Persons within the Department of Justice whose identities are not yet publicly known apparently broke the law by leaking firearms trace data to Sen. Dianne Feinstein, which she introduced in the Senate Judiciary Committee record in the hearing on Department of Justice oversight earlier this month.

“If I may,” Senator Feinstein requested at the beginning of her questioning of Attorney General Eric Holder (see webcast, at the 69:45 mark), I'd like to put in the record the official firearms trace data from the Department of Justice from 12/1/2006 to 2000...excuse me, 9/30/2011...this is guns [unintelligible] Mexico.”

Left unchallenged and unsaid is how Feinstein obtained the data, which is prohibited by the Tiahrt Amendment from being shared with anyone but law enforcement agencies and prosecutors, and only then in the course of a criminal investigation. That prohibition extends even to Senator Feinstein, as evidenced by the failed attempt earlier this year by Rep. Adam Schiff “to allow Congressional committees to be included on the list of entities to which the Bureau of Alcohol, Tobacco and Firearms can disclose part or all of the contents of the Firearms Trace System database.”

3 Perdue associates indicted

A Wake County grand jury today handed down indictments alleging that a top aide to Gov. Bev Perdue's 2008 campaign schemed to pay a staffer $32,000 for work that was kept off the books in violation of state election laws.


The new charges, all felonies, are part of a long-running investigation into Perdue campaign activities that have focused on expenditures that would have triggered election law violations for exceeding the limit on personal donations if they had been reported. Earlier this year a retired state magistrate was charged with obstruction of justice for allegedly trying to hide an illegal campaign flight.

Wake County District Attorney Colon Willoughby has said that Perdue, a former lieutenant governor and state lawmaker, is not a target of the probe, but today's indictment reached into the campaign's inner circle.

  "The conduct of the governor has not been an issue, nor any other elected official," Willoughby said. "She cooperated in the investigation, was interviewed, we asked her not to talk about the facts of the case. We thought it might be inappropriate, and there might be additional charges."

Peter Reichard, a Greensboro businessman who served as the Perdue campaign's finance director, was charged with obstruction of justice. Reichard has been a key player in the gubernatorial campaigns of Perdue and her predecessor, Mike Easley, both Democrats. Reichard served as Easley's finance director for his 2000 gubernatorial campaign.

Reichard's attorney, Hart Miles, said in a statement that his client was disappointed to learn of the indictments. Miles urged the public to withhold judgment until all the facts are known.

"We are prepared to go to trial if necessary," Miles said. "But, Peter's goal is to work in good faith with the District Attorney to see if this case can be resolved without a lengthy and costly trial. Peter is a man who accepts responsibility for his actions."

The indictment against him said his business, Tryon Capital Ventures, received $32,000 in contributions or loans from Charles Michael Fulenwider, a Perdue contributor from Morganton who owns fast food restaurants and had arranged several campaign flights for her. Reichard used the $32,000, disguised as consulting services, to compensate Julia Leigh Sitton, who later became the director of the governor's Western office. She is also known as Juleigh Sitton.

Sitton was charged with obstruction of justice and causing the Perdue campaign to file false reports. She resigned from the director's position in August and had been making $50,000 a year. She is a Morganton attorney who has long been active in Democratic political campaigns. Perdue campaign finance records show she was reimbursed for roughly $4,500 in campaign expenses in the 2008 election.

Trawick "Buzzy" Stubbs, a New Bern attorney who was a longtime law partner with Perdue's first husband, was charged with obstruction of justice and causing the filing of false campaign reports. The indictments say Stubbs caused the Perdue campaign to file false reports that did not disclose roughly $28,000 in campaign flights. Stubbs reported the flights as expenditures to the N.C. Democratic Party, when he knew that the flights benefited Perdue, the indictment said.

The unreported flights first turned up in a State Board of Elections investigation last year. Election laws prohibit giving more than $4,000 in cash or services to a candidate in an election cycle.

The election board investigation found that Stubbs wanted the travel he provided to be handled properly, but told investigators that he couldn't get the campaign to focus. One elections board report said Stubbs was "told of a variety of ways the travel payments could be handled and that he often was not comfortable with the information that he was being provided."

Stubbs said in a statement that he has cooperated "fully and voluntarily" with the state investigation and was saddened to learn of the indictments.

