PHOENIX – The U.S. Justice Department is filing a lawsuit challenging the constitutionality of Arizona's new law targeting illegal immigrants, setting the stage for a clash between the federal government and state over the nation's toughest immigration crackdown.
The planned lawsuit was confirmed to The Associated Press by a Justice Department official with knowledge of the plans. The official didn't want to be identified before a public announcement planned for later Tuesday.
The lawsuit will argue that Arizona's new measure requiring state and local police to question and possibly arrest illegal immigrants during the enforcement of other laws, like traffic stops, usurps federal authority.
Tuesday's action has been expected for weeks. President Barack Obama has called the state law misguided. Supporters say it is a reasonable reaction to federal inaction on immigration.
The law requires officers, while enforcing other laws, to question a person's immigration status if there's a reasonable suspicion that they are in the country illegally.
Republican Gov. Jan Brewer signed the law in April, and it was set to go into effect July 29. The lawsuit could delay implementation of the law.
Arizona passed the law after years of frustration over problems associated with illegal immigration, including drug trafficking and violent kidnappings. The state is the biggest gateway into the U.S. for illegal immigrants, and is home to an estimated 460,000 illegal immigrants.
The lawsuit is expected to be announced by Attorney General Eric Holder and Homeland Security secretary Janet Napolitano, a former Arizona governor.
President Barack Obama addressed the Arizona law in a speech on immigration reform last week. He touched on one of the major concerns of federal officials, that other states were poised to follow Arizona by crafting their own immigration enforcement laws.
"As other states and localities go their own ways, we face the prospect that different rules for immigration will apply in different parts of the country," Obama said. "A patchwork of local immigration rules where we all know one clear national standard is needed."
The law makes it a state crime for legal immigrants to not carry their immigration documents and bans day laborers and people who seek their services from blocking traffic on streets.
The law also prohibits government agencies from having policies that restrict the enforcement of federal immigration law and lets Arizonans file lawsuits against agencies that hinder immigration enforcement.

Illegal Immigration Costs U.S. $113 Billion a Year, Study Finds

The cost of harboring illegal immigrants in the United States is a staggering $113 billion a year -- an average of $1,117 for every “native-headed” household in America -- according to a study conducted by the Federation for American Immigration Reform (FAIR).
The study, a copy of which was provided to FoxNews.com, “is the first and most detailed look at the costs of illegal immigration ever done,” says Bob Dane, director of communications at FAIR, a conservative organization that seeks to end almost all immigration to the U.S.
FAIR's opponents in the bitter immigration debate describe the organization as "extremist," though it is regularly called upon to testify before Congress.
Groups that support immigration reform immediately attacked FAIR's report and pointed out that it is the polar opposite of the Perryman Report, a 2008 study that found illegal immigration was actually a boon to the American economy. It estimated that illegal immigrants add $245 billion in Gross Domestic Product to the economy and account for 2.8 million jobs.
The FAIR report comes as President Obama moves immigration reform to the top of his agenda, and it is likely to be a rallying point for those who oppose the president. At a speech Thursday at American University in Washington, D.C., Obama argued that the entire immigration system is broken and needs sweeping reforms. Among the changes he said are needed is "a path for [farm] workers to earn legal status," which the president's critics called an opening for a new amnesty program.
FAIR's report argues that there are two choices in the immigration debate: “One choice is pursuing a strategy that discourages future illegal migration and increasingly diminishes the current illegal alien population through denial of job opportunities and deportations. The other choice,” it says, “would repeat the unfortunate decision made in 1986 to adopt an amnesty that invited continued illegal migration.”

The report states that an amnesty program wouldn’t appreciably increase tax revenue and would cost massive amounts in Social Security and public assistance expenses. An amnesty “would therefore be an accentuation of the already enormous fiscal burden,” the report concludes.
The single largest cost to the government of illegal immigration, according to the report, is an estimated $52 billion spent on schooling the children of illegals. “Nearly all those costs are absorbed by state and local governments,’ the report states.
Moreover, the study’s breakdown of costs on a state-by-state basis shows that in states with the largest number of illegals, the costs of illegal immigration are often greater than current, crippling budget deficits. In Texas, for example, the additional cost of immigration, $16.4 billion, is equal to the state’s current budget deficit; in California the additional cost of illegal immigration, $21.8 billion, is $8 billion more than the state’s current budget deficit of $13.8 billion; and in New York, the $6.8 billion deficit is roughly two-thirds the $9.5 billion yearly cost of its illegal population, according to Jack Martin, the researcher who completed the study.

