Voter Fraud Is Real. Here’s The Proof
Data suggests millions of voter registrations are fraudulent or invalid. That’s enough to tip an election, easily.

This week, liberals have been repeating their frequent claim that voter fraud doesn’t exist. A recent Salon article argues that “voter fraud just isn’t a problem in Pennsylvania,” despite evidence to the contrary. Another article argues that voter fraud is entirely in the imagination of those who use voter ID laws to deny minorities the right to vote.

Yet as the election approaches, more and more cases of voter fraud are beginning to surface. In Colorado, multiple instances were found of dead people attempting to vote. Stunningly, “a woman named Sara Sosa who died in 2009 cast ballots in 2010, 2011, 2012 and 2013.” In Virginia, it was found that nearly 20 voter applications were turned in under the names of dead people.

In Texas, authorities are investigating criminals who are using the technique of “vote harvesting” to illegally procure votes for their candidates. “Harvesting” is the practice of illegally obtaining the signatures of valid voters in order to vote in their name without their consent for the candidate(s) the criminal supports.

These are just some instances of voter fraud we know about. It would be silly to assume cases that have been discovered are the only cases of fraud. Indeed according to a Pew Charitable Trust report from February 2012, one in eight voter registrations are “significantly inaccurate or no longer valid.” Since there are 146 million Americans registered to vote, this translates to a stunning 18 million invalid voter registrations on the books. Further, “More than 1.8 million deceased individuals are listed as voters, and approximately 2.75 million people have registrations in more than one state.” Numbers of this scale obviously provide ripe opportunity for fraud.

Don’t Let Data Contradict My Narrative
Yet in spite of all this, a report by the Brennan Center at New York Univeristy claims voter fraud is a myth. It argues that North Carolina, which passed comprehensive measures to prevent voter fraud, “failed to identify even a single individual who has ever been charged with committing in-person voter fraud in North Carolina.” However, this faulty reasoning does not point to the lack of in-person voter fraud, but rather to lack of enforcement mechanisms to identify and prosecute in-person voter fraud.

The science of criminal justice tells us that many crimes go unreported, and the more “victimless” the crime, the more this happens. The fact is, a person attempting to commit voter fraud is very unlikely to be caught, which increases the incentive to commit the crime.

The National Crime Victimization Survey (NCVS) is a sophisticated, comprehensive effort to catalog “the number and types of crimes not reported to law enforcement authorities.” However, it tends to deal mostly in violent crimes. As complex as the NCVS is, gathering accurate data for unreported victimless crimes such as voter fraud is even harder, since 1) outside of the criminal, no one may know a crime has taken place, and 2) there is no direct victim to report the crime in the first place. Yet we are expected to believe that, unlike violent crime, voter fraud is limited only to the cases that are actually reported and prosecuted? This is a senseless position.

Further, the Brennan Center report argues that because prosecutor Kris Kobach’s review of 84 million votes cast in 22 states found only 14 instances of fraud referred for prosecution (which amounts to a 0.00000017 percent fraud rate), voter fraud is so statistically small that it’s a non-issue. Let’s follow this logic. Does the fact that 109 people were cited for jaywalking in Seattle in 2009 mean that only 109 people jaywalked in Seattle that year? Does the fact that 103,733 people were cited for driving without a seatbelt in Tennessee in 2015 mean that only that many people were driving without seatbelt in Tennessee in 2015?

Absolutely not. This can be proven easily because in 2014, the previous year, only 29,470 people were cited. The disparity is largely due to increased enforcement efforts in 2015. In other words, increasing enforcement of the crime revealed a much larger number of people committing the crime.

The exact same is true for voter fraud. We have no reason to believe that the low number of prosecutions means only that exact amount of voter fraud is happening. Rather, it could mean a lack of enforcement is failing to reveal the bulk of the violations that are occurring. Thus, as with many types of crimes, especially victimless crimes, the real number of cases is likely significantly higher than the number reported.

