Article 2 section 1.2 of the Constitution states that state legislatures direct the manner in which state delegates are selected.
Pence will ask which of the two slates of delegates was selected in the manner in which your state general assembly has designated? Is it the Republican delegates or the Democrat delegates? The state legislatures will put it to a vote.
My personal opinion of how this will play out is that most of the states in question have majority Republican legislatures and will choose Republican delegates, but it's up to the legislatures of each state to decide.
Arizona's House is 31 Republican to 29 Democrat and the Senate is 17 Republican to 13 Democrat. I would be surprised it their delegates end up being Democrat.
Michigan's House is 58 Republican to 52 Democrat and the Senate is 22 Republican to 16 Democrat. Again, I would be surprised if their delegates end up being Democrat.
Georgia House 103 R to 75 D and Senate is 35 R to 21 D.
Pennsylvania House 113 R to 90 D and the Senate is 28 R to 21 D.
Wisconsin House 60 R to 38 D and the Senate is 21 R to 12 D.
In the end I would predict Arizona, Michigan, Pennsylvania, and Wisconsin will all pick Republican Delegates. At this point nobody knows for sure what the state legislatures will do.
For me, it's very telling that these states which supposedly voted for Biden all have majority Republican legislatures.
