Darren Sharper charged with rape
Updated: February 14, 2014
Associated Press

LOS ANGELES -- Prosecutors say former NFL safety Darren Sharper, who has been charged with raping and drugging women in California, is under investigation in connection with five more rapes and 11 druggings in other states.

Sharper appeared in Los Angeles Superior Court on Friday but his arraignment was postponed until Feb. 20 at the request of his lawyers.

Prosecutors immediately filed a motion to raise his bail to $10 million and outlined details of other alleged assaults and druggings in Las Vegas, Tempe, Ariz., and New Orleans.

Sharper has not been charged in the other jurisdictions and remains under investigation.

In the bail motion, an investigator described a pattern in which the former football star met women at clubs, lured them to a hotel or apartment then drugged and raped them.

Sharper is facing two counts of rape by use of drugs, four counts of furnishing a controlled substance, and one count of possession of a controlled substance, according to a statement from the Los Angeles County district attorney's office.

The complaint alleges the drugs involved were morphine and zolpidem, which is sold under the brand name Ambien.

Sharper was represented by prominent Los Angeles attorneys Blair Berk and Leonard Levine.

"We look forward to the true facts being revealed in this case," Berk said after the brief court appearance. "And we are hopeful Mr. Sharper will be fully exonerated before this case is concluded."

Sharper, 38, played in the NFL from 1997 to 2010, mostly with the Packers.

Prosecutors said he met two women at a West Hollywood nightclub on Oct. 30, invited them to a party and stopped at his hotel room.

He is accused of giving a shot of alcohol to each of the women before they passed out. One woman told investigators she woke up naked hours later with Sharper sexually assaulting her. The other woman awoke and "interrupted his actions," according to the criminal complaint.

On Jan. 14, Sharper met two other women at the same nightclub and invited them to a party. On the way, he invited both to his room and offered them shots before they passed out, prosecutors said.

When they woke up early the next day, one woman believed she had been sexually assaulted, the complaint said. Both women left his hotel and sought medical treatment.

Sharper was arrested on Jan. 17. He was allowed to remain free on $200,000 bail and ordered to surrender his passport. He has not entered a plea.

Prosecutors are seeking to raise bail to $10 million because the Miami resident faces similar investigations in Arizona, Nevada and Louisiana. Superior Court Judge Roberto Longoria did not immediately take up the bail request.

Sharper's lawyers refused to comment on the other investigations.

If convicted in the California case, Sharper could face more than 30 years in state prison.

Sharper was selected All-Pro six times and chosen for the Pro Bowl five times. He played in two Super Bowls, one with the Packers as a rookie and a second with the Saints.

According to the reports, he didn't ask.  He drugged them and then had sex with them while they were asleep.  That sounds almost like necrophilia.   :-\

Darren Sharper reaches agreement
Updated: March 20, 2015

LOS ANGELES -- Five years after reaching the NFL pinnacle by earning a Super Bowl ring with the New Orleans Saints in an All-Pro season, Darren Sharper is looking at a long stretch in prison after his lawyer said Friday the former safety reached a plea agreement that will settle rape charges involving at least nine women in four states.

All the alleged incidents came after Sharper's retirement in 2011, and the cases involved similar allegations that he slipped drugs to women and sexually assaulted them when they were unconscious or otherwise unable to resist or consent.

His Los Angeles attorney, Blair Berk, said Sharper would enter pleas in the Los Angeles and Phoenix areas on Monday that would resolve allegations there and in New Orleans and Las Vegas. Brian Russo, his attorney in Arizona, said his client will use video conferencing from Los Angeles, where he's being held, to allow him to make a change of plea in Phoenix.

Only prosecutors in Nevada provided details of their part of the deal with Sharper. He is expected to plead guilty there Tuesday to one felony charge of attempted sexual assault, with the expectation that he'll face between 38 months and eight years in prison, Clark County District Attorney Steve Wolfson told The Associated Press. He had previously been charged in the state with two counts of felony sexual assault, each carrying a possible 10 years to life.