How to Effectively Target Voter Fraud
So now that we know voter fraud is a serious issue, what are some solutions to this problem? States like Michigan have Poll Challenger programs, where observers from both parties may be present at voter check-in tables at precincts. They check each voter’s ID against a database of registered voters for that precinct to ensure the person attempting to vote is actually legally qualified to vote in that precinct. If there’s a discrepancy, the poll challenger may officially challenge the ballot. Other states should implement similar programs.

States should sponsor initiatives to remove dead voters and correct the registrations of people registered in multiple states (make them choose just one state). Since many local jurisdictions are reluctant to clean their voter rolls, federal or state oversight with teeth may be necessary.

Further, voter ID laws, such as the one implemented by North Carolina, but (wrongly) struck down by three liberal judges on the U.S. Court of Appeals for the Fourth Circuit— one appointed by Bill Clinton and the other two appointed by President Obama—are needed to ensure there’s no cheating with votes. States should continue to press the issue regardless of recent setbacks by liberal activist judges.

Finally, some have claimed that strong voter ID laws are racist, because they disproportionately impact minorities and would prevent minorities from voting. As a black person, I’m naturally interested in this claim. Thankfully, it turns out to be false. The Heritage Foundation has shown that black voter turnout actually increased after North Carolina passed its voter ID law.

Not only was the claimed negative outcome false, but the reasoning was faulty as well. The fact that the law disproportionately impacts minorities does not mean that it is discriminatory. It means, unfortunately, that fewer minorities are in compliance with common-sense safeguards to protect the integrity of our elections (i.e., having a driver’s license or photo ID).

To mitigate this concern, states can offer a service that will take people without valid ID to their local government office to apply for proper ID, free of charge. Users could schedule the pickup with their smartphone or a phone call. That way there will be as few barriers as possible to those who want to vote and are capable of obtaining a valid ID, but cannot due to transportation concerns (a reason often given by those who claim voter ID laws hurt minorities).

So let us not believe false claims that voter fraud doesn’t exist. It’s real, and we must work to stop it, while making sure those who are eligible to vote but without proper ID are accommodated fairly.

2 Investigators: Chicago Voters Cast Ballots From Beyond The Grave

CHICAGO (CBS) — Susie Sallee was buried in 1998. Yet records show she voted in Chicago 12 years later.

Victor Crosswell died in 1994, but records show he's voted six times since then.

And there's Floyd Stevens.  Records show he's voted 11 times since his death in 1993.

"It's crazy," Sharon Stevens Anderson, Stevens' daughter, tells CBS 2's Pam Zekman.  "I don't see how people can be able to do something like that and get away with it."

Those are just a few of the cases CBS 2 Investigators found by merging Chicago Board of Election voter histories with the death master file from the Social Security Administration. 

In all, the analysis showed 119 dead people have voted a total of 229 times in Chicago in the last decade.

Action News Investigation: Voting from the Grave

PHILADELPHIA (WPVI) --

The key to one of the most contentious presidential elections in history could be right here in the Keystone state.

Republican candidate Donald Trump has made allegations of fraud at polls in the City of Philadelphia.

So, Action News dug through a decade's worth of election and death records to see if there was any truth to the claim.

Some of what Action News investigation found was stunning.

Rita A. Pezzano, who passed a decade ago, was found listed as an active voter. Her daughter-in-law was shocked when we shared the news.

"I was about seven months pregnant when she died," said Audrey Marchiano.

"So she has been dead about 10 years now?" asked Investigative Reporter Wendy Saltzman.

"Yes," said Marchiano.

Pezzano passed in 2006. But state voting records show the South Philadelphia native still listed as an "Active Voter" who cast ballots in 2008, 2012, 2014, and the 2016 primary election.

Wendy Saltzman asked Marchiano if there was any way Pezzano could have voted in 2016.

"Not if she was dead," Marchiano replied. "So no."

Our investigation also found Joseph B. Haggarty resting peacefully in a Bucks County cemetery. His grave marker confirmed he died in 2010, but records show he voted five years after his death.

"Any chance he voted in 2015?" Wendy Saltzman asked a neighbor.

