Innocent until PROVEN guilty means crooks get off much more frequently than innocent get convicted. Any justice system will have both, ours it tilted to protect the innocent at the cost of criminals going free.

First of all, no one can purchase an "assault weapon". As defined an assault weapon is fully automatic.
