CBS/AP) AMBRIDGE, Pa. - Police say a western Pennsylvania store clerk used a gun to thwart a robbery by a suspect armed only with a BB gun.
Online court records don't list an attorney for 42-year-old James Hayes, of Ambridge, Pa., who remained jailed Monday on a charge that he tried to rob Moh's Market about 25 miles northwest of Pittsburgh.
A surveillance video shows a suspect entering the Ambridge store about 3:45 p.m. Saturday and pointing his gun at the clerk, who responded by pulling out a real gun.
In the video the clerk and the suspect are seen apparently fighting until the robber falls to the ground. The clerk is seen pushing the suspect out of the store and kicking him in the buttocks as he slams the door shut.
Police said they caught Hayes, who they identified as the suspect, nearby when a woman yelled that a man with a gun had just run into her apartment.
Interim police Chief James Mann called Hayes "one of the world's dumbest, and luckiest to be alive, criminals."

No way would I pull a gun out and not intend to use it. When something like that happens, you don't know the other person has a bb gun, you draw and shoot to kill.
