In terms of the law, does the "no trespassing" sign give him right to shoot and kill? I am assuming no because the guy is being charged with murder. Getbiggers, speak on this.

A man in Cape Coral, Florida on Wednesday was arrested for shooting and killing an unarmed door-to-door salesman on his property.
Kenneth Bailey Roop, 52, has been charged with second-degree murder for killing 30-year-old Nicholas Rainey.
A co-worker who witnessed the shooting said Rainey had knocked on Roop’s door, but received no answer. While Rainey was walking down the drive-way, Roop pulled up in his pickup truck and asked why Rainey was at his house. Rainey explained that he was selling steak and seafood. The witness said Roop then pulled out a black handgun and shot Rainey. As Rainey lay on the ground, Roop fired another bullet into the back of his head.
Roop later told police that he shot Rainey in the head “for effect” and that he had three no trespassing signs on his property. Roop said he feared for his life.
“I’m not going to give him the chance to do something to me,” he told police. “I was in fear.”
An off-duty Collier County sheriff’s deputy was nearby and heard the gunshots. When she arrived at Roop’s property, she found Rainey dying on the ground while Roop was in his garage reloading his handgun.
“He was telling the officer, ‘he stepped on my property, he trespassed, I’ll kill anybody that steps on my property,’ somewhere along them lines. It was just unbelievable,” one witness told the The News-Press. “She never flinched. She deserves a medal. I don’t think he was done [shooting].”
The deputy ordered Roop to drop his weapon and held him at gunpoint until police officers arrived.
Roop’s neighbors described him as “the neighborhood crazy.” Roop has a concealed weapons permit and approximately 14 firearms.

That's the problem with concealed carry. Think about the nuts on your block that have no police record carrying a gun that could take a life with a little movement of an index finger.
The growing concealed carry movement is scary. Think of the fender bender car accidents that would lead to a shooting after an argument. That is how the first concealed carry shooting happened in Texas. A guy threw a punch in a fender bender and the other guy shot him dead. No gun and he would have had a band aid on his face instead of one of them dead. How many dopes would kill someone for being pushed in an argument?
I have carried for 30 years but stand your ground type laws should be illegal. It should read if you are a civilian with a gun retreating is the first option unless the threat of loss of life is eminent and is mandatory out side of defending your home.

That's bullshit, if you want people to stay of your property, No Trespassing signs aren't enough, you actually need to securely fence the boundaries and use locks at access points to the property, if this is done, and someone comes onto your property, then yes, it is trespassing, if you don't do this, you are just some lunatic who put up a sign. Even then, you don't have the right to execute a trespasser unless your life is in imminent danger.

I think the issue is twofold.
These people have a misunderstanding of the law. They are under the impression they can kill anyone that comes onto their property. We are not talking about Einsteins here. More than likely they have come to this conclusion from crappy TV shows.
In addition to that, they are just itching to get a kill in. They are psychopaths. Their desire for a kill combined with their misunderstanding of the law sees them taking potshots at people for stepping on their Goddamn lawn. They wouldn't go out and kill someone in the street, they still see that as murder. They are probably religious and are scared of going to hell but when someone steps on their lawn, they see justification in the eyes of the good Lord and blow some poor fuckers brains out.
Those like them should be put down.

From the sounds of things, it doesn't sound like the salesman deserved to be shot, even if an argument broke out, which the shooter hasn't indicated is the case, their is no reason to shoot a man who is on your property, and not trespassing. Even under the LAW, people have the right to enter your property and knock on the door, if no-one answers they also have the right to leave via the driveway or the quickest route, regardless of any signs a whackjob has put up. It sounds like this man was just bordering on the edge for a long time, it wasn't the first time he had pulled a gun on someone, years before he was charged for pulling a gun on the meter reader and he often made complaints about the kiddies playing in front of the house.
I agree that the underlying issues need to be dealt with, the average citizen has little power or leverage, and essentially has little control over their own life, they basically have to TRUST their government, and if people are upset at their government, they can live in a perpetual state of annoyance. I think this is the biggest reason Americans love guns, it helps restore some of the control they feel they have sacrificed to live in a democratic country. Personally, I think everyone would be better off if they got more politically involved like the old days, learnt more about the process, interacted more with it and tried harder to change the system for the better. The alternative is to sit and stew in your own hatred and misery about how shit the whole system is and slowly cut yourself off from civilised society, like this man did.

Personally, I think everyone would be better off if they got more politically involved like the old days, learnt more about the process, interacted more with it and tried harder to change the system for the better. The alternative is to sit and stew in your own hatred and misery about how shit the whole system is and slowly cut yourself off from civilised society, like this man did.

You are incorrect. Citizens do not have "a right" to trespass on another person's legally recognized private property. Law enforcement and census workers have specific legal language that permits them limited access for limited periods of time in limited capacity to enter your property for specific reasons. After that they must have a Judicial warrant to be on private property or engage in investigation. This owner obviously overreacted, shot a man apparently unprovoked and then executed him on his driveway. The courts will see this clearly as it is...a murder investigation...not a "gun issue" or a "CHL" issue or a "private property" issue.

To make money from gullible paranoid whackjobs who don't understand the law. Citizens have a common law right to enter and leave your property. Society couldn't work otherwise. People if they really want others to not enter there property, need to securely fence the property and then securely lock access points to the property. Then include signage that states No trespassers without permission and then you have a better chance than not of a successful trespass prosecution. Trespass isn't always easy to prove, and their isn't a judge that is going to consider a door to door salesperson as a trespasser unless their is incriminating evidence indicating otherwise, and in this case, their isn't any.

I doubt it, the guy has a prior of pulling a gun on a meter reader and made regular complaints about children playing in front of the house, couple that with the fact neighbours and police seen him as the local crazy, things aren't looking good for this guy. Check out the case of Donny Aaron who was on a MMA show called "CAGED" and ran a MMA GYM. He was in a similar situation where he arrived at his fathers home to find a strange car in his driveway that was just leaving and he didn't recognise the man, so he followed the guy up the road, the man then pulled over and supposedly yelled at Donny when questioned about who he was and what he was doing at his fathers house, he then supposedly made threatening gestures at which point Donny shot him dead. Donny tried all the I was scared bullshit, it didn't work, he is currently serving 5 years for negligent homicide.

but Donny followed the dude up the road. He chased him. Kinda like that zimmerman thing, why he'll likely see time - no matter what the confrontation was, we know that the shooter went blocks after someone who wasn't a threat.
old man COULD HAVE claimed despite the past, this dude really did some at him for drugs and money and threaten him. it was on his property. bragging about it to cops was stupid. he maybe could have beat it.

Once when I was looking fo a house to do an install for Uverse I had to pull over to the curb in order to make phone calls and do some laptop work...a crazy guy whose house I pulled in front of hassled me over parking there while I did this. An AT&T lawyer had to come out with a cop and tell him that he didn't control the curb in front of his house.
Another time I had to access lines, terminals, and pedestals in a back yard to fix a buried drop for his rear neighbor...he objected and out came a company lawyer with a cop to tell him to take a hike, in a nice way of course...
Cell phone station site on a rural ranch near Brenham Texas...Time for maintenance...the window for cell site maintenance is between 11 pm and 4 am...rancher came out with rifle and held us at gunpoint...Lawyers and cops came and leaned on him.
