Perhaps the Supreme Court will do that, but after the lawsuits have gone through the lower courts (United States Court of Appeals). This could take awhile.

What kind of incentives?

The first test will be whether the House and the Senate vote to overturn Trump's declaration. Getting it done in the Senate is questionable although it only requires a simple majority. Should it pass in both houses, Trump can veto the resolution. Overriding Trump's veto would require a super majority which is a 2/3 majority. After all this happens the House and the Senate have to approve all appropriations to pay for the wall. While all this is going on, lawsuits against Trump's emergency declaration could be tied up in the lower courts for quite awhile before it would go to the U.S. Supreme Court.

If you will watch his video, he clearly states he didn't need to do the emergency, he could have taken his time but he didn't want to. I have no clue why you would choose to say "The wall wasn't needed" when my post was crystal clear I was talking about the declared state of emergencies and for you to show me one where Obama said the STATE OF EMERGENCY wasn't really needed but he was going to do it anyway.

Why should he spread out funding for a national emergency over a period of time? Faster and easier to declare it since the demoncrats obviously don't care about America. You do know that many of the Republicans and probably 2/3rds of America see this "wall" thing for what it is... Republicans controlled both the House and the Senate as well as the white house for 2 years... why now? And you are avoiding the point where he admitted he didn't have to do this... he was just impatient. I see now how some people can watch the OJ trial and come to the conclusion he is innocent... its just a psychological thing but it is still hard to watch...
