I've been watching Tucker for a while now to see what all the fuss was about.  I watch a broad spectrum of views so I can attempt to form my own opinion - he's an interesting character, very watchable

And from a UK point of view (so yeah I should go fuck myself) I'd ask 2 questions:

1.  How can he be in breach of contract (not to work for another organisation until 2025) if he's posting as a individual - did he Incorporate himself or something?

2.  As for his defence - 1st Amendment protection only applies to Federal Govt attempts to stymy it, no?  Contract law such as NDA's would not be possible otherwise, surely...?

Never could stand the guy and am not following his demise at Fox or his rise on Twitter but here is my take on your two questions:

1. I have the same question as your Question 1. How can Fox prevent him going to Twitter? The only thing I can think of is that there is wording in his initial contract with Fox that somehow pertains to this (non-compete forever forever no matter what??). But it would be pretty piss poor of Fox to enforce this wording after FIRING him.

2. You are correct. US Constitution First Amendment does not apply here. Fox News can tell him what or what not to say as Twitter can basically do as well (private employers or private speech platforms).
