The police enjoy numerous exclusive privileges and responsibilities, so they most definitely need to be held to a higher standard.  Killing a cop carries a stiffer penalty than killing an ordinary citizen, so it's pretty clear that the law exalts policemen over the general populace.

And it was sheer luck that this individual wasn't permanently disabled or killed.

Rio Arriba County Sheriff Thomas Rodella, 56, was found guilty of violating the civil rights of a driver, identified as Michael Tafoya by The Associated Press, and brandishing a firearm during a violent crime in an assault on Tafoya.

Federal prosecutors said Rodella and his son chased the man in their car and once they cornered him on a dead-end street, the sheriff got out with his gun, got into the man's car and pistol-whipped him.

Prosecutors say Rodella's son pulled the victim from his car. When Tafoya asked to see the elder Rodella's badge, the sheriff responded by slamming his badge into the victim's eye and shouting "You want to see my badge? Here's my badge, (expletive)."

If you look closely at the video, the poor guy (maybe he was nervous) makes an unnaturally quick move back inside of his truck. The cop should have waited until he had a better angle, to see what he was reaching for.

The cop was obviously wrong, but we are shifting slowly into a "kill or be killed" mentality by a certain number of cops. There have been plenty of situations when good cops where gunned down at traffic stops as well.

I believe every cop should have a partner anyway. Cops should never have to work alone.

It "spooked" the officer.

He cant be charged with anything too serious, as there is a total lack of intent.

Should be fired. Poor training, poor judgement, poor suspect control.

My opinion is that there should be no jail time, as the officer clearly was NOT just looking to shoot someone. He got scared.

Some years ago I was stopped for speeding (five over but I won't get into that).  I was coming back from the gym and I put my wallet in the little nook between the seats.  The cop asked me for my ID and when I opened the space where my wallet was he immediately put his hand on his gun and flipped the snap with his thumb.  I paused and told him I was getting my wallet.
