BELLMAWR - A gym that's operating here in defiance of a state order removed one of its doors last night, seeking to foil an expected effort to padlock the entrance. "I came in the middle of the night and took the door off its hinges," Frank Trumbetti, a partner in The Atilis Gym, told the Courier-Post Monday morning. Trumbetti, who expects a judge to rule against the gym later Monday, said he and partner Ian Smith are prepared to remain in the business indefinitely."The gym will be open no matter what," Smith vowed in a Facebook post over the weekend. "If they want to change our locks, they are going to have to take us out of here by force." Monday's state court hearing comes during an ongoing battle between the gym and Gov. Phil Murphy, who has barred indoor operations at gyms as part of the state's response to the COVID-19 pandemic.

And today...

Ian Andrew and Atilis gym just won their case Gov murphy brought against them for contempt of court. The governor threatened to change the locks on their rightfully rented building and business like a tyrant and throw them in jail. The good guys won one for today.

I live in nj ,,no you still can’t go train in gym,if so it will last only few days until it’s re shut.it sucks big time but this is it  some gyms can use a trainer only set up I gues you pay the trainer who gets access and you then can train it’s only by appts fuk that

In Hawaii, we have had a total of 415 cases out of a population of about one million. That's about .04% of the population. An average of about 10-20% of the population will get the flu every year. Of the 415 cases, 53 have required hospitalization, about 12%. Of the 415 cases 92% has fully recovered. There has been a total of 11 deaths, all but two had a preexisting condition or were over 65.

Democratic Governor, David Ige has extended the lockdown for another month going until July 1st. When you have a job, a steady income, and are not subject to the rules you impose on others, making these edicts is quite easy.

Unfortunately I have a job with customers in and out all day and eyes on us people are watching if we are behaving and following mask rules social distance etc,,,tough times.customers are ratting and keeping tabs too

The owners of Atilis Gym were arrested Monday morning in the latest chapter of the New Jersey gym’s repeated defiance of the state’s coronavirus protocols, the Camden County Prosecutor’s Office announced.  The arrests came just days after a judge ruled the the owners were in contempt of court and could begin facing fines for keeping their gym open, despite Gov. Phil Murphy’s order that gyms cannot be open as the state continues to battle the coronavirus pandemic.

Ian Smith, 33, of Delanco Township, and Frank Trumbetti, 51, of Williamstown, were charged with one count of fourth-degree contempt, one count of obstruction, and one count of Violation of a Disaster Control Act. The men were transported to the Bellmawr Police Department, where they were charged and then released.

Authorities said they observed a number of people entering and using the gym throughout the weekend after Judge Robert T. Lougy issued a court order Friday for Trumbetti and Smith to vacate the gym and cease operations. Police said both owners refused to leave the gym when asked Monday and were subsequently arrested.

Smith’s attorney, James Mermigis, said the gym was boarded up by authorities Monday and the owners do not have access to get inside. He said he is unsure what Smith and Trumbetti’s next step would be, but he remained adamant that Murphy’s order to have gyms still shutdown is “unconstitutional” when activities like gymnastics and martial arts have re-opened at certain capacity limits. “I do believe the governor is overreaching and I do believe this has gone too far,” Mermigis said.

After Judge Lougy’s ruling Friday, Smith told NJ Advance Media they will do “whatever we possibly can” to fight the decision, and he planned to remain in the gym until authorities removed him. “We will not leave this building under any circumstances unless they take us out in handcuffs,” Smith said.

Gov Manjina Murphy backs the BLM and Antifa commies and the fake systematic racism narrative, but he arrests 2 gym owners in the fear of spreading a fake virus.

Also, they were arrested by police who DID NOTHING as businesses were getting vandalized, burned down and looted.

Still amazed that a governor would actually spend time, money, police, courts and so much more arresting and attacking business owners, when thousands of protesters, gatherers and prisoners that are being let go from jails is far less important to these people.

Wow - just wow.

Go to a Costco or a WalMart, and you are packed in there. Go to a protest gathering, which is more than 20 people, and there are no social distancing whatsoever, which is the main issue.  But at the gym, 6 feet apart, cleaning supplies, hand sanitizers, and more.  Such a threat. 

Pathetic.

