You can ask, but he still gets to arrest you. You should educate yourself on the law as being defiant to a sworn officer making an arrest is likely to turn you into a statistic. You might be innocent of what he originally was arresting you for but now you are definitely guilty of resisting arrest-an actual crime as well.

Believe it or not, if you’re a police officer and make hundreds of not thousands of arrests in your career you actually have the leeway to be incorrect on occasion. Arrests of innocent people happen all the time, in fact in every court case where a person is found innocent they were technically “wrongly” arrested. Citizens have rights and will be able to exercise those rights in the proper way once downtown.