"I'm sure he didn't, personally. God rest his soul, he's long gone," he replied.

Action News also found Paul Bunch, who died in 2006, also cast a vote in this year's primary which was nearly ten years after death records show he died.

Wendy Saltzman asked Bunch's former neighbor if that seemed impossible.

"I believe so. It sounds like it, unless he is coming back from the dead," he said.


Action News also visited the former neighborhood of Concetta Gallara. Records show she died in 2009, but voted in 2013.

When asked if there was a way Gallara could have voted, her former neighbor Jeanie Pizzo told Saltzman, "I don't know, it's awfully funny. Unless a dead person came out of their grave."

Action News took our findings to election watchdog, The Committee of Seventy.

President and CEO David Thornburgh said, "There's going to be some error and some level of petty fraud and we should have no tolerance for that."

We also asked Philadelphia City Commissioner Al Schmidt, who is a Republican, about our findings. His office is in charge of overseeing Philadelphia's elections.

"It is certainly an irregularity, there is no doubt about that," Schmidt said.

Commissioner Schmidt's office also checked some of the names Action News provided them. Schmidt said in the small sample-check he did, his office found no clear evidence of fraud.

"We do have one guy that is questionable, definitely," he added.

Schmidt also said that most of the issues he found would be considered human error. He cited things like poll workers scanning the wrong name, a person who would have signed in the wrong spot, or a son with the same name who may have voted in his dead father's place instead of his own.

Saltzman also asked Schmidt about how people like Timothy Turner could still be an active voter in Philadelphia.

"Timothy Turner died in 2006. How is he still on the voter roles for somebody to vote in his place in 2016?" asked Saltzman.

"He would be removed if the Department of Health knew about it at the state level and then the state notifies us," Schmidt said.

Schmidt also said deceased voters would remain on the election rolls if Philadelphia County wasn't informed of their death.

We told Turner's son about his father's "vote from the grave". He told Saltzman he wasn't happy about it.

"I figure whoever is running the voter registration ain't doing their job, for them to still have my father's name and for him to have been deceased for 10 years," said Darryl Turner.

The Committee of Seventy also cautions that intentional fraud is a tiny fraction of the one million votes cast in the City of Philadelphia.

"Clearly dead people shouldn't be casting ballots," added David Thornburgh.

Thornburgh and Schmidt both agreed that the number of inaccuracies uncovered by Action News couldn't sway the election.

Saltzman asked if it could however fuel critic's questions on the legitimacy of Philadelphia's voting process.

"Doesn't that open up the voter rolls to the possibility of fraud?" Saltzman asked Schmidt.

"It definitely makes it so that there is an opportunity for it," Schmidt replied.

Schmidt also said the dead voters we uncovered will be removed from the rolls.

Harris County poll workers plead guilty to voter fraud

HOUSTON - Two Harris County poll workers pled guilty to unlawfully depositing a ballot during the May 2016 primary runoff election.

Jeanene Johnson and Latunia Thomas both took oaths swearing to be fair while working the polls during the May 2016 primary run-off. But prosecutors claim they broke that promise.

Investigators said Thomas forged her own daughter's signature and then illegally cast a vote on her behalf. They also said Johnson was aware of this and illegally checked the daughter in,even though she was not present.

They both pled guilty.

“You are stealing someone's vote, it's wrong, and we are going to be watching we are going to catch you and turn you over to the DA,” said Stanart. Both women have criminal records.

Thomas pled guilty to disorderly conduct in 2007 and assault in 1989.

Johnson was accused of hindering apprehension in 2003 and convicted of check fraud in both 1990 and 1980. She was also accused of theft in 1984.

Stanart said both women were nominated by the Harris County democratic party. His office knew about their past, but decided enough time had passed to let them work the polls.

Student headed to prison for registering dead voters for Democrats

HARRISONBURG, Va. — A man paid to register Virginia voters prior to the 2016 Presidential Election will spend at least 100 days in prison for submitting the names of deceased individuals to the Registrar’s Office.

