This guy was one of my first clients ever and I was fully familiar in setting up the operation in the beginning, totally legit.  We got full license, approval, etc.  We gave him the consent forms and told him exactly what to do to be completely legitimate and he then went off on his own for a few years.  We got approval from NYS Board of Health for what he was doing provided he did it according to protocol set up to where the donors met certain conditions and the families consented w notary, documentation, etc.

We told him that he should get the families to give notary and witness statements but he got greedy and wanted nothing to do with us.  He started making millions by just stealing the body parts and took everyone down with him.

Very talented guy - but his greed and Type A personality got the best of him.

After he left, he started making millions of dollars and

Are you the sort of attorney that people say, "He's hilarious.  Keeps his clients laughing all the way to the electric chair?"

No - I rang the alarm many times that the consent protocols needed to be iron clad - but guess what happens when a cremation comes into the nursing home?

I'm sure it can get ugly in those situations.   :-\

It's gotta be tough...even though being an attorney is probably a lot different than being a nurse or doctor...I'm sure you can get emotionally attached to clients from time to time.

I had the Brooklyn DA, the NY POST , etc chasing me down but I never said shit to them.  This was set up as a legit operation (no pun intended) and corrupted by typical ginzo NYC wops.   A great idea that helped thousands of people in need, but corrupted by greedy people.

There are typically only 2 places to get bone and tissue - hospitals and funeral homes and there is HUGE COMPETITION for it.  Mastromarino was a brilliant guy and knew that hospitals kept the tissue and bone for themselves and could create and supply a huge market for biotissue companies via funeral homes.

What did he do?  Here is how it worked:

You get a poor ass family in Bronx , Brooklyn, etc - they cant afford shit but want a good funeral and wake.  Ok - consent to donation of the bones, and we will give you open casket and good wake and no one will know a thing.   Mastromarino paid the funeral guy 2k for the opportunity , poor family got a good wake / funeral - and he made sometimes 100k on a body to where he sold the tissue, bones, etc to various companies desperate for the tissue

STATEN ISLAND, N.Y. -- The irony is not lost on Michael Mastromarino: The mastermind behind a ghoulish multimillion-dollar body parts scheme is now in a prison infirmary dying of bone cancer, with little time left.

Mastromarino, 49, received last rites two weeks ago.

"The gist of what everyone is asking me is how is the doctor who was prosecuted for illegally harvesting bone and tissue dying of bone cancer," said Mario Gallucci, his lawyer. "How ironic is that. But the case here is that bone cancer is not treated with the harvesting of bone or tissue anyway."

Even Mastromarino himself recognized the diagnosis as a twist of fate.

"You're never going to believe this, I am dying of bone cancer," is what Mastromarino told Gallucci when he received results of testing. "He has a sense of humor about it."

Gallucci last saw his client in December.

"He looked great, but was complaining about an injury he sustained to his groin while working out," Gallucci said.

"The institution wasn't getting him proper care, so while I was there I made inquiries that he at least be taken to an infirmary. It was that check-up that revealed it wasn't really a groin pull, but that he was really suffering from bone cancer that had metastasized to his brain."

Mastromarino, a former oral surgeon from New Jersey, was sentenced to 18-to-54 years in prison in 2008 for the headline-grabbing, macabre plot in which he looted more than 1,000 corpses from 2001 to 2005.

The skin, bone and tissue were sold without proper screening to processors for research and medical procedures, like dental implants and knee replacements.

Among the bodies plundered for parts was that of "Masterpiece Theatre" host Alistair Cooke.

In March 2008, Mastromarino pleaded guilty to 14 counts, including enterprise corruption, body stealing and reckless endangerment.

He carried out the plot with ex-embalmer Joseph Nicelli, 53, of Rossville, and Christopher Aldorasi, 37, of New Springville, who worked as a "cutter."

Nicelli, who once ran Daniel George & Son Funeral Home and Regional Funeral Services, both in Brooklyn, is serving eight to 24 years behind bars after copping to enterprise corruption and other counts.

Aldorasi was convicted at trial and sentenced to nine to 27 years.

Mastromarino is currently in hospice care in the infirmary of Wende Correctional Facility in Alden, N.Y.

"It's a matter of minutes," said Gallucci, regarding how much time Mastramarino has left.

