A) you don't have to be arrested to be detained or taken into custody
B) what was found, if anything has no bearing on the events that preceded his death.

If he had an issue with the police the time and place to take it up was after the fact. Instead this guy resisted arrest which is both unreasonable and dumb.

I disagree...once you're freedom of movement has been taken away you are technically detained....and once the cuffs are on you, you are arrested.....also what do you what was found has no bearing?>??...if they were accusing him of stealing cigarettes then he MUST have had the contraband on him or in the vicinity......if not, they have no probable cause to stop and detain him.....even if he sold cigarettes every day that month

No, I don't think anyone had accused him of stealing. From what I've read, he was observed accepting a quarter or two for a cigarette.

Whether he was under surveillance or just wrong place/wrong time, I don't know.