James Madison University student Andrew J. Spieles, 21, of Harrisonburg, pled guilty Monday in the United States District Court for the Western District of Virginia. As part of the plea agreement, Spieles agreed to a prison sentence of 100 to 120 days.

Spieles worked for Harrisonburg Votes when he committed the crime, according to acting United States Attorney Rick A. Mountcastle.

Harrisonburg Votes is a political organization affiliated with the Democratic Party.

“In July 2016 Spieles’ job was to register as many voters as possible and reported to Democratic Campaign headquarters in Harrisonburg,” a U.S. Attorney’s Office spokesperson said. “In August 2016, Spieles was directed to combine his registration numbers with those of another individual because their respective territories overlapped. After filling out a registration form for a voter, Spieles entered the information into a computer system used by the Virginia Democratic Party to track information such as name, age, address and political affiliation. Every Thursday an employee/volunteer hand-delivered the paper copies of the registration forms to the Registrar’s Office in Harrisonburg.”

Later that month, someone at the Registrar’s Office called police after another employee saw a name they recognized on a registration form.

The name was the deceased father of a Rockingham County Judge.

“The Registrar’s Office discovered multiple instances of similarly falsified forms when it reviewed additional registrations. Some were in the names of deceased individuals while others bore incorrect middle names, birth dates, and social security numbers,” the spokesperson continued. “The Registrar’s Office learned that the individuals named in these forms had not in fact submitted the new voter registrations. The assistant registrar’s personal knowledge of the names of some of the individuals named in the falsified documents facilitated the detection of the crime.

“Spieles later admitted that he prepared the false voter registration forms by obtaining the name, age, and address of individuals from “walk sheets” provided to him by the Virginia Democratic Party, fabricating a birth date based on the ages listed in the walk sheet, and fabricating the social security numbers. Spieles admitted that he created all 18 fraudulent forms himself and that no one else participated in the crime.”

Boston: RMV Employees Arrested For Creating False IDs for Illegals

Four Massachusetts Registry of Motor Vehicles employees and two others were arrested for allegedly creating false identification cards for illegal aliens; some of the false ids were used to register the illegals to vote in Boston.

Mass Live reports: Four state Registry of Motor Vehicle clerks along with two other people were arrested Wednesday after authorities say they were making false identifications through the registry and selling them to people living in the country illegally, some of whom had been deported in the past.

Some of those phony licenses and identifications were used to fraudulently register to vote in Boston, according to the U.S. Attorney’s Office.

Evelyn Medina, 56, of Boston; Annette Gracia, 37, of Boston; Kimberly Jordan, 33, of Randolph; David Brimage, 46, of Boston; Bivian Yohanny Brea, 41, of Boston; and a 32-year-old man identified as John Doe were all charged in federal court with aggravated identity theft. Officials are still trying to determine John Doe’s true identity and list multiple aliases for him. Medina, Gracia, Jordan, and Brimage were employed as clerks at the Haymarket Registry of Motor Vehicles. Authorities said Brea and Flako worked with the RMV clerks to operate the scheme.

The case against the six people began after Massachusetts State Police received an anonymous letter in October 2015 claiming a “corrupt RMV employee” was providing stolen identifications and drivers’ license to people seeking the phony documents.

“An investigation revealed that several Haymarket RMV clerks – Medina, Gracia, Jordan, and Brimage – were allegedly working with Brea, who acted as the document vendor, and Flako, who acted as the document dealer, to provide licenses and identification cards to illegal aliens for cash,” the U.S. Attorney’s Office said.

These fake ids can also be used to apply for state and federal welfare benefits.

HARRISONBURG, Va. — A man paid to register Virginia voters prior to the 2016 Presidential Election will spend at least 100 days in prison for submitting the names of deceased individuals to the Registrar’s Office.

James Madison University student Andrew J. Spieles, 21, of Harrisonburg, pled guilty Monday in the United States District Court for the Western District of Virginia. As part of the plea agreement, Spieles agreed to a prison sentence of 100 to 120 days.

Spieles worked for Harrisonburg Votes when he committed the crime, according to acting United States Attorney Rick A. Mountcastle.

