9th Circuit Has 80 Percent Reversal Rate At Supreme Court

The 9th U.S. Circuit Court of Appeals — which ruled Thursday against reinstating President Trump’s travel ban affecting seven terror-prone countries — has an unusually high reversal rate before the U.S. Supreme Court.

Eight of out of 10 cases from the 9th Circuit reviewed by the Supreme Court are overruled, according to a 2010 analysis published by the American Bar Association. The 9th Circuit, which is known for its liberal tendencies, has the second-highest reversal rate of the 13 appellate courts below the Supreme Court.

Republicans cited Thursday’s ruling as just the latest example of judicial overreach in favor of liberals.

“No one familiar with the 9th Circuit Court of Appeals should be surprised at today’s ruling,” South Carolina Rep. Trey Gowdy said in a statement. “The 9th Circuit has a well-earned reputation for being presumptively reversible.”

Here comes the spin.

FYI, team Trump fast tracked this  to the 9th circuit.
They lost. 

Obviously, a higher court ( SCOTUS ) may hear this case.

Pres. Trump could get with his legal team and rewrite the exec order to now pass constitutional muster.
That would be the easiest way to get a legal order in place and enforce some immigration concerns.

BUT, his ego won't allow it.
THAT's the root of his problems. I suspect this won't be the last time we deal with his ego.

What exactly is wrong with the exec order?  Why re-write it?  I honestly don't know.  That's why I'm asking you.

No. 0.12% of cases ruled on by the 9th circuit were overturned. 99.85% of cases were not heard by the Supreme Court. 0.03% of cases were confirmed by the Supreme Court.

The total percentage of cases 'Confirmed' by the Supreme Court either actively by affirming the case or tacitly by not hearing the case is 99.88%

This is from the data found by DavePhD. The total number of cases decided by the 9th circuit court of appeals was 114,199. Of that number, 107 were reversed, 33 were vacated, and 35 affirmed by the Supreme Court.

A total of 0.15% of 9th circuit cases were heard by the Supreme Court

Of those cases, 80% were overturned (reversed or vacated). This is the "Reversal Rate" and is the number they are using. The quote omits the fact that the "Reversal Rate", as understood by lawyers, does not include cases that weren't reviewed by the Supreme Court and thus either tacitly approved by them (by declining to take the case) or by the opposition counsel (by not pursuing to the Supreme Court)

WASHINGTON (Reuters) - Justice Anthony Kennedy's legal reasoning in a little-noticed 2015 U.S. Supreme Court immigration ruling could play a pivotal role in deciding the fate of President Donald Trump's travel ban if the high court eventually decides the matter.

The case involved an Afghan-born naturalized U.S. citizen named Fauzia Din who argued she had the right for a full explanation from the U.S. government as to why her Afghan husband was denied entry. The justices ruled 5-4 against her.

On its face, the ruling would seem to help the administration in its defense of the president's Jan. 27 executive order, which temporarily barred entry into the United States by people from seven Muslim-majority nations and put on hold the entry of refugees. Lower courts have blocked the order, but the administration may ask the Supreme Court to revive it.
