This seems a like valid excuse for having Classified documents in his possession. Could Trump use that same excuse?

Trump allegedly refused multiple requests and subpoenas from the National Archives and the Department of Justice to return documents, and is accused of actively hiding boxes and obstructing the federal investigation. While Biden promptly reported the discovery of documents, consented to voluntary searches of his homes and offices, fully cooperated with the Department of Justice, and faced no criminal charges.

No doubt some folks have done so, without success. Did Trump also not know the difference between classified and unclassified? Oh that's right, Donald Trump repeatedly claimed he had the absolute ability to declassify documents simply by saying so or "even by thinking about it," without needing any formal process.

Biden promptly reported his theft of classified documents he stole while was a U.S. Senator.  I don't know you even type this stuff with a straight face. 

The only reason he faced no criminal charges is the special prosecutor believed Biden was too incompetent to be convicted.

We discussed this at length in this thread, but for the benefit of anyone else reading . . . .

The POTUS is the only person in the country who is the ultimate authority when it comes to classification and declassification of documents and information.  Given that fact, no other person, entity, etc. can impose a "formal process" that the POTUS has to follow.  That would mean the POTUS is not the ultimate authority when it comes to classification and declassification.  But he is.