Harrisonburg Votes is a political organization affiliated with the Democratic Party.

“In July 2016 Spieles’ job was to register as many voters as possible and reported to Democratic Campaign headquarters in Harrisonburg,” a U.S. Attorney’s Office spokesperson said. “In August 2016, Spieles was directed to combine his registration numbers with those of another individual because their respective territories overlapped. After filling out a registration form for a voter, Spieles entered the information into a computer system used by the Virginia Democratic Party to track information such as name, age, address and political affiliation. Every Thursday an employee/volunteer hand-delivered the paper copies of the registration forms to the Registrar’s Office in Harrisonburg.”

Later that month, someone at the Registrar’s Office called police after another employee saw a name they recognized on a registration form.

The name was the deceased father of a Rockingham County Judge.

“The Registrar’s Office discovered multiple instances of similarly falsified forms when it reviewed additional registrations. Some were in the names of deceased individuals while others bore incorrect middle names, birth dates, and social security numbers,” the spokesperson continued. “The Registrar’s Office learned that the individuals named in these forms had not in fact submitted the new voter registrations. The assistant registrar’s personal knowledge of the names of some of the individuals named in the falsified documents facilitated the detection of the crime.

“Spieles later admitted that he prepared the false voter registration forms by obtaining the name, age, and address of individuals from “walk sheets” provided to him by the Virginia Democratic Party, fabricating a birth date based on the ages listed in the walk sheet, and fabricating the social security numbers. Spieles admitted that he created all 18 fraudulent forms himself and that no one else participated in the crime.”

Dozens of people who are not U.S. citizens were allowed to register to vote due to a glitch in Pennsylvania's electronic driver's license system, a Philadelphia election official said Wednesday.

Al Schmidt, a Republican who sits on Philadelphia's three-member election commission, told reporters that at least 168 noncitizens -- who are legal residents of the U.S. -- had registered to vote in the city through the licensing system.

Philly.com reported that 317 such illegal voters have contacted the commission since 2006 to have their registrations canceled. Of those, Schmidt's office said that 220 were registered to vote from 2006 to 2017. Forty-four voted in one election and 46 voted in more than one election.

"This is a real concern," Schmidt said. "It is harmful to election integrity, and it is harmful to members of the immigrant community who are applying for citizenship. If you've registered to vote in the U.S., and you're not a citizen, it's potential grounds for the denial of your citizenship application."

Schmidt said that many more noncitizens could have mistakenly registered through the system, both in Philadelphia and elsewhere in Pennsylvania. However, he pointed out that no municipal election was close enough to have potentially been affected by improper voting.

Schmidt also said that the cases likely did not rise to the level of voter fraud because of the apparent lack of intent by the registrants.

"All voter fraud is an irregularity; not all voter irregularities are fraud," he said. "Regardless of the intent, the damage is still the same."

The Pennsylvania Department of State said it is working to fix the system and was aware of the problem before Schmidt contacted it in July. A spokeswoman could not immediately say when the department first became aware of the issue.

The department is looking into the total number of mistakenly registered voters and could not provide an estimate, the spokeswoman said.

Last fall, during a legislative hearing on the integrity of the state's voting systems, Secretary of State Pedro Cortes, a Democrat, acknowledged that someone who is not a citizen "may inadvertently register" while getting or updating a driver's license, according to a transcript of the hearing.

Some 6.1 million people voted in Pennsylvania in November's presidential election, including more than 700,000 in Philadelphia. Donald Trump, a Republican, won Pennsylvania; Hillary Clinton, a Democrat, won Philadelphia.

The registration problem stemmed from electronic touch screens in state driver's license centers that were programmed to give users the option to register to vote while getting new or updated licenses. The system showed noncitizens the voter registration option, even though they had already provided information showing that they were not citizens, officials said.

"For the majority of these people, it’s completely plausible to believe they thought they were eligible to vote," Schmidt said.

In August 2016, the department took a step to try to prevent such registrations. It changed the software so that users are immediately asked if they are U.S. citizens. The process stops if a user answers "no," the department said.

