A gay man was arrested at a hospital in Missouri this week when he refused to leave the bedside of his partner, and now a restraining order is preventing him from any type of visitation.

Roger Gorley told WDAF that even though he has power of attorney to handle his partner’s affairs, a family member asked him to leave when he visited Research Medical Center in Kansas City on Tuesday.

Gorley said he refused to leave his partner Allen’s bedside, and that’s when security put him in handcuffs and escorted him from the building.


“I was not recognized as being the husband, I wasn’t recognized as being the partner,” Gorley explained.

He said the nurse refused to confirm that the couple shared power of attorney and made medical decision for each other.

“She didn’t even bother to look it up, to check in to it,” the Lee’s Summit resident recalled.

In a 2010 memorandum, President Barack Obama ordered hospitals that receive Medicare or Medicaid funding to allow visitation rights for gay and lesbian partners.

For its part, Research Medical Center insisted that it does not discriminate based on sexual orientation.

“We believe involving the family is an important part of the patient care process,” the hospital said in a statement. “And, the patient`s needs are always our first priority. When anyone becomes disruptive to providing the necessary patient care, we involve our security team to help calm the situation and to protect our patients and staff. If the situation continues to escalate, we have no choice but to request police assistance.”


Gorley cannot currently visit his partner at all due to a restraining order issued after his arrest on Tuesday.

That's precisely why "separate but equal" should NEVER be allowed to apply. Let them marry for goodness sakes!

Can you picture a situation where a man refuses to leave his dying wife's side because her brother or cousin wants to be alone with her, ...and they through the husband out of the hospital? can you picture the shit storm if a woman refused to leave her dying husband's side, so his extended family wanted to be alone with him, ...and they throw her out of the hospital? It would NEVER happen. Hospital personnel would defer to the wishes of the spouse, and if a husband or wife chose to monopolize the last few hours of their loved ones... so be it!

This was an issue of disruptive and belligerent behavior by the visitor that affected patient care. The hospital’s response followed the same policies that would apply to any individual engaged in this behavior in a patient care setting and was not in any way related to the patient’s or the visitor’s sexual orientation or marital status. This visitor created a barrier for us to care for the patient. Attempts were made to deescalate the situation. Unfortunately, we had no choice but to involve security and the Kansas City MO Police Department.

The hospital also denies it ever filed a restraining order against Gorley.

Each side has a position in the matter. I would expect the hospital to say no less than that, ..however, the fact remains he has been denied access to his dying partner.

Let us entertain your wild speculation for a minute. Do you for a minute think that a hysterical woman who refuses to leave her dying husband's side is going to be body slammed to the floor, ...glasses flying off, ...both hearing aids flying out of her ears, and being physically removed from the premises because she was blubberring & crying over her dying partner? She'd be soothed, given a tissue, a cup of coffee, and there, there... treated with patient kid gloves. no hospital would even dare to think of doing such a thing.

Looks to me from my perspective like they decided to "man-handle the little homo" without thinking of the potential PR nightmare it could / would / did unleash!

It depends - if the doc and staff are trying to administer care of some type and the spouse or whoever refuses to leave - they should get out of the room.

What kind of care besides an operation can the facility provide that would require the spouse to be out of the room?
Were they afraid his partner might see him naked? He was removed at the request of another family member.

I have no idea - i have seen a lot of things in hospitals visiting people.   i can imagine a million scenarios here and think this twink is being a drama QUEEN.  Definately the QUEEN in the relationship.

again did you bother to read the post when the guy got to the hospital a family member asked him to leave,so if you were in his shoes and were there to see your partner and a family member asked you to leave when you have every legal right to be there you would probably get pissed

Like I said its no different than a lot of things I have seen - maybe the beta-twink was w the partner the entire time and the family asked for a few minutes alone without have his prescense there and he melted down. 

You never know.  Personally - i dont know how i would react beause im not an over emotional blubbering gay causing a rukus in the hospital
