You can't sue people for having opinions as well as stating fact. Or perhaps you need to read Chris Cook's interview again, or maybe listen to what Steve Blechman had to say about the situation and called out Gamma-O for what was said. Or perhaps review all the studies on Gamma Oryzanol that says its junk.
There's no libel and no case whatsever, here's why
- "he's selling a bum product"-
Tons of studies prove that Gamma Oryzanol doesn't work. Its also an opinion of mine that he's selling a bum product based upon those studies
- "his business is close to taking a nosedive in a river"
Based off the information of a former employee...non other than Chris Cook. And I believe everything he's saying is true
- "he's ripped off a number of his endorsed athletes"
See name listed above, listen for new grumblings in the wind soon.
- "he is a weasel, folks"
That he is. My opinion....again.
240, you can't compare your case to mine because you went way over the line with Kamali, Shawn Ray, & Chick
I am sure those who are neutral and have legal knowledge will chime in here. Vince, have you listened to the Muscleradio show with Larry pepe? He had on Rick Collins and very specifically broke down what happened when business competitors make statements like this in public forums.
If Burger King's CEO came out and said that mcD's CEo was a weasel, that mcD ripped ppl off, and that McD would be out of business soon, he would be committing libel. Period.
You are making all of these statements. And, your "I heard it from someone" matters nothing- They are responsible for their statements, and you are responsible for yours. Even repeating a statement makes it your own. Those words came from Rick Collins.
I'm sure your sources are believeable. but YOU are the one bashing the man PERSONALLY- and he is a competitor of yours. This is a legal no-no, and I base this upon what Collins said. If he wants to, your words are certainly actionable!
