Article 2 section 1.2 of the Constitution states that state legislatures direct the manner in which state delegates are selected.

Pence will ask which of the two slates of delegates was selected in the manner in which your state general assembly has designated?  Is it the Republican delegates or the Democrat delegates?  The state legislatures will put it to a vote. 

My personal opinion of how this will play out is that most of the states in question have majority Republican legislatures and will choose Republican delegates, but it's up to the legislatures of each state to decide.

Arizona's House is 31 Republican to 29 Democrat and the Senate is 17 Republican to 13 Democrat.  I would be surprised it their delegates end up being Democrat. 

Michigan's House is 58 Republican to 52 Democrat and the Senate is 22 Republican to 16 Democrat.  Again, I would be surprised if their delegates end up being Democrat.

Georgia House 103 R to 75 D and Senate is 35 R to 21 D.

Pennsylvania House 113 R to 90 D and the Senate is 28 R to 21 D.

Wisconsin House 60 R to 38 D and the Senate is 21 R to 12 D.


In the end I would predict Arizona, Michigan, Pennsylvania, and Wisconsin will all pick Republican Delegates.  At this point nobody knows for sure what the state legislatures will do.

For me, it's very telling that these states which supposedly voted for Biden all have majority Republican legislatures.

I believe you have confused delegates with electors. 

Delegates:

The delegates are people represent their states at national party conventions. The candidate who gets the support of a majority of delegates becomes that party's presidential nominee.

Electors:

When you vote for a Presidential candidate, you aren’t actually voting for President.  You are telling your State which candidate you want your State to vote for at the meeting of electors. The States use these general election results (also known as the popular vote) to appoint their electors. The winning candidate’s State political party selects the individuals who will be electors.

When citizens cast their ballots for president in the popular vote, they elect a slate of electors. Electors then cast the votes that decide who becomes president of the United States. Usually, electoral votes align with the popular vote in an election.

The electors from each state already voted on December 14th. What is happening tomorrow is a counting of the vote (a formality). In a joint session a few Republican Senators and a few Republican House Representatives intend to challenge the electors' vote on the basis that the election was not legitimate in certain states. Then they must prove their claim, which will likely be that there was election fraud. Good luck with that because there is no proof of election fraud or the courts, including the U.S. Supreme Court would have heard the cases brought before them by the Republican Party and Trump's array of dingbat attorneys and ruled accordingly. Instead, the judges determined the 62 lawsuits were without merit and refused to hear them.

Pretty sure that will NOT be the case.  If they had any "facts", they would have already used them in courts right?  Why lay out the "facts" at time when it is pointless.

To be honest, I am surprised the Dems made such a strong showing at all.  They are not known for showing up to vote in midterms or special elections. This is why I stated back in December that the Senate balance would not change.

But if they do well - focus on healthcare / education reform, don't get crazy with taxes, stay tough on China....they might not.

If they go full open border / free everything / $ for illegals, weak on China,  they will get crushed again, and rightfully so.

Biden is more moderate, but putting AOC/Talib on oversight committees isn't a good start.  Maybe it was just a token to get them to vote Pelosi as speaker, but they should not be what ANYONE wants in that role.

There's a video of the U.S. Constitution? Who knew? Like most legal documents, the Constitution is about as clear as mud. Open to a variety of interpretations. Often when there's a question or a dispute about what the language means, they'll go with past practice.