"It was never my intent to violate any law and I intend to plead not guilty," Stubbs said.

He added that he never sought or received any benefit for supporting Perdue's campaign.

The Perdue campaign was required to pay a $30,000 fine and return more than $20,000 in illegal campaign donations after election board probes.

Perdue issued a statement saying her campaign has cooperated fully with the investigation, but she would not comment on the charges. She said the investigation confirms that she "as a citizen, a candidate for public office, and an elected official" has "strived to follow the rules and laws."

Willoughby did not know when Reichard, Sitton or Stubbs would be required to appear in court.

Federal investigators have also been looking into the Perdue campaign.

Wake County District Attorney Colon Willoughby said Monday that Gov. Bev Perdue is not the focus of a year-long campaign finance investigation that led to the indictments of two of her former staffers and a longtime friend.

Still, the charges are apparently enough to embolden Rep. Bill Faison, who said earlier after some controversy that he would not challenge Perdue in a primary.

Faison, D-Orange, said Tuesday he believes Perdue will step aside.

“You have all these indictments. And the focus of the governor’s office ought to be on the people and ought to be dealing with the economic crisis we got,” Faison said.

“Clearly, the DA is saying that they’re still investigating this matter, so it’s not over. Clearly, the governor’s office is focused on those investigations and the consequences of them, and the focus ought to be on the people," he said.

"So I think, ultimately, Gov. Perdue will do the right thing and decide not to run. I don’t believe you’ll ever see her file,” Faison said.

Another Obama donor convicted of fraud

File this one under culture of corruption. Obama supporters just can’t seem to stay out of trouble, can they? This latest scandal involves a former Tarheels basketball player and a $21 million bank fraud scheme. New York Daily News reports:

Courtney Dupree was convicted of vastly overstating the billings of his Long Island City-based lighting company GDC Acquisitions in order to fraudulently obtain a loan from Amalgamated Bank.

Dupree, 42, sat stone-faced as the verdict was read in Brooklyn Federal Court. He faces up to 30 years in prison and has to pay back at least $18 million. …

Dupree, who attended the elite Wharton School of Business, was a rainmaker in Democratic circles.

In 2008, Dupree hosted a $1,000-a-ticket fund-raiser for Barack Obama at his Broad St. apartment that was attended by top aide Valerie Jarrett.

His company counted NBC Universal and Goldman Sachs among its clients.

Such corruption occurs on either side of the aisle, of course, but that makes it no less disappointing when it happens.

Richard Rubin — husband of former Broward County Commissioner Diana Wasserman-Rubin, who still faces seven felony charges of her own — was sentenced this morning to ten months in federal prison.

Rubin, 66, pleaded guilty in April to federal tax evasion after failing to report $100,000 in fees he received from the town of Davie for a land deal he brokered in 2004.

With attorney David Bogenschutz at his side, Rubin managed to get only ten months up the river — which is in accordance with sentencing guidelines but much less than the maximum penalty of five years.

Former U.S. Democrat Representative Corrine Brown was found guilty on 18 of 22 charges for fraud and tax evasion during trial verdict Thursday in federal court in Jacksonville.

Brown was found guilty of taking tens-of-thousands of dollars from her One Door for Education Foundation, a charity for poor and impoverished children, and putting the money into her personal accounts for use in maintaining an indulgent lifestyle. She was also found guilty of conspiring within the scheme to defraud donors to the foundation, and guilty of attempts to impede/obstruct the investigation.

Hina Alvi, her husband Imran Awan, and his brothers Abid and Jamal were highly paid shared IT administrators working for multiple House Democrats until their access to congressional IT systems was terminated Feb. 2 as a result of the investigation. Capitol Police confirmed the investigation is ongoing, but no arrests have been reported in the case.

Philadelphia District Attorney Seth Williams pleads guilty in his federal corruption trial

Seth Williams resigned as Philadelphia’s district attorney and was led out of court in handcuffs Thursday after abruptly ending his trial on federal bribery charges with a guilty plea.

Williams, who saw embarrassing details about his messy personal life and financial struggles dragged out into open court during the nearly two-week trial, pleaded guilty to one count related to accepting a bribe from Bucks County businessman Mohammad Ali.

“I have a guilty plea from the highest law officer in the city that he betrayed his office and he sold his office … I am appalled by the evidence that I heard,” Diamond said before ordering Williams jailed. “I simply do not credit this defendant’s testimony. I do not believe him.”