It said it is working on creating a new touch-screen system in which a noncitizen would not see the motor voter screens at all, the department said.

The motor voter system may not be the only problem in Pennsylvania. Schmidt said he discovered 52 other noncitizen legal immigrants who registered to vote through other means, including paper voter registration applications. The Department of State is looking into that, as well, the spokeswoman said.

New Chicago ID card created for undocumented immigrants to be accepted for voter registration

CHICAGO (Illinois News Network) — A new municipal ID designed primarily for illegal immigrants will be accepted in Chicago as a valid form of identification to register to vote.

The CityKey will be a government-issued photo identification card available to all Chicago residents regardless of immigration status, criminal record, housing status, or gender identity, according to the city clerk’s website.

State Board of Elections spokesman Matt Dietrich says the final call on what documents to accept rests with local officials.

“There are 109 local election authorities in Illinois,” Dietrich said. “They’re the ones who actually handle the registration, the checking of IDs, and keeping the documentation. We maintain an electronic database of voter registrations that we get from them.”

Dietrich says there is no state requirement to prove citizenship while registering to vote. He’s not expecting a surge in potential voter fraud cases because the process will remain the same.

“When you go to register to vote, you do check a box that attests to your citizenship,” Dietrich said. “You are signing a legal document that says, ‘Yes, I am a citizen.’ But no one who registers to vote is required to bring in, for example, a birth certificate or other proof of citizenship. That’s something that you check the box, and you attest to it.”

Dietrich believes the penalty for illegally registering to vote is steep enough to discourage those who might be considering it.

“The main thing that would happen is deportation,” Dietrich said. “If you’re not a citizen, and you have any thoughts of ever attaining citizenship, registering to vote is almost an instant trigger that when you apply for citizenship, you will be deported. That’s one of the first things they check.”

Chicago officials will accept a long list of documents from residents to establish their identities. Current driver’s licenses and state IDs will be valid, as will expired foreign passports, foreign driver’s licenses, high school or GED diplomas, and more. Dietrich says given the information he has seen, it appears the Chicago commissioners are making the right call.

“I believe, from what I’ve read, the Chicago municipal ID would live up to the qualifications under state statute for what a government-issued ID is. So that would be a legal form of ID for the board of elections to accept.”

In addition to a photo identification, CityKey also will serve as a library card and transit card in Chicago. City leaders also are working with cultural institutions, sports teams, and local businesses to offer discounts and benefits for card holders. Officials say the card could offer the most appeal to illegal immigrants, the homeless or those recently released from prison.

A Mexican woman has been charged in Texas with voter fraud after prosecutors said she illegally voted in the 2016 presidential election.

Texas Attorney General Ken Paxton said his office will prosecute Laura Janeth Garza, a 37-year-old Mexican national who lives in Houston, after a grand jury indicted her May 10 on charges of voter impersonation and ineligible voting.

Both charges are second-degree felonies. If convicted, Garza faces two to 20 years in prison and a $10,000 fine, according to Fox 4 News in Dallas-Ft. Worth.

“This case demonstrates my office’s commitment to protecting the integrity of elections,” Paxton said in a statement. “We will continue to do everything in our power to safeguard the electoral process in Texas.”

According to the attorney general’s office, Garza is accused of voting illegally in Harris County in November 2016, as well as in elections in 2004 and 2012.

Paxton said a joint investigation with the Texas Department of Public Safety determined that Garza obtained documents to steal the identity of a U.S. citizen and illegally register to vote.

Law enforcement became aware of Garza after a U.S. citizen attempted to obtain a passport, but discovered Garza had already done so using her identity, Paxton said. The State Department referred Garza’s case to Texas Department of Public Safety, which then handed it over to Paxton’s office for prosecution.

President Trump has long claimed widespread voting fraud took place in the 2016 election, an assertion that has not been substantiated.

"It's not a conspiracy theory, folks," Trump said at an event in West Virginia last month, claiming millions voted illegally in 2016.
