Yes, it's self defence, but it's where his head and intentions were at before that. He went with a loaded gun knowing he would put himself in a confrontational situation.

If he was stood on the side of the road and they came and confronted him then he would have nothing to worry about. As it stands I don't think it will end well for him.

Arguing the law on Getbig....

What this will boil down to is state and local laws. And if he has a CCW.

What does the video show? What does his social media show?

The prosecutor will argue his mindset and intentions his defense will argue or defend those.

If this was a guy with a legal permit walking through a protest, trying to get home safely, or if he even showed up with the idea of arguing with protesters a good attorney will prove his intentions were just as peaceful as the mobs. Why would a protester have a knife or use a skateboard as a weapon on someone who’s verbally disagreeing with them? If he has a CCW he didn’t break a law (depending on ordinances).

If this dude just showed up with a gun that he wasn’t legally allowed to carry in public then he will have  a real case against him.

He was carrying a hand gun illegally. He showed up to a protest with said gun to prevent a statue being torn down.

I mean if you were only sharing your opinion on his actions that’s one thing but as you said you don’t think it will end well for him, meaning the law will work against what your opinion is.

It doesn’t matter. This will take years to go to trial and by that time opinions may have changed on the actions of the protesters.

Multiple laws were being broken, a good attorney should be able to present those facts.

Fuck you all.  I did work in law enforcement and wore that badge a long time also.  I also studied criminal justice and constitutional law.  That is the way its seen AND THATS WHY HE WAS ARRESTED.

We have reached a point in America where you can't defend yourself. Multiple attackers with one clearly having a knife. Who wouldn't shoot to defend yourself. Well they dropped the shooting charge (for now) and they are charging him for his actions prior to the shooting.

It seems the court of public opinion has more power than ever, and in the above mentioned incident it is a good thing that justice prevailed.

This guy is a bozo. He went looking for trouble, as were the “protesters” destroying public property, he found it and now he can deal with consequences.

Bernalillo County District Attorney Raúl Torrez said he had serious concerns an initial police investigation into the Monday shooting did not identify who owned multiple weapons collected at the scene, including knives, nor interview key bystanders and police.

Torrez dropped an initial aggravated battery with a deadly weapon charge against Steven Baca, 31, after images emerged online showing protester Scott Williams, 39, holding what was rumored to be a knife before he was allegedly shot by Baca. Torrez said he expected Baca to claim self defense in the case.

“There have been rumors on social media about what transpired in the final seconds before this and we are actively looking into those and whether or not this was justified,” Torrez told an online press briefing. “The reason he is not facing that charge right now is because this investigation is not complete.”

Videos show Baca, a counterprotester at a demonstration to remove a conquistador statue, tussling with demonstrators before pulling out a handgun and shooting several times.

Torrez said that under New Mexico law, a person cannot claim self defense if they are the first aggressor.

Torrez said his office had put out a call for information on allegations Williams was armed.

“Right now I have no evidence to suggest that he was in any way armed,” Torrez said. “The fact that we haven’t charged it (shooting charge) today doesn’t mean it will not be charged.”

Torrez filed four new charges against Baca for unlawful carrying of a firearm and battery for allegedly assaulting three women before the shooting.

Baca’s lawyer Jason Bowles said he would plead not guilty to all charges, the Albuquerque Journal reported. Bowles did not immediately respond to a request for further comment.

Maybe I could have been a little clearer. His use of the gun looked like self defence as he only pulled it out and used it after being attacked and when it looked like his life was possibly in danger. I think he actually tried to use pepper spray on those chasing him before reaching for the gun.
