California Students Sent Home for Wearing U.S. Flags on Cinco de Mayo
Administrators at a California high school sent five students home on Wednesday after they refused to remove their American flag T-shirts and bandannas -- garments the school officials deemed "incendiary" on Cinco de Mayo.
The five teens were sitting at a table outside Live Oak High School in Morgan Hill, Calif., on Wednesday morning when Assistant Principal Miguel Rodriguez asked two of them to remove their American flag bandannas, the Morgan Hill Times reported. The boys told the newspaper they complied, but were asked to accompany Rodriguez to the principal's office.
The five students -- Daniel Galli, Austin Carvalho, Matt Dariano, Dominic Maciel and Clayton Howard -- were then told they must turn their T-shirts inside-out or be sent home, though it would not be considered a suspension. Rodriguez told the students he did not want any fights to break out between Mexican-American students celebrating their heritage and those wearing American flags.
"They said we were starting a fight," Dariano told the newspaper. "We were fuel to the fire."
The boys told Rodriguez and Principal Nick Boden that turning their shirts inside-out was disrespectful, so their parents decided to take them home, the newspaper reports.
"I just couldn't believe it," Julie Fagerstrom, Maciel's mother, told the newspaper. "I'm an open-minded parent, but it's got to be on both sides. It can't be five kids singled out."
Galli told NBC Bay Area, "They said we could wear it on any other day, but today is sensitive to Mexican-Americans because it's supposed to be their holiday so we were not allowed to wear it."
In a statement released on Wednesday, the Morgan Hill Unified School District said it did not agree with the school's actions.
"In an attempt to foster a spirit of cultural awareness and maintain a safe and supportive school environment, the Live Oak High School administration took certain actions earlier today," the statement read. "The district does not concur with the Live Oak High School administration's interpretation of either board or district policy related to these actions."
Attempts to reach school officials early Thursday were not successful. A secretary told the Morgan Hill Times that Boden and Rodriguez were unavailable for comment on Wednesday.
According to its website, Live Oak High School is a 1,300-student institution in the southern part of Santa Clara County, with most students residing in the nearby cities of Morgan Hill and San Jose.
"The student population reflects the rich ethnic and socioeconomic diversity of the community," the website reads.
More than 100 students were spotted wearing the colors of the Mexican flag -- red, white and green -- as they left school, including some who had the flag painted on their faces or arms, the Morgan Hill times reported.
While bandannas of any color are banned at the school, its dress code policy does not contain references to American flags.
"However, any clothing or decoration which detracts from the learning environment is prohibited," the policy reads. "The school has the right to request that any student dressing inappropriately for school will change into other clothes, be sent home to change, and/or be subject to disciplinary action."
Freshman Laura Ponce, who had a Mexican flag painted on her face and chest, told the Morgan Hill Times that Cinco de Mayo is the "only day" Mexican-American students can show their national pride.
"There was a lot of drama going on today," Ponce told the newspaper.
Some other Mexican-American students reportedly said their flags were taken away or asked to be put away, but no other students were sent home on Wednesday.
Eugene Volokh, a professor of law at the University of California-Los Angeles, said the students are protected under California Education Code 48950, which prohibits schools from enforcing a rule subjecting a high school student to disciplinary sanctions solely on the basis of conduct, that when engaged outside of campus, is protected by the First Amendment.
If the school could point to previous incidents sparked by students who wore garments with American flags, they could argue that the flag is likely to lead to "substantial disruption," Volokh said.
"If, for example, there had been fights over similar things at past events, if there had been specific threats made," he said. "But if [school officials] just say, 'Well, we think it might be offensive to people,' that's generally speaking not enough."
Volokh said the students and their parents likely have a winning case on their hands if they decide to take the matter to court.
"Oh yes, it's almost open and shut," he said.
Lis Wiehl, a former federal prosecutor and a Fox News legal analyst, said the incident appears to a "blatant" violation of the students' First Amendment right to free speech. She noted that inciting violence is an exception to a First Amendment legal defense, but Wiehl said she saw no indications that the students provoked anyone.
"Unless I'm missing something, this seems like a blatant violation of the First Amendment," said Wiehl, adding that uniforms are not required at the public school. "And they're wearing, of all horrific things, the American flag."

