so my girlfriend has a job working at cracker barrel, an usually works in 4 to 5 hour shifts 3-4 days a week. She told me she needed a break just to eat a little peice of bread after 3 hours for no more than 5 minites and her manager gave her an attitude about it.

however in her employee handbook it states ver batem

"As a non-exempt employee you get paid work breaks totaling one half hour for every eight hour shift you work. Where this policy conflicts with state law, Cracker Barrel complies with state law."

so answer me this , is she entitled to a break even if her shifts are only 4-5 hours? ( of course i think she is atleast 5 minites)

if this happens again im going to confront the managers about this. even the employee handbook is using shady language that i have depicted above seems highly suspect that they are trying to breeze over the issue or intimidate someone from confronting the issue.

waitressing is just like painting you gotta have calories in you like every damn hour to repair your muscles, i hate these redneck buisnesses with bald headed f/\G managers who think people can run off of air and red meat.

so with all this being said am i in the right or the wrong "LEGALLY" in my general feelings about all this?

This will likely solve the problem, fat and bald meat-eating manager will be intimidated by a man of Falcon's stature and will acquiesce.

it's true under 5 hours, no breaks nothing. Ask her if there are any smokers in the building and if so, have her mention to her boss all the company time they waste on their cigarette breaks.

Your boss must give you a rest break of at least 10 consecutive minutes for each 4 hours.

JF doesn't need to catch a case for something she herself needs to deal with. It's in the employee handbook, and if they comply with State Laws, oh well...
Plus, it it doesn't take a person five minutes to eat a piece of bread, especially at Cracker Barrell...