“The most important finding of the study is the enormous cost to state and local governments due to lack of enforcement of our immigration laws,” Martin wrote.
The report found that the federal government paid $28.6 billion in illegal related costs, and state and local governments paid $84.2 billion on an estimated 13 million undocumented residents. In his speech, Obama estimated that there are 11 million.
But FAIR's critics said the report wrongly included American-born children of undocumented workers in its study.
“The single biggest 'expense' it attributes to unauthorized immigrants is the education of their children, yet most of these children are native-born, U.S. citizens who will grow up to be taxpaying adults," said Walter Ewing, a senior researcher at the American Immigration Council. "It is disingenuous to count the cost of investing in the education of these children, so that they will earn higher incomes and pay more in taxes when they are adults, as if it were nothing more than a cost incurred by their parents."
He added that “the report fails to account for the purchasing power of unauthorized consumers, which supports U.S. businesses and U.S. jobs” and that it “ignores the value added to the U.S. economy by unauthorized workers, particularly in the service sector.”
Martin said FAIR expected that criticism, but that because the children are a direct result of illegal immigration, their inclusion was both fair and reasonable.

1- Bush did not run on the hope and change platform. By definition, the reelection of the incumbent is more of the same. Many voted him in for a second term because we were in the midst of two wars and Kerry was not a viable alternative. Also, throw in low UE, continued economic prosperity and the rabid movement of the left to remove him from office ( even going as far as to use a Hollywood documentary; Fahrenheit 911) and most people were going to bend over backwards just to keep him.
2- Do you consider the "majority" to be the virtual entirety of the media, entertainment industry, the international community, most people in the United States under 30, about half the country that votes, and the entire democratic party? He was bashed so badly, that two years after leaving office, his predecessors still blame him for everything and anything that goes wrong anywhere in the world.
3- I hate to use a schoolyard analogy, but two wrongs don't make a right. Obama is the president now. Obama was supposed to herald the dawn of a new day. A throughly inexperienced used car salesman is currently the leader of the free world. Fake it to make it doesn't work anymore. Smiling and giving uplifting speeches is a poor substitute for governing. The sooner he and his supporters realize that, the better.

I think that obama did the right thing agenda wise on health care I vehimently disagree with it but he passed a VERY VERY flawed billed that will likely end up costing us money but what it will do for his agenda is force us to fix it down the road and thus keeps health care reform moving foreward.

He and I got the old vets in the trailer park to chase out dirtbags who had run the place for years. I moved there (broke for college, split with girl, and dad had an empty trailer for us).
Within a week, I realized how much I hated the dirtbags. So at the community monthly meeting, we talked about what we could do about it. We started roaimg the park at night in packs, doing laundry late at night, gathering intel on who was doing what. We started calling the police in groups, so they'd respond faster. We started carrying a bit more open, legal but scary. The old vets started hunting racoons at night, and capping them with a 22 for all to hear.
The groups of people hanging in cars, making deals, moving girls.... they stopped. They were tired of hillbillies with implied threats, and the law certainly on our side. They left.
I'd do the same damn thing today if it happened on my block again. Occasionally I'll see someone who doesn't belong, I'll make my presence known, and let them know without saying a word that Error 404, Prey not found ;)

of course not. cops told us what was legal and what was not. we followed the law. police started arriving in the park from both exits at once to make sure no strange cars got away. it was more of a teamwork thing with the police who were happy to clean up the area.
Hey, you guys don't have to agree with it. Maybe keeping your head down and hoping "the govt" will solve crime in your neighborhood will work. we didn't feel like waiting for that.

Once again showing your ignorance. Nuclear technology (with 3rd generation recycling of waste material) and offshore wind are both more than viable for the energy of this country long term. You should really look into this before you make such ignorant statements. Maybe you should step outside the fox news oil loving box and see exactly where technology is and where it can take us.
You're talking about taking 10-20 years minimum to get something somewhat viable from colorado using a highly environmentally insensitive method, invest that time and money in nuclear and wind and you have yourself a sustainable ongoing power source with a fraction of the emissions and totally renewable. Continue the use of oil for transportation until we have the energy abundance to make electric gas hybrids more affordable and sustainable. Not only do you have energy independence but you also cut emissions and create jobs that will be needed ongoing long after any oil would have run out.

