In the eyes of the law, it doesn’t matter. Unless Jason has a power of attorney or legal guardian, he can do whatever he wants without outside interference. His parents will likely have little influence over him at this point.
I think his mom is his legal guardian, but she's also a purported drunk. If that's true, depending on the extent of her alcoholism, she might be even less capable of running his affairs than he is, particularly if he's properly medicated. (It's clear when he's off meds and when he's on. He's still stupid, with maybe a 65-70ish I.Q. (75 at best), but when he is "on," and the verbal and physical tics aren't as obvious, he at least has the sense to avoid that Richard dude when Janoy pisses him off, to obey simple traffic laws, bag groceries, etc. When he's "off"...he's obviously dumb as well as autistic, hyper and seems to have a mild case of Tourette's.)
Given all of his conditions, he'd be better off in a home for disabled people. Ironically, he might be one of the higher-functioning people there, but that doesn't mean he needs less treatment. If anything, his obsessive behavior and transient bouts of delusions of grandeur would mean he needs MORE attention, much in the same manner that the profoundly depressed require greater treatment as they start to regain their footing.