Absolutely rididulous!!! If old men are allowed to wear socks with sandals, teenagers should be able to wear American flag T-shirts in an American highschool, no matter how garish & obnoxious a flag T-shirt may be.
I'm speculating they felt their was going to be some friction and he decided it wasn't goinngto happen in his school on his watch, and sought to avoid potential bad publicity. lokks like he may hhave gotten it anyway, but this is only speculation on my part. A stupid move.

Guess who else uttered the exact same phrase last year? James Crowley, the white Cambridge cop who arrested black Harvard professor Louis Gates, Jr. and was singled out in a nationally televised press conference by President Obama for "acting stupidly."
On July 23 of last year outside his home, a reporter told Crowley that Gates had asked for an apology from him for his handling of the incident.
"There will be no apology," Crowley replied.
After a beat, the reporter followed up: "Is this now and ever, 'no apology,?"
"Yes," Crowley replied flatly.
The fact is, Americans are increasingly fed up with the racially divisive, politically correct insanity pulsating through the country today. After years of being pressured and browbeaten by the left-wing PC police about what they can say, do, think, and wear, many Americans have had enough. And they're especially furious with being asked to apologize for things that aren't or shouldn't be in the least bit offensive.
The idea that high school kids anywhere in America would be called the principal's office - let alone that they would be asked whether they should apologize - for wearing clothes bearing the image of the United States flag, is a perfect case in point.
It's the kind of insanity that rankles the sensibilities of millions upon millions of Americans, and has them cheering when someone - whether a Cambridge cop or a Bay Area mother - stands up, refuses to back down, and says, "there will be no apology

It's not the same. Dariano was the party injured by the actions of the authority in charge. In the gates/crowley affair, Gates was the one injured, and Crowley was the authority in charge.

However, sending an AMERICAN kid home for wearing an AMERICAN flag on any day is absolutely absurd. It's beyond ridiculous.
Watching WWII films, and reading books, biographies, etc., from people who lived during that era, it seems that there was a level of pride about our country that just isn't there today.
There's no doubt that people found fault with many of our Government's policies back then too...so it's not that. We're all a bunch of fuckwads that have allowed dumber fuckwads to make us lose that sense of pride. We live in a great country where (although we're moving in an opposite direction at this time) anyone that is willing to put in the effort can make a great life for themselves and their family.
You don't punish people for supporting that.

I think rccs's perspective is a little different from those of us in North America.
In Portugal, and in fact many European countries, culture & ethnicity are homogenized.
Multi-ethnic countries like Canada & the USA are imo rather unique, but very reflective of the fact that culture does not necessarily fall along lines of ethnicity, ...especially in the USA.

According to ou dictionary ethnicity means a group if people with a different culture (creed, political view, different language and different race). By our standards, for example, white british are not an ethnic group, but black british are an ethnic group because they are derived from Africa, which holds several different ethnicities opposed to ours. I know that this might actually soud strange, but in fact it is real. So the answer of the other guy is an hollow, ignorant argument.

I consider 'ethnicity' to be defined by race, genetics, ancestry etc.,
I consider 'culture' to be defined by language, customs, ideologies, ways of doing things, values, concepts & traditions held dear etc. I consider 'nationality' to be defined by what your passport says and where you live.
For example: While a 5th generation NYer name Joseph, born & raised in NYC, whose great, great grandparents emigrated to America from Italy, may share a common ethnicity to a guy named Giuseppe who has lived on a vineyard in Tuscancy his whole life, they do not share the same culture. At some point however, they may share the same nationality.
North America is different from Europe, because it's population is derived mostly from emigrés as opposed to the natural geometric population increases that we see in older countries and cultures. While North American population increases were caused by a different set of factors, This uniqueness imo, reflects the often overlooked fact that ethnicity & culture are not necessarily the same, and that unlike Europe, one's ethnicity is not necessarily an accurate barometre of their culture. The very difference between Canada & the USA punctuate this point precisely. For all our similarities, we are two very different people.

btw - The british are just as much a combination of different ethnicities as those whose ancestors came from Africa. Brits are a combination of Saxons, Normans, Celts, Romans etc. How do you think all those dark Irish with black hair & blazing blue yes came up to exist next to pale freckled redheads etc., Through Britain's (the UK, Ireland, Scotland, etc) centuries of interbreeding for want of a better word, they left us with what we know call Brits, and we rarely distinguish between their varied ethnic composition, but the different ethnicities do exist.