"We are pleased that Mr. Sharper is accepting responsibility for the crimes he committed in Nevada," Wolfson said.

Wolfson said the Nevada prison term would run concurrent with other sentences in other jurisdictions.

"I'm not sure where he's going to serve his time," Wolfson said, "But he's going to serve significant time."

The announcement came after a morning of closed-door meetings in the Los Angeles chambers of Superior Court Judge Michael E. Pastor.

The Las Vegas charges, filed earlier Friday before the agreements were announced, had the same pattern as the previous allegations. Prosecutors there alleged that Sharper went club-hopping with two female tourists and took them to his hotel room on the Las Vegas Strip, where he drugged and sexually assaulted them while they were unconscious.

He had been sought on a warrant in Nevada, but he had been jailed since Feb. 27, 2014, in Los Angeles, where he had been due for a preliminary hearing Friday after pleading not guilty to drugging and raping two women there in 2013.

The New Orleans charges allege that he sexually assaulted three women in 2013. The Arizona charges allege that he drugged three women and sexually assaulted two of them in November 2013 in the Phoenix suburb of Tempe.

New Orleans District Attorney Leon Cannizzaro wrote in a statement that he expects Sharper will be sent to Louisiana within 30 days to plead guilty to federal and state charges filed there.

Cannizzario thanked victims in the cases for remaining involved despite personal attacks on their credibility. "This plea constitutes a complete vindication of these victims as well as their truthfulness," he wrote.

Sharper had a 14-year All-Pro career as a safety with the Green Bay Packers, Minnesota Vikings and New Orleans Saints. He played in one Super Bowl with the Packers and was part of the Saints' only championship season.

He was working as an analyst for the NFL Network before being fired when the rape allegations surfaced.

Sharper enters pleas in two cases
Updated: March 23, 2015
Associated Press

LOS ANGELES -- Former NFL star Darren Sharper pleaded no contest Monday to drugging and raping two women in Los Angeles as part of a broader plea deal in four states that will send him to federal prison for nine years.

Sharper, 39, acknowledged the crimes in Los Angeles Superior Court after pleading guilty by video link to sexual assault in Arizona.

Sharper wearing a striped, light blue suit, said he was entering the plea because it was in his best interest. He had faced up to 33 years in prison if convicted of all counts against him in California.

The former all-pro safety who won a Super Bowl with the New Orleans Saints admitted he had drugged and raped two women he met at a West Hollywood bar in 2013 and 2014.

The women were not in court, but prosecutors said they had agreed to the plea deal.

In the Arizona case, Sharper admitted sexually assaulting one woman and trying to attack another in suburban Phoenix in 2013.

Sharper appeared in a Phoenix courtroom by video-conferencing from Los Angeles, where he has been jailed since February 2014.

Under the deal negotiated by his lawyers and state and federal prosecutors, Sharper will serve a nine-year federal prison term for similar crimes in Louisiana, Nevada, Arizona and California.

Similar hearings will follow in Las Vegas on Tuesday and in New Orleans in the next month. In each state, he's accused of drugging and sexually assaulting women when they were unconscious or otherwise unable to resist or consent.

He was sentenced immediately in the Arizona case, which is very unusual. Sentencing in California was scheduled July 15.

Sharper retired from the NFL in 2011 after a 14-year career with three teams and later worked as an analyst for the NFL network.

All the alleged sexual assaults happened after Sharper's retirement as a player.

Sharper admitted sexually assaulting one victim and trying to assault another in Arizona, though police said he drugged three women and sexually assaulted two of them at a Tempe apartment in November 2013.

Prosecutor Yigael Cohen on Monday cited a letter in which one of the victims says she suffered emotional harm as a result of the attack and that she didn't have the ability to resist.

A search of the Tempe apartment turned up a shot glass with a white residue that turned out to be the sedative zolpidem, and California investigators discovered that Sharper had a prescription for the drug.

