The Clinton Foundation accepted millions of dollars from seven foreign governments during Hillary Rodham Clinton’s tenure as secretary of state, including one donation that violated its ethics agreement with the Obama administration, foundation officials disclosed Wednesday.

Most of the contributions were possible because of exceptions written into the foundation’s 2008 agreement, which included limits on foreign-government donations.

The agreement, reached before Clinton’s nomination amid concerns that countries could use foundation donations to gain favor with a Clinton-led State Department, allowed governments that had previously donated money to continue making contributions at similar levels.

The new disclosures, provided in response to questions from The Washington Post, make clear that the 2008 agreement did not prohibit foreign countries with interests before the U.S. government from giving money to the charity closely linked to the secretary of state.

In one instance, foundation officials acknowledged they should have sought approval in 2010 from the State Department ethics office, as required by the agreement for new government donors, before accepting a $500,000 donation from the Algerian government.


The money was given to assist with earthquake relief in Haiti, the foundation said. At the time, Algeria, which has sought a closer relationship with Washington, was spending heavily to lobby the State Department on human rights issues.

While the foundation has disclosed foreign-government donors for years, it has not previously detailed the donations that were accepted during Clinton’s four-year stint at the State Department.

A foundation spokesman said Wednesday that the donations all went to fund the organization’s philanthropic work around the world. In some cases, the foundation said, foreign-government donations were part of multiyear grants that had been awarded before Clinton’s appointment to pay for particular charitable efforts, such as initiatives to lower the costs of HIV and AIDs drugs and curb greenhouse gas emissions.

“As with other global charities, we rely on the support of individuals, organizations, corporations and governments who have the shared goal of addressing critical global challenges in a meaningful way,” said the spokesman, Craig Minassian. “When anyone contributes to the Clinton Foundation, it goes towards foundation programs that help save lives.”

Some of the donations came from countries with complicated diplomatic, military and financial relationships with the U.S. government, including Kuwait, Qatar and Oman.

Other nations that donated included Australia, Norway and the Dominican Republic.

The foundation presents a unique political challenge for Clinton, and one that has already become a cause of concern among Democrats as she prepares to launch an almost-certain second bid for the presidency.


Rarely, if ever, has a potential commander in chief been so closely associated with an organization that has solicited financial support from foreign governments. Clinton formally joined the foundation in 2013 after leaving the State Department, and the organization was renamed the Bill, Hillary & Chelsea Clinton Foundation.

Foreign dollars

The Washington Post reported last week that foreign sources, including governments, made up a third of those who have given the foundation more than $1 million over time. The Post found that the foundation, begun by former president Bill Clinton, has raised nearly $2 billion since its creation in 2001.

Foreign governments and individuals are prohibited from giving money to U.S. political candidates, to prevent outside influence over national leaders. But the foundation has given donors a way to potentially gain favor with the Clintons outside the traditional political limits.

In a presidential campaign, Hillary Clinton would be likely to showcase her foreign-policy expertise, yet the foundation’s ongoing reliance on foreign governments’ support opens a potential line of attack for Republicans eager to question her independence as secretary of state and as a possible president.

The Wall Street Journal reported last week that the foundation had accepted new foreign-government money now that the 2008 agreement has lapsed.

A review of foundation disclosures shows that at least two foreign governments — Germany and the United Arab Emirates — began giving in 2013 after the funding restrictions lapsed when Clinton left the Obama administration. Some foreign governments that had been supporting the foundation before Clinton was appointed, such as Saudi Arabia, did not give while she was in office and have since resumed donating.

Foundation officials said last week that if Clinton runs, they will consider taking steps to address concerns over the role of foreign donors.

“We will continue to ensure the Foundation’s policies and practices regarding support from international partners are appropriate, just as we did when she served as Secretary of State,” the foundation said in a statement.

Foreign governments had been major donors to the foundation before President Obama nominated Clinton to become secretary of state in 2009. When the foundation released a list of its donors for the first time in 2008, as a result of the agreement with the Obama administration, it disclosed, for instance, that Saudi Arabia had given between $10 million and $25 million.

In some cases, the foundation said, governments that continued to donate while Clinton was at the State Department did so at lower levels than before her appointment.

Foundation officials said Wednesday that the ethics review process required under the 2008 agreement for new donors — or for existing foreign-government donors wishing to “materially increase” their support — was never initiated during Clinton’s State Department years.

But, they added, on one occasion, it should have been.

Algeria donation

The donation from Algeria for Haiti earthquake relief, they said, arrived without notice within days of the 2010 quake and was distributed as direct aid to assist in relief. Algeria has not donated to the foundation since, officials said.

The contribution coincided with a spike in the North African country’s lobbying visits to the State Department.

That year, Algeria spent $422,097 lobbying U.S. government officials on human rights issues and U.S.-Algerian relations, according to filings made under the Foreign Agents Registration Act. Data tracked by the Sunlight Foundation shows that while the Algerian government’s overall spending on lobbying in the United States remained steady, there was an increase in 2010 in State Department meetings held with lobbyists representing the country — with 12 visits to department officials that year, including some visits with top political appointees. In the years before and after, only a handful of State Department visits were recorded by Algeria lobbyists.

The country was a concern for Clinton and her agency.

A 2010 State Department report on human rights in Algeria noted that “principal human rights problems included restrictions on freedom of assembly and association” and cited reports of arbitrary killings, widespread corruption and a lack of transparency. Additionally, the report, issued in early 2011, discussed restrictions on labor and women’s rights.

“Algeria is one of those complicated countries that forces the United States to balance our interests and values,” Clinton wrote in her 2014 book, “Hard Choices.” She said that the country was an ally in combating terrorism but that “it also has a poor human rights record and a relatively closed economy.”