Democratic Kentucky state Sen. Julian Carroll was officially removed from his position as minority whip Sunday following a local news report that alleged the lawmaker groped a male staffer in 2005.

The Senate Democratic caucus formally voted to remove Carroll and called for him to resign his office, according to a Spectrum News report.

“In light of recent media reports, the Senate Democratic Caucus has voted to remove Senator Carroll from his leadership position as minority whip,” Senate Democrats said in a statement. “The Senate Democratic Caucus calls on Senator Carroll to resign his Kentucky State Senate seat, immediately.”

The lawmaker allegedly told local photographer, Jason Geis, he would help him get into art school and then groped him, before propositioning him for sexual favors, according to a recording provided by Geis.

“I want to be your friend,” Carroll said to Geis in 2005. “But you know what I want don’t you? I want to be relieved.” The then-75-year-old lawmaker ordered Geis to “jack me off.”

The aging Democrat then told the aspiring photographer to provide him oral sex before cautioning “I don’t want you to do anything you don’t want to do.”

Carroll has yet to publicly address the allegations made in the report, but he told local reporter Rick Storm that the claims were “ridiculous” and that they “never happened.”

'A 'For Sale' Sign at City Hall': FBI Indicts 2 PA Dem Mayors in Pay-to-Play Probe

Two Democratic Pennsylvania mayors were indicted Wednesday as part of a wide-ranging FBI corruption probe.

The mayors of Reading and Allentown - the state's third-largest city - were named among the defendants in the five-person indictment.

Acting U.S. Attorney for Eastern Pennsylvania Louis Lappen said Allentown Mayor Ed Pawlowski (D) was charged with 14 counts relating to running a pay-to-play scheme, and other offenses.

Lappen said Pawlowski and former Reading Mayor Vaughn Spencer (D) "essentially put up a 'for sale' sign in front of their city halls to sell city work to the highest bidder," Lappen said, according to WFMZ-69 News.

A last-ditch attempt by Democratic senator Bob Menendez (N.J.) to avoid a federal corruption trial slated to start next month was rejected by a federal judge on Wednesday.

Menendez, accused of giving political favors to Florida eye doctor Salomon Melgen in exchange for campaign contributions and gifts, asked that the case against him be dismissed on account of the Supreme Court's 2016 decision to overturn the corruption conviction of former Virginia governor Bob McDonnell (R.).

Menendez's attorneys argued that none of the alleged assistance he offered Melgen were "official acts," and therefore, based on the Supreme Court's McDonnell decision, the legal argument against him was invalid.

U.S. District Court Judge William Walls said the determination of whether Menendez performed an "official act" in his attempts to benefit Melgen will be made during the trial, which is set to begin on Sept. 6.

"Whether the acts alleged in the Superseding Indictment satisfy the definition of an ‘official act’ under McDonnell is a factual determination that cannot be resolved before the Government has the opportunity to present evidence at trial," wrote Walls in his rejection of the dismissal request.

Menendez received campaign contributions from Melgen, in addition to flights on private jets and luxury vacations.

For years, David Binkle was hailed as a pioneer among school nutrition advocates for accomplishing a near-herculean task – using produce and meats provided by local growers to greatly reduce the number of fatty meals served in the nation’s second-largest school district.

The Los Angeles Unified School District serves nearly 700,000 meals per day, and the professional chef helped lead a charge that saw vegetarian curries, pad Thai noodles and quinoa salads replace old cafeteria staples like chicken nuggets and corn dogs.

The initiatives won the district numerous awards, drew praise from then-First Lady Michelle Obama as she led a national push to combat childhood obesity, and earned Binkle appearances on Tedx Talks.

But as he was revolutionizing meals for the district’s students, prosecutors allege, Binkle illegally funneled roughly $65,000 of the district’s money into a private consulting firm he ran, then placed some of that money into his own pocket.

The 55-year-old appeared in court on Tuesday and pleaded not guilty to 15 felony counts including embezzlement and misappropriation of public funds. He posted $220,000 bail and is scheduled to return to court in October.

“While recognizing that everyone is innocent until proven guilty, the charges against Mr. Binkle are extremely upsetting as they do not reflect the professionalism, ethics and character we expect of all L.A. Unified employees,” the school district said in a statement.