In the California case, he pleaded no contest to four counts of furnishing zolpidem, which is a controlled substance.

Sharper's attorneys said last year that their client did not make the drinks authorities say he used to drug the women.

One of the women told police she had not had any alcohol that night until Sharper insisted she drink a shot. Another young woman said she had been drugged, then went to bed, locked her door and was not attacked.

The next day, one of the women confronted Sharper, who denied wrongdoing, according to police reports.

Sharper is expected to plead guilty to one felony charge of attempted sexual assault in Nevada, with the expectation that he will face up to eight years in prison, Clark County District Attorney Steve Wolfson told The Associated Press.

Darren Sharper pleads guilty in Vegas
Updated: March 24, 2015
ESPN.com news services

LAS VEGAS -- Former NFL star Darren Sharper pleaded guilty Tuesday in Las Vegas to a reduced felony attempted sex assault charge, in the third part of a four-state plea deal that prosecutors say will put him in federal prison for about nine years.

Appearing by Internet hookup from a courtroom in Los Angeles, Sharper entered his plea before Clark County District Court Judge Douglas Herndon, who scheduled sentencing for June 25.

Look, I'm a dad of three daughters ... If he ends up only serving nine years, it's an absolute shame. It's way too short.

- Scott Fujita, to TMZ
on ex-teammate Darren Sharper

A plea agreement calls for Sharper to serve 38 months to eight years in prison for the Nevada conviction, but at the same time as sentences from California, Arizona and Louisiana.

On Monday, the 39-year-old Sharper pleaded guilty to sexual assault in Arizona -- again using an Internet hookup -- and no contest in Los Angeles to raping two women he drugged after meeting them in a West Hollywood bar.

He was sentenced to nine years in the Arizona case and will face 20 years in the California case when he's sentenced July 15. The California no-contest pleas have the same effect as a conviction, and state sentencing rules will have him serve about nine years.

Sharper is due in federal court April 6 in New Orleans, the city where he won a Super Bowl as a member of the NFL's Saints franchise. He's due in Louisiana state court 10 days later.

Sharper wore an orange jail uniform with "LA County" stamped over his chest pocket as he sat Tuesday in Los Angeles flanked by attorneys Blair Berk and Lisa Wayne.

One of his Las Vegas lawyers, Richard Schonfeld, appeared on his behalf -- first before a Las Vegas justice of the peace and then before Herndon.

The former All-Pro safety cleared his throat and said, "Guilty," when asked to enter his plea.

Sharper's other lawyer, David Chesnoff, issued a statement noting that Sharper took responsibility in the Las Vegas case.

Sharper could have faced 20 years to life in Nevada state prison on two sexual assault charges filed against him last week in Las Vegas.

Those charges were dropped as part of the plea agreement. Prosecutor Craig Hendricks said he spoke with the two victims, both in their mid-20s, before terms of Sharper's plea deal were made public.

Sharper was accused of club-hopping with the women in January 2014 before taking them to his room at a Las Vegas Strip hotel, drugging them and raping them while they were unconscious.

Police and prosecutors characterized the Las Vegas case as weaker than in California, Arizona and Louisiana because the women didn't report the attack until after they returned home and heard about similar allegations against Sharper.

District Attorney Steve Wolfson said Tuesday he was satisfied that Sharper was accepting responsibility for his crimes in Las Vegas and the other states.

Sharper retired in 2011 after a 14-year NFL career as with the Green Bay Packers, Minnesota Vikings and the Saints. He won a Super Bowl in New Orleans.

One of his former teammates, Scott Fujita, called what has happened "disgusting."

"He was a great teammate, a great player," Fujita told TMZ. "But all that aside, it's disgusting and beyond repulsive.

"Look, I'm a dad of three daughters ... If he ends up only serving nine years, it's an absolute shame. It's way too short."

