Honestly, I highly doubt it would go to Obama.
The question will always be how much independence do intelligence agencies have?
My impression is they have a lot of leave way to do whatever they choose to do. Not to mention the question of how the surveillance was processed.
For instance, we have the CIA who does something and gets information about something in a country... Let's call it "Rusghanistan". They happen to notice that this person's name who is involved lives in the US. They then pass that to the FBI or the NSA, (Which would not have happened before The Patriot Act was legalized) who then monitors that person.
That person happens to then at some point, be a part of a person's campaign... Let's say Dillary Truminton... At this point, they, as a part of previous investigation, are now performing surveillance on a campaign.
No crime is occurring at any point and it's just typical intelligence work.
