Interesting.  I love the idea.  Not sure those crazy right wing "states rights" folks will want the federal govt taking over criminal sentencing, but hey, that's what they get with Trump.

Capital Murder charges are an option here. The reason it isn't mandatory is that over time, prosecutors realize there are some people who sit on juries that no matter the compelling evidence, won't sentence a person to death. Squimish stomachs I guess. So IF there were no options but the death penalty, it could impact the convictions even if it was overwhelming evidence. Something to consider.

Also, there are a comparative handful of delegates at stake in the first few primaries.  About half of the delegates needed for the nomination will be decided on Super Tuesday.
