I guess it depends what contract they sign and the rules they have to abide by.
Most companies (or military for that matter) put in their contract some “moral” code of behavior that the individual has to go by. If you sign it, the break the contract, the individual is in the wrong.
Whether or not someone agrees to what the contract says is besides the point. No one has to take any job or sign any contract.