His family, including his wife, children, mother and siblings, have visited him in prison over the last few weeks.

"He made peace with his family and friends," Gallucci said. "He is ready to be taken."

  He died.

I always wondered if he would try to blame me for what happened but he never did.  He was reckless and careless.  He refused to listen to anyone but himself.  He gave him the protocols to do this legitimately and he just brushed us off.

I actually went to his place in Ft. Lee once and he had a fridge , a HUGE one, full of body parts.   Arms, legs, you name it.   He used to ship the body parts vua Fed Ex too.

Brooklyn's bone snatcher has died a ghastly death — from bone cancer.

Michael Mastromarino, who made millions by harvesting skin and bones from corpses, died at St. Luke's Hospital Sunday morning, a state Corrections Department spokeswoman said.

The bone cancer had spread to his entire body, sources said.

"It's full circle, baby,” said Vito Bruno, whose father’s organs were sold by Mastromarino after his death from kidney cancer in 2003. “Karma's a bitch."

The 49-year-old Mastromarino was being held at the Fishkill Correctional Facility’s Regional Medical Unit.

From 2000 to 2005, Mastromarino stole pieces of corpses — some diseased with cancer and AIDS — and sold them for tissue replacement.

Michael Mastromarino, Dentist Guilty in Organ Scheme, Dies at 49

By DANIEL E. SLOTNIK

Published: July 8, 2013

Michael Mastromarino, a former dental surgeon who became a tabloid sensation when he was charged with running a $4.6 million enterprise that plundered tissue and bone from corpses at funeral homes and sold them for transplants and research, died on Sunday at St. Luke’s Cornwall Hospital in Newburgh, N.Y. He was 49 and still serving a prison term.

The cause was complications of metastatic liver cancer, Mario Gallucci, Dr. Mastromarino’s lawyer, said.

The technology that allows the transplantation of critical organs also enables the far more common transplantation of tissue: bone can be used to repair fractures, veins for heart bypass surgery, and tendons and ligaments can restore mobility. Harvesting organs is allowed in New York State, provided the donor does not carry a potentially communicable disease, the survivors approve and the person is not too old. But there are nowhere near enough willing donors to meet the demand for tissue, so the profit from one body can reach six figures.

Dr. Mastromarino became licensed by New York State to supply tissue banks and manufacturers of biological surgical instruments after his dental license was suspended in 2002 because of a drug addiction. He established a network of undertakers, whom he paid up to $1,000 per corpse, and soon took on assistants and formed a business based in New Jersey, Biomedical Tissue Services. He reportedly made $10,000 to $15,000 per body.

But Dr. Mastromarino harvested organs and tissue from bodies without consent from the survivors, the authorities said, and removed material from people with cancer, H.I.V. and other diseases. He then forged paperwork, including consent forms and death certificates, to make the cause of death and age acceptable.

The police began investigating irregularities at the Daniel George & Son Funeral Home in Bensonhurst, Brooklyn, in 2005. News reports included lurid details, like what the police called a secret room in the funeral home equipped with specialized surgical equipment; leg bones replaced by PVC pipe so bodies would appear intact at viewings (this procedure is common in lawful bone removal); and the fact that one of the victims was Alistair Cooke, the British journalist and former host of “Masterpiece Theater,” whose arm and leg bones were taken even though he had had cancer.

Dr. Mastromarino was charged in 2006, along with two of his workers and an embalmer. He pleaded guilty in 2008 to numerous charges of enterprise corruption, reckless endangerment and body stealing and was sentenced to 15 to 30 years in prison. He and his wife, Barbara, agreed to pay $4.6 million to the district attorney’s office, to be distributed among the victims’ relatives.

Michael Mastromarino was born in Brooklyn on Sept. 16, 1963. He graduated from the University of Pittsburgh and the New York University College of Dentistry.

Dr. Mastromarino had surgical offices in New Jersey and Manhattan. He was a co-author, with Michael R. Wiland, of the book “Smile: How Dental Implants Can Transform Your Life.” Dr. Mastromarino, who was divorced, is survived by two sons, Michael and Jerry.

As for Mr. Cooke, his daughter, Susan Cooke Kittredge, said in an article in New York magazine that “he would have been just horrified” by the illegal harvesting. But, she said, “at the same time, he would have appreciated the Dickensian nature of it.”