Sharper was working as an NFL network analyst when women began telling police in several cities similar stories of blacking out while drinking with him and waking up groggy to find they had been sexually abused.

His arrest came as the league dealt with off-field problems with players accused of crimes ranging from spousal abuse to murder.

‘Penile plethysmograph’ test to gauge arousal part of Darren Sharper’s strict post-prison deal
BY JOHN SIMERMAN AND RAMON ANTONIO VARGAS| JSIMERMAN@THEADVOCATE.COM, RVARGAS@THEADVOCATE.COM
April 10, 2015

When Darren Sharper gets out of prison in less than a decade, if he wants to stay out, the former NFL star who once cut loose on the field and in nightclubs from Miami to Los Angeles will live the closely monitored life of a known predator.

During his first three to five years of freedom, California officials will track him by GPS.

He’ll undergo sex offender treatment for years.

He can’t drink alcohol for the rest of his life or go to bars or liquor stores. He can’t visit sex shops or chat on the Internet to get a date.

If he wants to spend the night away from home or travel more than 50 miles, state officials must approve it.

Sharper will be subject to lie detector tests and, while on lifetime probation in Arizona, to the “penile plethysmograph,” in which a sensor is attached to the penis while an array of sexual images flashes before his eyes, to gauge arousal.

Sharper will comply or land back in prison — in Arizona or Louisiana, or both — to serve at least another 14 years behind bars before returning to the same conditions.

Such are the terms of a “comprehensive and global disposition” that Sharper and prosecutors in four states have reached to resolve drugging and rape cases against him in Louisiana, Arizona, California and Nevada, covering nine sexual assault victims.

The terms of the deal remain for two judges in New Orleans — one federal, one state — to approve as public bewilderment rises locally and nationally over what many see as a sweetheart prison term for the retired ex-Saints star.

Sharper remains at the St. Tammany Parish jail, pending a guilty plea in federal court on three counts from an indictment accusing him and former St. Bernard Parish Deputy Brandon Licciardi in a years-long conspiracy to drug women to prime them for rape.

Orleans Parish Criminal District Court Judge Karen Herman made clear in her courtroom this week that she wouldn’t take Sharper’s guilty plea for three New Orleans rapes until after U.S. District Judge Jane Triche Milazzo signs off on the deal.

Under the terms of the deal, Herman would have the ultimate say over Sharper’s compliance and whether he must return to Louisiana to serve out an agreed-upon 20-year sentence on two counts of forcible rape and a count of simple rape.

Under the intricate agreement, Sharper’s time behind bars or while under parole or probation supervision in California and Arizona will be considered “in custody” time under the 20-year Louisiana sentence.

But if he runs afoul of the terms, only his time behind bars would be counted against those 20 years, with no credit for parole or probation time.

This week on WWL-TV, Orleans Parish District Attorney Leon Cannizzaro defended the seemingly lenient prison sentence for Sharper, citing closure for the victims.

“Look, certainly they would have liked to see a greater sentence imposed. I understand that, and we have discussed that with them,” Cannizzaro said. “But for all intents and purposes, these victims have been vindicated. They were in fact the victims of this man’s sexual assaults. They were not doing this for any financial gain, but simply they wanted to come forward and let the community know, ‘This guy violated us,’ and he is going to walk into the courtroom and plead guilty.”

Prosecutors in Los Angeles said the reluctance of victims to have their identities revealed when they testified in open court factored into striking the global plea deal.

The deal also requires Sharper to cooperate fully with authorities. He must sit down to be “interviewed and debriefed by law enforcement authorities” after the Louisiana pleas but before his formal sentencing.

The agreement does not limit the topics, and it demands that Sharper testify, if asked, before grand juries or at trials. It seems likely that, at a minimum, he’ll be asked to provide information about alleged co-conspirators Erik Nunez and Licciardi, both of whom have pleaded not guilty to rape charges.

