Most of what the incoming Trump administration has proposed in terms of economic and regulatory policies would be a boon for big banks, but there is one policy that cuts both ways: Trump's desire to lower the corporate tax rate. According to one of the nation's leading bank analysts, Keefe, Bruyette & Wood's Brian Kleinhanzl, the move could reduce Bank of America's (NYSE: BAC) tangible book value by $4.4 billion.

Under ordinary circumstances, this is obviously a good thing. The less companies have to pay to the government, the more left over for shareholders. And over the long run, it'll be good for Bank of America as well. However, thanks to a combination of the financial crisis and a specific provision in the tax laws, there's a short-term downside to lower corporate taxes from the North Carolina-based bank's perspective.

The downside can be traced to $33.3 billion worth of deferred tax assets that currently sit on Bank of America's balance sheet (see page 225 of its 2015 10-K here). These relate to losses incurred in the financial crisis that were too large to be absorbed by its income at the time. Under tax law, these can be carried forward in the form of deferred tax assets and used to offset its tax liability in future years.

The catch is that the deferred tax assets must be used within a certain amount of time. The statute of limitations for domestic deferred tax assets is 20 years. It's half that for those that offset foreign income, according to regulatory filings by Bank of America's close competitor Citigroup.

By lowering the tax rate, in turn, these assets become less valuable, as future tax liabilities will accordingly shrink. Even more importantly, it calls into question whether Bank of America will have time to use the entirety of its deferred tax assets before they expire.

The answer to this remains to be seen. After all, we still don't know whether the corporate tax rate will in fact fall, much less when exactly it might do so.But if it were to happen, KBW's Kleinhanzl predicts that it would cause the value of Bank of America's deferred tax assets to drop by $6.6 billion. When you net that against the positive impact of a lower tax rate on certain of Bank of America's liabilities, it means that the  the bank's tangible book value would decline by $4.4 billion, according to KBW's analysis.

Time Warner CEO Jeff Bewkes told Business Insider's Henry Blodget on Tuesday that the "real threat" to the First Amendment did not come from President-elect Donald Trump during the campaign, but rather from the Democratic Party.

Bewkes was speaking at Business Insider's annual IGNITION conference, during which he was asked about Trump's frequent campaign threats to open up libel laws.

Trump has also set his sights on Bewkes' own media property, CNN, which he consistently ridiculed along the campaign trail and even after Election Day.

"Do you worry about that at all?" Blodget asked.

Bewkes said he didn't "think that's a serious thing," adding that "we should all worry" if someone were seeking to change the First Amendment. He suggested that came from the Democratic Party, which "had a campaign plank to change the First Amendment, and they were doing it in the guise of campaign finance reform."

"And that was worrying me more," Bewkes said. "The press tends to miss that because they tend to lean that way, and therefore they were supporting what they were viewing — I think overly charitably — as something in cleaning up money in politics when in fact what it would do is restrain multiple voices."

Democrats, including Vermont Sen. Bernie Sanders and Democratic presidential nominee Hillary Clinton, vowed to engage in campaign finance reform following the election — a cause that has been bolstered in recent years by the Supreme Court's Citizens United decision. The 2010 ruling deemed that corporations and labor unions were people who could flex First Amendment rights in contributing to campaigns, and it led to the advent of so-called super PACs.

"So I thought the real threat to the First Amendment came from the Democrats' side more," Bewkes said. "There's not going to be a serious effort on the Republican side."

Trump announces Japanese corporate giant is investing $50 billion in the U.S.

President-elect Donald Trump announced Tuesday that Japanese telecom and internet conglomerate SoftBank would invest $50 billion in the United States and create 50,000 new jobs, saying that the decision wouldn't have been made without Trump's election win.

Trump appeared in the lobby of the Trump Tower on Tuesday with Masayoshi Son, the chief executive of SoftBank, to announce the news, and later on Twitter claimed credit.

Son told reporters at Trump Tower that the funds would be invested into American start-ups.

It was not immediately clear how much of the investment was new, or how much would come directly from SoftBank itself. Son told The Wall Street Journal in an interview that the money would come from a $100 billion joint investment fund created in October by SoftBank and the Saudi Arabian government to invest in the global technology sector.

SoftBank has said it would provide at least $25 billion for the fund in the next five years, while Saudi Arabia's public investment fund pledged to invest up to $45 billion in the same time period. The additional $30 billion would come from outside investors. During a trip to India last week, Son said he was close to securing the remaining funds.

The paper also contained the logo of Foxconn, a major supplier for Apple’s iPhones. It was not clear what role Foxconn would play in the deal, or if the company would be responsible for the additional $7 billion in investment and 50,000 new jobs mentioned on the paper. Foxconn could not immediately be reached for comment
