Yearbook flasher charged with indecent exposure

He has to wear an electronic device, as ordered by the judge. He is being charged with 69 accounts of indecent exposure. I assume if he is found guilty, he may have to register as a sexual offender. This one joke may screw the rest of his life.  :-\ :-\

ARIZONA -

(KPNX) At first glance, it looks like a typical varsity football yearbook photo: Mesa, Arizona's Red Mountain High School players posing side-by-side with senior Hunter Osborn blending in with the crowd.

That is, until the school released the yearbooks to students, who noticed something school staff and yearbook editors had apparently hadn't: Osborn was exposing himself.

Court documents state that Osborn "exposed his penis through the top of his waistband of his football uniform."

Once school leaders found out, they notified Mesa Police and Osborn was charged with one count of furnishing harmful items to minors -- which is a felony -- and 69 counts of indecent exposure, one for every person who was there when the picture was taken.

A total of 250 pre-order yearbooks went out before anyone caught the photo.

The picture is also in a football program that was sold at games.

A guy shouldn't get in trouble for exposing his genitals? Should we just be allowed to go around and flash people?

Cases like this can become a slippery slope. If it was okay for him to do this, when and where does it cross the line to where its illegal and inappropriate? Thus, they keep the law constant across all cases--don't expose yourself. Case closed. The stringent nature of this law does not allow people to find legal loopholes in the law, i.e., well, this person exposed himself and didn't get in trouble, so how is my case much different? Why can't I do it?

It's true he shouldn't do it but would have he got this punishment 30 years ago?

Well, no, he would not have gotten this punishment 30 years ago. Though, I am not too sure what that has to do with anything. Laws are not static. Laws change according to the times. I'd have to look into the research, but perhaps sexually deviant behavior has risen over the years; furthermore, such behaviors are taken a lot more seriously these days. 30+ years ago, we didn't know as much as we did about this type of behavior. As such, laws often change depending on what we learn and its affect on others.

Now, I don't think this guy is displaying true sexual deviancy. However, as I stated previously, they keep the law constant across all cases, in order to avoid any legal loopholes. If you let one person get away with it, then who else should be allowed to expose their genitals? And where? It then becomes a slippery slope, and I am assuming that is not something the law wants to deal with.

As for your statement, "its a crime to have a penis nowadays." Really? I've never been arrested on any sexual behaviors. Have you? I've never been convicted of a crime because "I have a penis." Seems like you just want to make an excuse for a man to expose himself. Hmmmmm, interesting. Tell me more about that.................... ...................

The punishment here doesn't fit the crime.

Did you see what I said above? They most likely keep the laws constant so lawyers and others can't find loopholes. When it comes to stuff like this, it becomes a slippery slope if you let one person get away with it. Then people will ask, "Are there are other contexts where I can expose myself and not get into that  much trouble?"

Just a dopey kid pulling a prank.  If he is under 18 then the judge in most jurisdictions has wide latitude. He might drop the charges and basically slap him on the prick I mean wrist.  Then the charges will be sealed if he stays out of trouble. If he is 18 then he has in for a world of hurt if the judge and prosecutor doesn't go easy on him.

Its a tricky question. I do not think he is a sexual offender. However, I can see why the law would want to treat all cases like this in an equal manner.

So, I guess there is my subjective interpretation of the situation, and how I am conceptualizing it purely from a legal perspective.