L.A. Unified food guru David Binkle is pulled from job
Emails and calls to Binkle seeking comment were not returned. His attorney, Alec Rose, declined to comment. In a previous statement to The Times, Binkle denied wrongdoing and said allegations of financial misconduct were unsubstantiated.

According to court documents, Binkle repeatedly misappropriated district funds in amounts ranging from $5,000 to $15,000 between 2010 and 2014. Prosecutors also allege that he forged an application to become a vendor with the district and failed to disclose outside financial interests.

If convicted, he faces up to 13 years in prison.

Binkle worked as a chef before joining the district as deputy director of food services in 2008.

His initiatives to push for healthier food won praise from Washington D.C. and Los Angeles, and Binkle enjoyed broad support from school nutrition advocates, local farmers and the union that represented school service managers. Binkle was credited with adopting menus that lowered the sodium and fat content of school meals and with increasing the amount of food served daily in cafeterias.

Binkle dramatically altered the way the district procured ingredients, opting for years-long contracts with providers that included Tyson Foods Inc., Jennie-O Turkey Store Sales, Goldstar Foods, Five Star Gourmet Foods, Driftwood Dairy and Don Lee Farms. Five of the vendors also agreed to contribute approximately $500,000 annually to a marketing program that promoted healthy eating in the district's schools.

But problems began to arise. George Beck, a former food-services deputy branch director responsible for accounting and budgets, previously told The Times he began questioning Binkle’s management of the marketing program as early as 2011.

The district took no corrective action however, according to Beck, who says he was laid off in retaliation two years later.

In 2012, Binkle was elevated to the position of director of food services, overseeing a program with a budget of hundreds of millions of dollars.

In November 2014, a scathing report from the district’s Office of the Inspector General accused him of failing to disclose his ownership of an outside culinary consulting firm or report payments from vendors to attend school nutrition conferences.

His firm, California Culinary Consulting, presented “at minimum an appearance of a conflict of interest,” the audit said. And the marketing program was “being mismanaged and at worst being consistently abused” by Binkle, according to the audit.

A month later, the district placed Binkle on unpaid leave. At the time, he was making an annual salary of $152,000.

In an email to the Times in 2015, Binkle said the state conflict-of-interest law did not require him to disclose anything about his firm because all of his consulting income that year came from outside Los Angeles County.

Binkle said he was “frustrated and baffled" by the allegations. He insisted his use of the marketing funds was aboveboard and had been approved by district supervisors, including the former chief financial officer and then chief deputy superintendent Michelle King, who now runs the district.

“I have done nothing wrong and have nothing to hide, since my actions were approved and encouraged from senior district officials, general counsel or the ethics office,” Binkle wrote in the email. “I am confident the truth and facts will show the allegations are unsubstantiated.”

Beck said the allegations against Binkle represent a larger problem within the district. Binkle, Beck said, was allowed to operate with virtually no supervision, creating a situation that cost the district money and allowed him to enter into contracts with vendors with essentially no input from other school officials.

“He negotiated these contracts with these firms with no oversight, nobody else participating. It was a huge procurement bureaucracy. There was one contract for vegetarian entrees, and I remember sitting in a meeting with 35 people. Binkle was there. He had one entrée that was $2.25 per item, and our reimbursement was less than the cost of the meal,” Beck said. “Every meal that we sold, we were losing money.”

When informed of the charges against Binkle by a Times reporter, Beck said he felt vindicated.

“You have absolutely made my afternoon,” Beck said.

Binkle remains employed as an adjunct culinary instructor at the College of the Canyons in Santa Clarita, according to a spokesman for the school. He has been employed there since August 2009 and is scheduled to teach a class in the fall.

While they declined to comment on the criminal charges, school nutrition advocates praised Binkle’s work in Los Angeles, saying he did his best to provide healthy food to hundreds of thousands of schoolchildren.

“David worked hard to improve the menus, the ingredients, the presentation and the student nutrition experience,” said Matthew Sharp, a longtime school nutrition advocate who has worked extensively with Los Angeles schools.

Beck said he still can’t believe it took six years, and outside intervention by prosecutors, to get to the bottom of the conduct he uncovered long ago.

“All these internal control entities that were supposed to be exercising internal control were not doing it,” he said. “I brought it to their attention, and they did nothing about it.”