After his various sentencing hearings are over, he’ll serve at least 101 months in a federal facility and the remainder — less than a year if he’s a model federal inmate — in California before he’s released to state and federal supervision there.

Just how closely he’ll be monitored by parole agents in the Golden State will be determined through a series of assessments, said Luis Patino, spokesman for the California Department of Corrections and Rehabilitation.

“In general, the special conditions of parole are designed to keep the offender from the same sort of situation that he or she was in when they committed the crime,” Patino said.

State law requires that Sharper submit to HIV testing and that he “must pay actual restitution to the victims.”

Along with registering for life as a sex offender, he also must register as a narcotics offender under state law in California.

Once finished with parole in California, Sharper would move to Arizona for lifetime probation, according to the agreement.

There, his neighbors, school groups and any employers will be alerted to his presence, and his face, address and a description of his crimes may be posted on a flier.

The terms of that probation will continue if Sharper lands back in prison for violating the conditions of the deal and serves out his sentence in prison.

“There will never be a time he will be finished,” a person familiar with the deal said.

Arizona’s role will be gauging and mitigating the chances that the former Saint would reoffend.

Restrictions on where he can live, move or travel, and with whom he can spend time, are designed to limit Sharper’s opportunities to commit the crimes with which authorities charged him, experts say. According to the deal, one of the tools authorities could use is the penile plethysmograph, or PPG.

Commonly, rubber rings are placed around the penis to measure swelling in response to seeing certain pictures. Offenders might be shown depictions of both consensual and nonconsensual sex to compare the reactions and get a reading on whether rape arouses the subject, according to a 2012 research study.

Just how county probation departments in Arizona use such findings was unclear.

The deal doesn’t specify in which Arizona county Sharper must reside, and not every Arizona county’s probation department makes use of the penile testing. Maricopa County — the state’s largest, including Phoenix, Scottsdale and Mesa — stopped awhile ago, said Michael Cimino, deputy chief of the county’s adult probation department.

“It’s not typically something we use any longer,” Cimino said. “It’s been several years.”

While Sharper has consented to such testing under the plea deal, many in the medical and legal communities don’t put much stock in it. The American Psychiatric Association years ago called the device unreliable, in part because men can feign responses during a PPG test by concocting images in their minds.

Federal appeals courts in New York and California have in a pair of cases rejected it as a method to monitor sex offenders, finding it unreasonably intrusive.

Still, Sharper’s concession to be subject to the test suggests a life in Arizona far removed from the one he enjoyed as a professional football player or television analyst before his January 2014 arrest in Los Angeles.

“Especially for a sex offender, I think it would be naive for someone to have the expectation that they’re going to have the same life when they go on probation that they did before they got on it,” said Joshua Davidson, an Arizona lawyer who represents such clients.

“When he’s an old man, (the probation) will extremely limit what he can do, where he can go and who he can see,” said Howard Snader, another Arizona criminal defense lawyer. “If you’re writing this from the angle that he’s never going to get out of the system, that’s correct. If you’re writing that he got a sweetheart deal, then, nah.”

Darren Sharper pleads guilty to drugging women with intent to rape
Ex-NFL safety Darren Sharper pleads guilty to drugging women with the intent to rape

Posted: Fri May. 29, 2015

Former NFL safety Darren Sharper pleaded guilty in a New Orleans federal court on Friday to three counts of conspiracy to distribute drugs with the intent to commit rape, reports the New Orleans Advocate.

Authorities charged Sharper and another man with distributing the drugs alprazolam, diazepam and zolpidem—more commonly known by the brand names Xanax, Valium and Ambien, respectively—with the intent to commit rape.

Sharper has already pleaded guilty to state charges in Nevada and Arizona and no-contest in California as part of a global plea deal that will call for him to spend the next nine years in prison for drugging and sexually assaulting women in those states.

Sharper has been in jail since February 2014 after he was arrested in Los Angeles following the first rape allegations.