Creates a shit ton of American Jobs and Fully REvives and entire industry in the states...
2) We can slash the Price per barrel...Right now we are at $75/barrel...we can cut that in half to $35/barrel or lower
3) We will be able to stop depending on oil from the saudis which would take a factor out of our political dealings with the middle east...
4) Unlike offshore drilling a mile under water...we can get to a leak...above ground...

I have a 17 and a 26. I'm not kidding when I tell you that the 26 is the best gun i have ever had or shot bar none. Its small, concealable, etc. I literally have tens of thousands of rounds threw my glocks and never once have had a jam or anything.
Its small, but its a 9mm and accepts the pre-ban hi capacity mags. At 25 Yards I am far better than with the 17. I don't even shoot my 17 anymore as the 26 is more accurate. At 15 yards, I am as good as the guys with the $1,200 Kimbers.
I shot my friends' HK and prefer the glock by far. Once you get used to the trigger, its an even better gun. Ask 240, he will tell you the same thing.

Most of my neighbors barely speak English. Whether its indian, portugese, spanish, korean, i am like the last of the mohicans where I live.

the sig gets my junk hard... but the glock is simple perfection. Use the sig for a conversation piece - but keep the glock if shit ever gets dirty. You dont want a hammer snag at the wrong moment.

Glock by far is the most reliable out there bar none. Big Mal - if you buy a Glock - it will never fail to go boom when you pull the trigger.
You can't go wrong with Glock. Well worth the $550 - $650.

for real, i understand you can't be as vigilant in a crowded place like NYC. For me, locally, it worked to chase the dirtbags out (no matter to me if illegal or legal).

Chandler police arrest man in stabbing, decapitation

Chandler police are investigating the bizarre case of a man who was stabbed, decapitated and left in a pool of blood in a central city apartment.
One man has been arrested and police are seeking three more suspects in what may the city's first beheading.
"We don't go to many cases where the victim has been decapitated," said Chandler Police Det. Frank Mendoza.
The man police arrested in the case, Crisantos Moroyoqui, 36, is an undocumented immigrant who lived across the way from the murder scene. He rented a bed for $100 a month in a small apartment shared by five other day laborers. He had lived there three months, his roommates said Monday.
He spent Sunday morning drinking across the walkway with the victim and three other men. The other four had just arrived this past weekend, neighbors said. No one knew them well. But two other men who went to sleep about 4:30 a.m. saw the five men still drinking.
"Before going to bed, they saw the victim alive and well with Moroyoqui and three other Hispanic males in the living room," police said.
Sometime between 4:30 a.m. and 5:30 a.m., one of the four visitors, a Hispanic male in his 30s, was stabbed, decapitated and left in a pool of blood.
The three remaining visitors fled in a 2003 red Ford Expedition with California plate 6FWR784, police said. Moroyoqui, his tan shoes covered in blood, had apparently walked the few steps to his apartment and fallen asleep in the bed he rents, police said. Police reported he also had blood on his pants, which they are testing to determine if it belonged to the victim.
Neighbors reported seeing candles burning in the apartment. The men also used a Ouija Board, also known as a spirit board, neighbors said. Empty cases of Bud Light beer were evident Monday, as was a large red stain in the carpet.
Police would not comment Monday on whether they are looking into the possibility that the four men were practicing a ritual that involves decapitations. Nor would they say whether drugs were involved.
"In any type of homicide investigation we look at every angle, whether greed, drugs…" Mendoza said. "There is a reason why they did this to this guy. We just don't know what it is yet."
When police responded to the scene, they said Moroyoqui at first provided a false identity He has exercised his right to remain silent.
He was arrested on suspicion of 2nd degree murder and hindering prosecution.
The other suspects, considered armed and dangerous, are:
Juan Campos Morales Aguilar, also known as Asai He is about 5 foot 10 inches, 220 pounds and has short dark hair and a thin mustache. He was least seen wearing a black shirt with a white T-shirt and jeans.
Jose David Castro Reyes, 25. He is about 5 feet 10 inches tall, is clean shaven and has short hair. He was wearing jeans, a white shirt and a white T-shirt.
The third suspect is known only as "El Joto." He is about 5 foot 3 inches tall, with short spiked black hair and a goatee. He was wearing a white T-shirt, with a black pattern shirt and Levis.
Anyone with information about this case is encouraged to call 911.
