymous meetings. Employers are not required to provide a reasonable accommodation which creates undue hardship for the employer.