The above article about LA school food, is pretty bizarre. What can you really do with $65,000 that you've embezzled over the course of four to five years? Why risk your freedoms for such a small amount of money? Also, the part where he could negotiate contracts for food without any other input is pretty bad. He was costing them money with every meal. I applaud the idea of getting kids to eat healthier, but not at that cost.

FBI agents suspect somebody in Congress tipped off the Awans that they would be indicted and now the criminal cases once-seemingly isolated to a group of rogue Pakistani IT specialists working for Congress suddenly has gotten much larger. And much more troubling.

Federal agents said preceding his arrest, Imran Awan acted like a man who was recently tipped off that he would be pinched and moreover, it was no coincidence Awan’s wife was whisked out of the country in March after sidestepping the FBI at Dulles International Airport to flee to Pakistan.

“She had cardboard boxes for luggage,” one FBI agent said. “The school didn’t even know she took her kids out.”

Now a faction of FBI veterans believe the couple’s puzzling behavior is explained by even more troubling revelations: Information about the Grand Jury convened to investigate Awan and his wife Hina Alvi for bank fraud and illicit money transfers was likely leaked to the Pakistani couple. Awan and Alvi were both former IT workers hired by Democratic Rep. Debbie Wasserman Schultz. Additionally, Imran and his wife — along with two brothers — performed IT and computer programming work for at least 18 more Democratic lawmakers in Congress. But it was Wasserman, the former chairwoman of the DNC, who kept the pair employed despite the booming criminal case.

Imran Awan, the former computer administrator who worked for Rep. Debbie Wasserman Schultz and scores of other Democrats, is currently on bail.

He is under a high-intensity supervision program and must wear a monitoring device and stay within 50 miles of his house.

The 37-year-old was spotted looking relaxed in a casual white tee shirt and earbuds, after getting out of a blue Mitsubishi outside his home in northern Virginia. Imran and his family members - including his wife, who is also indicted - ran IT for at least 60 Democrats in congress over the past decade and for the House Democratic Caucus, giving them access to emails and computer data from an estimated 800 lawmakers and staffers.

Now they are at the center of a probe into what happened to the data they had access to - and

'There are possibilities that [Imran] or them might have been selling this information to anybody who is not authorized to have them.'

The group was blocked from accessing the House computer network in February, after police began investigating them for potential data and equipment theft, including suspicions that they transferred data to an off-site server.

The investigation has many staffers questioning whether their secrets could have been compromised by the group or even given to outside sources.

Imran was arrested on mortgage fraud charges by the FBI on July 24...

Report: Indicted state Rep. Dawnna Dukes spent $51k on online psychic

State Rep. Dawnna Dukes, the Austin Democrat facing corruption charges, failed to turn over a cell phone to investigators and spent more than $51,000 on an online psychic, according to a legal filing reported by the Austin American-Statesman on Wednesday.

The document obtained by the Statesman reveals that Travis County prosecutors intend to present the information as evidence in Dukes’ misdemeanor trial next month, part of 19 “extraneous acts” chronicled by prosecutors. Dukes is accused of using her legislative to staff run personal errands and being compensated for days she did not work at the Texas Capitol.

In addition to the large psychic bill and Dukes’ giving investigators a phone whose identification number did not match the one they had requested, other “extraneous acts” include Dukes’ being recorded absent for more than half of roll calls taken during the 2017 legislative session, the Statesman reported.

A Travis County grand jury in January indicted Dukes on two charges of abuse of official capacity by a public servant, a misdemeanor punishable by up to a year in jail and a fine of up to $4,000. Those charges allege that Dukes used her legislative staff to work on the African-American Community Heritage Festival and be a live-in nanny for her daughter.

At the same time, Dukes was charged with 13 counts of tampering with a governmental record, a felony punishable by up to two years in jail and a fine of up to $10,000. These charges are based on allegations that Dukes made false entries on travel vouchers to obtain money for expenses she was not entitled to. But Travis County prosecutors put their felony case on hold earlier this month after a key witness’s story changed about the official paperwork that Dukes was accused of having falsified.

In June, the 12-term lawmaker pleaded not guilty to tampering with a governmental record and abuse of official capacity by a public servant. Judge Brad Urrutia set a trial date of Oct. 16.

