The three judges of the San Francisco-based 9th U.S. Circuit Court of Appeals said the argument that the ban targets Muslims raised "serious allegations" and presented "significant constitutional questions," and they agreed that courts could consider statements by Trump and his advisers about wishing to enact such a ban.
The judges sided with the states on every issue except for one technical matter. They rejected the administration's argument that courts did not have the authority to review the president's immigration and national security decisions. They said the administration failed to show that the order met constitutional requirements to provide notice or a hearing before restricting travel. And they said the administration presented no evidence that any foreigner from the seven countries was responsible for a terrorist attack in the U.S.

The case involved an Afghan-born naturalized U.S. citizen named Fauzia Din who argued she had the right for a full explanation from the U.S. government as to why her Afghan husband was denied entry. The justices ruled 5-4 against her.

On its face, the ruling would seem to help the administration in its defense of the president's Jan. 27 executive order, which temporarily barred entry into the United States by people from seven Muslim-majority nations and put on hold the entry of refugees. Lower courts have blocked the order, but the administration may ask the Supreme Court to revive it.

Thankfully, our founding fathers had the intelligence to realise the importance of separating powers between the executive, legislature and judiciary in order to prevent possible abuses of state power and guarantee certain rights to citizens. A fixed constitution, along with a separation of power, means that a moron like Trump has to negotiate with an independent and autonomous judiciary. With incredible prescience, our founders predicted that one day we would have pudding-bowl haircut sporting, Reddit-reading pseudo-intellectuals like True Adonis, and mentally-handicapped Oompa Loompas like Coach, proudly campaigning to elect one of the biggest imbeciles in U.S history.