As I have said before, ANY business that can practice social distancing, face maks and keep things clean should be allowed to open. But for this governor, no way.  The economy of the USA will be hurt for years to come because of these inept ideas of the governors. Too bad he doesnt have Elon Musk's factory in his state...

I am renting shore house right next to a small gym in nj and it’s usually packed everyday ,it’s weird seeing it shut

The owners of Atilis gym in New Jersey reopened on Saturday by kicking down the wooden barricades authorities used to block their entrance amid coronavirus restrictions. Co-owner Ian Smith posted a video of himself and his business partner, Frank Trumbetti, kicking the barriers and entering as a crowd cheers their decision. The dramatic display indicated that the months-long standoff between Gov. Phil Murphy and the gym owners wasn't finished.

New Jersey's Atilis Gym, which reopened against COVID-19 emergency orders, loses business license

BELLMAWR, N.J. — A New Jersey gym that reopened against statewide pandemic orders has lost its business license.

The 5-1 vote by the Bellmawr Borough Council on Tuesday night came nine days after the owners of Atilis Gym kicked in a plywood barrier installed by authorities after a state judge found the gym in contempt for violating court-ordered limits on indoor operations.

The gym’s owners, Frank Trumbetti and Ian Smith, have also defied COVID-19 emergency orders imposed by Gov. Phil Murphy and New Jersey Health Commissioner Judith Persichilli.

The license revocation took effect immediately, but patrons continued to use the gym Wednesday.

At Tuesday's meeting, a lawyer for the gym owners argued the business did not threaten public safety.

“You’re saying they violated safety standards?” asked attorney John McCann. “What’s the standard?”

“Where’s the evidence that they’re a danger?” continued the attorney, who claimed the gym is “the safest place in New Jersey right now.”

Prior to the vote, Bellmawr Police Captain Michael Draham described repeated violations of shutdown orders at the gym.

The borough’s zoning officer, Jim Burleigh, also said the gym had failed to request township approval before moving some exercise equipment into the parking lot for patrons’ use.

Burleigh asserted large pieces of equipment outside the business could be a hazard for children.

McCann, however, argued borough officials had not shown the gym was a threat to public health. He contended no gym patrons have been infected by the coronavirus, attributing that information to Trumbetti and Smith.

“I take my clients at their word,” said the attorney, who noted Trumbetti's mother had died from COVID-19.

McCann also said council members should require proof that the gym is a health risk.

“Demand the science from the state,” McCann said.

“The Atilis Gym would close tomorrow if we could see the science,” he added.

The state Attorney General’s Office has cited scientific reports to support the view that “extensive and prolonged interactions (at gyms) continue to present significant risks."

In a May 22 court filing, the state noted a study from South Korea found the risk of infection in gyms “is high, perhaps higher than other confined indoor spaces in which people remain for extended period (sic) of time."

The gym controversy has drawn sign-carrying, flag-waving supporters to the Bellmawr business and led to appearances by Trumbetti and Smith on national television.

In a Facebook post Sunday, Smith predicted the council session would be "very clearly an extension of Murphy's will." Smith also said he and Trumbetti were prepared to live at the gym in an effort to prevent its closing.

Several protest participants were among audience members who sharply criticized the council’s vote. Among other points, they claimed the COVID-19 death toll has been inflated and that the governor’s emergency orders are unconstitutional.

The license revocation “was damaging and it doesn’t promote unity,” said Dawn Fantasia, a Sussex County freeholder who attended the meeting remotely.

The only Bellmawr residents to speak supported the council’s vote.

“I just wanted to say, ‘Thank you,’” said Jesse Jamison.

Kathleen Mortka said her initial support for the gym ended when promised safety guidelines were not implemented.

"There are photos on social media … showing unmasked people who were not social distancing," Mortka told the council. She said that showed "they did not care about me or any other patrons."

Murphy closed gyms statewide under a March 16 order intended to curb the spread of COVID-19, which is blamed for more than 14,000 confirmed deaths and more than 1,800 probable deaths in New Jersey.

Persichilli issued another shutdown order May 20 after the gym reopened without authorization. The gym was allowed to reopen on June 15 to accommodate retail businesses inside the building.

The state took the gym back to court last month, alleging "wanton violation" of a court order that allowed only individualized instruction inside the building.

Superior Court Judge Robert Lougy in Trenton issued the contempt finding on July 24, setting the stage for Trumbetti and Smith to force their way into the closed gym on Aug. 1.