Sharper is expected to plead guilty to two counts of aggravated rape and one count of simple rape in Louisiana state court on June 15, stemming from two separate incidents in September 2013 involving three women. That case was delayed until the resolution of the federal case.

Sharper, 39, played 14 seasons in the NFL with the Packers, Vikings and Saints. He was a five-time Pro Bowl defender and two-time first-team All-Pro selection.

He was employed as an analyst for NFL Network before he was fired when the rape allegations surfaced.

Ex-NFL star Darren Sharper gets 18 years in federal prison

Associated Press
By JANET McCONNAUGHEY

Darren Sharper NEW ORLEANS (AP) -- Former NFL star Darren Sharper was sentenced Thursday to more than 18 years in prison for drugging women in order to rape them -- double the sentence recommended by prosecutors.

One of Sharper's victims -- the only one to speak at his sentencing hearing -- rebuffed his display of contrition.

"For the list of people you've done this to: Go to hell," she said. Her name was not given in court, and The Associated Press does not identify victims of sexual abuse by name.

The former New Orleans Saints safety, jailed since February 2014, apologized and appeared chastened by his fall from grace.

"I would like to apologize a thousand times," the 40-year-old Sharper said. Later, he said, looking down and sighing, "I'm still trying to figure out why I made some of these choices."

His voice quivered and choked with emotion when he apologized to his parents.

U.S. District Judge Jane Triche Milazzo, in sentencing Sharper, told him she couldn't understand how he did what he did, since he was college educated and obviously had grown up "in one of the most loving households."

"We can never ignore the damage you inflicted on those women and society at large," she said.

Sharper had pleaded guilty in federal court in New Orleans to drugging three women so he could rape them. He also has pleaded guilty or no contest in state courts in Louisiana, Arizona, California and Nevada to charges arising from allegations of drugging and raping women.

Defense attorney Billy Gibbens asked for leniency because Sharper's testimony helped get "late" guilty pleas from two codefendants who will be sentenced in October.

Assistant U.S. Attorney Michael McMahon told the judge, "I don't think Mr. Sharper has really wrapped his head around the fact that he is a serial rapist."

Meanwhile, the tearful victim told Sharper that because of arrogance and "clear stupidity," he kept drugging and raping women even after he knew she was talking to state and federal investigators.

"Within days ... you gave me ... and the entire judicial system in Louisiana the big middle finger because you thought we weren't capable of stopping you," she said. "You continued to rape other women in Los Angeles, Phoenix, Las Vegas."

She said she understands that people make mistakes. "But it wasn't a mistake. A mistake happens once and you never make it again." Rather, she said, it was "a way of life for you and your friends."

Prosecutors suggested a 9-year prison term for Sharper under a multi-jurisdictional plea deal, but Milazzo rejected it in June as too lenient. The sentence she imposed, 18 years and four months imprisonment, was 15 months short of the maximum. Sharper also was fined $20,000. His sentence will run concurrently with any state sentence.

The judge said he will be on three years' supervised release after he gets out of prison, including "sex treatment conditions" and registration as a sex offender.

Sharper or his friend Brandon Licciardi, a former sheriff's deputy in neighboring St. Bernard Parish, put anti-anxiety drugs or sedatives into women's drinks so they could rape them, according to a 15-page statement signed as part of Sharper's plea agreement.

Milazzo has scheduled sentencing Oct. 13 for Licciardi and a second New Orleans codefendant, Erik Nunez.

Charges around the country involve nine victims, but Milazzo has said in court that there may be as many as 16.

Sharper was named All-Pro six times and chosen for the Pro Bowl five times during a career that included stints with the Green Bay Packers and Minnesota Vikings. He played in two Super Bowls, one with the Packers as a rookie and one with New Orleans Saints when they won in 2010.

He ended a 14-year career in 2011. He was working as an NFL network analyst when women began telling police in several cities similar stories of blacking out while drinking with him and waking up groggy to find they had been sexually abused.
