How quickly it's been forgotten that at one point the Obama administration decided it wouldn't go after medical marijuana and then reversed itself.  But yeah, the administration doesn't get involved with laws -

Bottom line is that Obama is the top dog of the executive.  When the DOJ argues one side of a case, it the Obama's Administrations side that is being argued REGARDLESS of whether Obama personally signed off on the case or not.