Democratic strateist Doug Schoen, who worked on Bill Clinton's 1996 campaign and Hillary clinton's 2008 campaign, said that, given the allegations of "rigging" the primaries against Bernie Sanders by the DNC and new revelations about the Clinton email and Uranium One scandals, it is time for a "special prosecutor" to look into the entire mess.

Schoen, a Harvard Law School and Oxford University graduate, added that "the entire Democratic Party stinks from the head down, the whole process," and "everyone really has a stain on their hand."

Schoen made his remarks on the Nov. 6 edition of Hannity, where he was joined by Tezlyn Figaro, the national justice director for the Bernie Sanders 2016 presidential campaign.

Commenting on the Democratic National Committee (DNC) in 2016 and the Hillary Clinton scandals, Schoen said, "Look, I support the general thrust of what you and certainly Tezlyn [Figaro] are saying. People were disenfranchised [in 2016]. But I want to go a step further tonight. The entire Democratic Party stinks from the head down. The whole process. Everyone has really a stain on their hand."

“And with this new revelation tonight on the [Clinton] emails that probably involved 'gross negligence,' it strengthens my call and that of others for a special prosecutor to look at that, [James] Comey, the gross negligence, to look at the email deal more generally, to look at Uranium One," said Schoen.

“The dossier, all of it," he said. "Because at this point, what we know is getting more and more troubling."

"I say this is a loyal Democrat," said Schoen. "I know Tezlyn is a loyal Democrat. But as she said and I would say, this is not partisan, this is about -- democracy.”

Host Sean Hannity then remarked, “Listen, you hear me. I am more critical of Republicans. They are weak and timid and they've lost their identity and vision. Their inability to keep promises. I am more critical of them. And you are more critical. What do you make of every Democrat that has gone out there, oh no big deal? Oh, so what, we disenfranchised Bernie people? Really?"

Schoen answered, “I was the only mainstream Democrat that I'm aware of, who publicly disavowed Hillary in the election."

"And my point is, I said there would be a constitutional crisis if she was elected," said Schoen. "We have one now and she wasn't elected. Tezlyn, it stinks. It's rotten! It's more than rigged.”

Corrine Brown convicted of 18 felonies, could be sentenced to decades in prison

A jury convicted former U.S. Rep. Corrine Brown today of financial crimes that could put her in prison for years, potentially the rest of her life.

 

The verdict came three days after closing arguments in a trial where Brown was painted as living the high life on cash that aides secretly deposited in her bank account after passing it through other accounts.

Brown remained free after the verdict was announced. She is expected to be sentenced within 120 days.

The jury convicted Brown of 18 of the 22 separate criminal counts a grand jury indicted her for in July. The convictions involve conspiracy, mail fraud, wire fraud, tax crimes and hiding income she should have publicly reported.

She was found not guilty of two counts of mail fraud and two counts of wire fraud.

Brown could in theory be sentenced to decades in prison, but that decision is likely more than three months away. No sentencing date was immediately set.

Each fraud or conspiracy conviction carries a potential 20-year sentence, and each tax conviction three years. Hiding income could lead to another five-year sentence.

The convictions affirm parts of a narrative prosecutors told of Brown breaking laws while she lived an unsustainable expensive lifestyle that left her desperate for cash.

Jurors were told the brash 70-year-old Democratic icon, who spent 24 years in Congress before losing reelection last year, received $141,000 in untraceable cash over several years through sources including the sham charity One Door for Education and her Friends of Corrine Brown campaign committee.

An FBI accountant testified Brown, who earned around $175,000 a year as a member of Congress with a pension from the Florida Legislature, spent an average of $1,438 per month more than her reported income.

“Former Congresswoman Brown took an oath year after year to serve others, but instead she exploited the needs of children and deceived her constituents to advance her own personal and political agendas,” said FBI Jacksonville Division Special Agent in Charge Charles Spencer in a prepared statement.

“Corrupt public officials undermine the integrity of our government and violate the public’s trust, and that is why investigating public corruption remains the FBI’s top criminal priority,” Spencer said. “I am proud of our special agents, analysts and support personnel who spent countless hours following the money trail in this case, and thank our law enforcement partners at the IRS-CI and U.S. Attorney’s Office for their efforts to hold Brown and her associates accountable for their inexcusable actions.”
