A cross atop Mount Soledad in California is an unconstitutional religious display on government land and must come down, a federal judge in San Diego ruled late Thursday.

U.S. District Judge Larry Burns ordered the cross, which honors veterans, must be removed within 90 days -- a decision that could result in the case being sent back to the U.S. Supreme Court. Burns immediately stayed his order pending an expected appeal.

The original lawsuit was filed in 2006 by the American Civil Liberties Union on behalf of the Jewish Veterans of the United States of American and several other Southern California residents.

“We support the government paying tribute to those who served bravely in our country’s armed forces,” the ACLU’s Daniel Mach, said in a statement to the San Diego Union-Tribune newspaper. “But we should honor all of our heroes under one flag, not just one particular religious symbol.”

Bruce Bailey, president of the Mt. Soledad Memorial Association, expressed disappointment in the ruling.

"It is unfortunate that the Ninth Circuit left the judge no choice but to order the tearing down of the Mt. Soledad Veterans Memorial Cross," Bailey told Fox News.  "However, we are grateful for the judge's stay that gives us an opportunity to fight this all the way to the Supreme Court."

Hiram Sasser, director of litigation for Liberty Institute, said in a statement to Fox News that they will continue to “fight for this memorial and the selfless sacrifice and service of all the millions of veterans it represents; it is the least we can do for those who gave so much to us all."

Most everything in these types of situations is constitutional. You have to wonder why things like this get ruled in favor of and other things do not. Obama and the left shit on the constitution daily, makes unconstitutional appointments of known communists that are clearly a threat to our freedom and nothing happends. Chief Justice John Roberts mysteriously votes Obamacare constitutional when by all accounts, wasn't. Find out who the ruling judge was on that case (Mt. Soledad) and then come back and tell me his political leanings.

The Mount Soledad Memorial has been the subject of ongoing litigation for the last two decades. In January 2011, a three-judge panel of the 9th Circuit Court of Appeals reversed an earlier decision by Judge Burns that the cross is part of a larger non-religious war memorial honoring all veterans. Cross supporters appealed the appeals court decision to the U.S. Supreme Court, which refused to hear the case and sent the case back to federal court.

WHY did he have to rule the way he did? Because of the Ninth Circuit decision:

That law sparked the latest round of litigation in federal court. In 2011, the U.S. Court of Appeals for the Ninth Circuit reaffirmed its prior decision on this display, holding that because of the cross, the memorial “primarily conveys a message of endorsement of religion.” Specifically, it “projects a government endorsement of Christianity.”

The United States Supreme Court denied review in 2012 but sent a written message noting that the lower courts were still considering whether the memorial could be modified in a way that preserves its character. In a statement by Justice Samuel Alito, the Court signaled that it would seriously consider taking the case if these additional efforts did not produce a positive outcome.

After almost two years of additional proceedings, on Dec. 12 the U.S. District Court for the Southern District of California reluctantly held that under controlling precedent from the Ninth Circuit, the district judge still had no choice but to declare the cross an endorsement of Christianity. He has ordered it removed within 90 days.

Judge Larry Alan Burns read the order from the bench in court and appeared to choke up as he ordered the memorial’s destruction, observers told Breitbart News. Burns then issued a stay of his decision to give the memorial cross’s lawyers time to appeal back to the Ninth Circuit and, if necessary, the U.S. Supreme Court.

How does patiently waiting for a decision via the courts for in excess of 20 years constitute "religious extremism"?

Or is your definition of a "religious extremist" anyone who holds a position differing from your own?

The constitution is quite clear. There's no religious extremism involved in demanding it be taken down.

If you served your country, I'm had a memorial erected in your honour, I'm sure the last thing you would want is for President Obama to erect a memorial under the Muslim Crescent, ...or for a President Lieberman (God Forbid) to erect a memorial under a giant Star of David.

The concern about "known communists," sounds very 1950s. At the very least, it sort of fell out of favor with the passing of Reagan. I would also point out that the US is in debt, to the tune of trillions of dollars, to the largest "communist" nation in the world - China. Perhaps a little communism would do us good.

I have no problem with people who have positions different from my own.  Had lunch earlier this week with one of my buddies who is an atheist.  Great guy.  He's not a paranoid anti-religious extremist.

I have noticed that you repeat crap that everyone already knows. Decline of Christianity in "Eurpope" has been known for years. Nothing new.

Western "Eurpope"? You actually think that Christianity began there? Do you know the first place where people were called Christians? It wasn't in western "Eurpope". You also might be confusing catholicism and Christianity.

The founder of the Christian church was very clear in teaching that Christianity was not going to be defined by a certain place or temple. So "dying where it started" is a non-factor when it comes to Christianity. It's founder also understood and thought, that while the will of his Father was for everyone to be saved,  most people were not going to follow his teachings. Christianity is not about a certain place or even a certain group of people. It is a way of life based on a relationship with Jesuschrist. "MANY are called, but FEW ARE CHOSEN". Jesus only sought true believers wherever they may be.
