A campaigner has lost a Supreme Court case challenging the government's refusal to issue gender-neutral passports.

Christie Elan-Cane said the application process breaches human rights laws by not allowing an "X" option.  But the court said applicants' gender was "a biographical detail which can be used to confirm their identity".  Christie Elan-Cane said the case will now go to the European Court of Human Rights.

The campaigner, whose pronouns are per/per/perself, has called for legal recognition of non-gendered identity for decades, said on Twitter that the "UK government and judicial system are on the wrong side of history" and "this is not the end".

The 31-year-old had been kicked out from The Albion after breaking the rules by not wearing a face mask, and dancing in a sexually provocative manner when customers were supposed to remain seated during the covid pandemic.  As she was being escorted from the premises by bouncers, Sims assaulted and spat at the landlord and two security staff.  Despite having no shoes on her feet, she made off when police arrived. CCTV operators then tracked her while she carried out the lewd act.

Now Sims - who was arrested after a police pursuit - has been sentenced to five months in prison, suspended for 12 months at North Staffordshire Court.

Prosecutor Karen Wright said the police were called to The Albion at 10.40pm on June 18 last year according to Stoke-on-Trent Live.  Miss Wright said: “A female has been ejected due to the fact she had assaulted security staff. They were punched and spat at when trying to remove the defendant from the location.  “The revolving door was knocked off its axis after the defendant had kicked out at it when security staff tried to stop her re-entering the pub.

“On arrival of the police, the defendant left. She was wearing a pink dress and left her shoes behind. She was spotted walking down Percy Street by CCTV operators.

“She raised her dress up and lowered her pants to reveal a penis and continued to walk 40 feet with the penis exposed. This occurred in public view. Members of the public appeared shocked by the defendant’s actions.

James Hulse, mitigating, said the defendant says her victims were cruel to her.

“She has had that cruelty for most of her life,” said Mr Hulse.

“She seems to bear the brunt of that.”
