Santos charged with 10 new criminal counts in superseding indictment

Rep. George Santos (R-N.Y.) was charged with 10 new criminal counts over two additional alleged schemes during his campaign, federal prosecutors said Tuesday.

Santos pleaded not guilty in May to a 13-count indictment, and the new charges bring the total to 23.

The additional indictment comes days after Santos’s former campaign treasurer, Nancy Marks, reached a deal with prosecutors and pleaded guilty to conspiring with the then-candidate to fraudulently inflate his campaign finance reports.

Prosecutors are now charging Santos over the allegations, which they dub the “Party Program” scheme, and a second prong described as the “Credit Card Fraud” scheme.

The first scheme was meant to ensure that Santos and his campaign qualified for a “national party committee” program that would provide financial and logistical support to Santos’ bid for Congress, prosecutors said. To qualify, the New York Republican had to show his campaign raised at least $250,000 from third-party contributors in a single quarter.

To make that representation, Santos and Nancy Marks — the treasurer for Santos’ campaign who pleaded guilty to a conspiracy charge last week — agreed to falsely report to the FEC that at least 10 family members made significant contributions to the campaign, despite knowing they had not, according to prosecutors.

The second alleged scheme involved Santos stealing the identities and financial information of contributors to his campaign, charging their credit cards repeatedly without authorization, prosecutors said.

Prosecutors said the new charges comprise one count of conspiracy to commit offenses against the United States, two counts of wire fraud, two counts of making materially false statements to the Federal Election Commission (FEC), two counts of falsifying records submitted to obstruct the FEC, two counts of aggravated identity theft and one count of access device fraud.

The Hill has reached out to Santos and his lawyer for comment. Santos’s congressional office said they don’t comment on legal matters.”

Breon Peace, U.S. Attorney for the Eastern District of New York, said Santos is accused of “stealing people’s identities and making charges on his own donors’ credit cards without their authorization, lying to the FEC and, by extension, the public about the financial state of his campaign.”

“Santos falsely inflated the campaign’s reported receipts with non-existent loans and contributions that were either fabricated or stolen” Peace said. “This Office will relentlessly pursue criminal charges against anyone who uses the electoral process as an opportunity to defraud the public and our government institutions.”

Because the GOP's vote margin in the House is so narrow that they cannot afford to lose his vote. House of Representatives: 221 Republicans (plus 2 Delegates and the Resident Commissioner of Puerto Rico), 213 Democrats (plus 3 Delegates), and 2 vacant seats.

Under the Constitution, any member of the House can be expelled with a vote of two-thirds of lawmakers. House Republicans blocked a Democratic effort to expel Santos in May, instead voting to refer the matter to the House Ethics Committee to conduct an investigation."

That’s the exception, not the rule. Most of these people would rather “win” than do the right thing.

Did he have a daddy? Santos became more of a liability to the House GOP than an asset, so both sides of the House voted to oust him. Simple as that.

Just for the record, Santos has not yet been convicted of the crimes he is currently accused of. He is innocent until proven guilty. Do you suppose if he were found innocent of all that he has been charged with the House would reinstate him? Just curious.

I’m not blind, believe me, I think Hunter needs to be investigated and there’s no way his demented father wasn’t involved. If it’s proven Joe was involved with real evidence not just circumstantial crap, I’d love for obsidian to put his head on a stick. Hunter is a private citizen, Joe is the one in elected office who may or may not be proven to be dirty.

You are correct, they could have done this except he had become a daily embarrassment to the House, mostly the Republican side since it was because of the GOP's earlier votes failing that he was still there. I don't agree with the notion that when something has never happened before so there is no precedent, one cannot be set. Everything that happens has a beginning.

The Constitution gives Congress the power to impeach or in Santo's case expel federal officials. A congress person's constituents cannot impeach or expel them. I believe it is good the House did not choose to impeach him because that is a longer, more expensive process. I for one would not want to see tax dollars expended on this process or on Santos. His constituents also do not have the ability to recall members of Congress. Santos had a year left of his term. Another year of this nonsense would not have been a positive thing for House Republicans.

I am not sure what will happen with Mendez. If he is found guilty of the crimes, he is charged with he is potentially in much bigger trouble than Santo's.

He's was being charged with two misdemeanor counts for failure to file taxes, a single felony count of tax evasion, and a charge related to a gun purchase....basically the failure to file taxes falls into the count of tax evasion.  The gun charge is based on him taking a picture with a gun being displayed.  Most courts would generally toss that out as it was not found in his possesion or was taken in a search but because he's the president's son, he can't exactly use the loopholes that any other defendent would have used.   

If there is money laundering, there needs to be solid proof.

Have you ever heard about a morals clauses? Many companies have them and freely use violating it to terminate employees. Public employers have them. Congress has them. The House calls it the Code of Official Conduct,  https://ethics.house.gov/publications/code-official-conduct.  While the Senate terms theirs the Rules and Standards of Conduct, https://www.ethics.senate.gov/public/index.cfm/ethicsrules#:~:text=The%20Senate%20Code%20of%20Official,Mailing%20Frank%20and%20Radio%20and. The U.S. Constitution has a somewhat narrower take on the terms of expulsion but ultimately gives Congress the authority to act on it.
 
When I saw that Santos had been expelled, I gave it considerable thought. One thing I considered (like you did) was that he was elected by his constituents and therefore should be removed by them. Unfortunately, and as you agree the only way, they have of doing this is by electing a different candidate during a regular election. Based on the U.S. Constitution, the voters do not have the authority to recall the person they elected. State Constitutions may see this differently. Oregon Governors’ have been recalled or at least the voters tried to recall them. The same thing has happened with Portland’s Mayor, Ted Wheeler.

One thing about Santos’ expulsion is he can still be physically ‘in the building’. That could have a disastrous result if the person expelled where to seek vengeance in some violent manner. I doubt Santos would do this though. He may have the gall to tell outright lies, but I cannot visualize him doing something violent. My guess is he is a wimp.

There's plenty of money trail from overseas in the Biden name, just no will to prosecute. Both Hunter and James Biden on behalf of "the big guy". The emails are all there, again no will.

Remember, the corruption can be in broad daylight and if there is no will to out it nothing happens.

I am aware of a morality clause.  However, once that starts happening, it is extremely dangerous and subjective, and will lead to more expulsions for political purposes.
