Hopefully he is paying a mortgage on the new house. Paying cash for the new house with the proceeds from the old house, just to have his wife's name on it as a 50% owner, wouldn't be the smartest move. I'm no lawyer or accountant, but is there any way to keep a house in your own name if you buy it after you're already married? Presumably a prenup could have kept his old house in his own name...

Assets acquired prior to a marriage are not joint assets during a divorce. Only assets purchased with income acquired during the marriage are considered joint assets. If you are worried about someone stealing your money you probably shouldn't marry them. Additionally, you can also have written agreements. If a 40 something lawyer and a finance person were to get married with different assets and children, you would think they may have already discussed and planned for those issues. Personally, I married a Lawyer who makes a lot more money than me so not too worried about her trying to claim have of my income earned during our marriage or half the assets we purchase together we are both still adults with our own things as well. My assets would not change during a divorce but my joint household income would go down considerably.