Clinton met with the president of Algeria during a 2012 visit to the country.

A State Department spokesman referred questions about the ethics-office reviews to the charity. Nick Merrill, a Clinton spokesman, declined to comment.

Besides Algeria, a number of the other countries that donated to the foundation during Clinton’s time at the State Department also lobbied the U.S. government during that time.

Qatar, for instance, spent more than $5.3 million on registered lobbyists while Clinton was secretary of state, according to the Sunlight Foundation. The country’s lobbyists were reported monitoring anti-terrorism activities and efforts to combat violence in Sudan’s Darfur region. Qatar has also come under criticism from some U.S. allies in the region that have accused it of supporting Hamas and other militant groups. Qatar has denied the allegations.

The 2008 agreement laid out that the new rules were intended to allow the Clinton Foundation to continue its “important philanthropic work around the world,” while also avoiding conflicts. It was signed by Bruce Lindsey, then the foundation’s chief executive, and Valerie Jarrett, who was co-chair of Obama’s transition team.

Jennifer Friedman, a White House spokeswoman, said in a statement that the agreement was signed “to avoid any appearance of conflict of interest” and “in keeping with the high standards we set for our nominees.” She said the deal went “above and beyond standard ethics requirements.”

Clinton Foundation fundraising, particularly from foreign governments, came up repeatedly at Clinton’s confirmation hearings for secretary of state.

Then-Sen. Richard G. Lugar (Ind.), who was the ranking Republican on the Senate Foreign Relations Committee, called the foundation “a unique complication that will have to be managed with great care and transparency” and called on the organization not to take any new foreign-government money while Clinton was serving as secretary of state.

“The Clinton Foundation exists as a temptation for any foreign entity or government that believes it could curry favor through a donation,” he said then. “It also sets up potential perception problems with any action taken by the secretary of state in relation to foreign givers or their countries.”

Lugar also called on the foundation to release more information about its donors, including how much each gives annually. (Since 2008, the foundation has released only how much donors have given cumulatively over time.) He said ethics officials should review donations from all foreign sources, not just governments, because of the close ties in many countries between wealthy interests and government officials.

Then-Sen. John F. Kerry (D-Mass.), the committee’s chairman at the time, called Lugar’s concerns a “legitimate question.” Kerry, who succeeded Clinton as secretary of state, suggested the potential at least for appearance problems if her official duties seemed to coincide with her husband’s fundraising efforts.

“If you are traveling to some country and you meet with the foreign leadership and a week later or two weeks later or three weeks later the president travels there and solicits a donation and they pledge to give at some point in the future but nobody knows, is there an appearance of a conflict?” Kerry asked.

At the hearing, Clinton said foreign governments donated to the foundation in part because the U.S. government had been slow to press for reductions in the cost of HIV and AIDs drugs. She said the agreement went beyond what was required by law.

“I will certainly do everything in my power to make sure that the good work of the foundation continues without there being any untoward effects on me and my service and be very conscious of any questions that are raised,” she said. “But I think that the way that this has been hammered out is as close as we can get to doing something that is so unprecedented that there is no formula for it, and we’ve tried to do the very best we could.”

Using personal email as a sole method of communication appears to break rules outlined by the National Archives and Records Administration. The government agency stipulates that personal email can only be used in "emergency situations," and when used, the emails "are captured and managed in accordance with agency record-keeping practices."

According to the Times report, Clinton's "aides took no actions to have her personal emails preserved on department servers at the time."

Nick Merrill, Clinton's spokesman, told CNN on Tuesday morning that, "like Secretaries of State before her, she used her own email account when engaging with any Department officials."


"For government business, she emailed them on their Department accounts, with every expectation they would be retained," he said in an emailed statement. "When the Department asked former Secretaries last year for help ensuring their emails were in fact retained, we immediately said yes."

Despite Clinton using a personal email address, all of her emails to official government accounts would be archived as received mail by the people on the other end of the email. Her communication with people not using government emails, however, would likely not be automatically kept.

But Merrill says her records were kept and turned over to State. "Both the letter and spirit of the rules permitted State Department officials to use non-government email, as long as appropriate records were preserved," Merrill concluded.

The senior state department official noted that previous secretaries of state had used personal emails to communicate with staff, including Secretary Colin Powell.

"As a result, our policies are continuing to evolve, including how those policies pertain to leadership officials," the official said. "And we all know that implementing changes in the federal government can be an onerous process."

The National Archives and Records Administration outlined new rules for federal agencies in 2013 that "reaffirm that agencies and agency employees must manage federal records appropriately and protect them from unauthorized removal from agency custody."

This bulletin stipulated that email messages are federal record.

Clinton's emails have been at the center of debate around the House's select committee investigating the Benghazi attack that resulted in four dead Americans. Republicans have demanded the State Department hand over emails from Clinton and other top officials. The committee has received some of those emails, but the State Department is still processing the request.

MARCH 3--The disclosure that Hillary Clinton used a non-governmental e-mail address while she was Secretary of State originally came courtesy of “Guccifer,” the Romanian hacker now serving time in a Bucharest prison for his online attacks against scores of public figures.

As TSG first reported in March 2013, “Guccifer” illegally accessed the AOL e-mail account of Sidney Blumenthal, who worked as a senior White House adviser to President Bill Clinton, and later became a senior adviser to Hillary Clinton’s 2008 presidential campaign.

When “Guccifer” (who was later identified as Marcel Lazar Lehel) breached Blumenthal’s account, he discovered an assortment of correspondence sent to Hillary Clinton at the e-mail address hdr22@clintonemail.com. The “clintonemail.com” domain was registered in 2009, shortly after her nomination to become Secretary of State.

While Blumenthal, a longtime Hillary Clinton confidant, used her private e-mail to send personal messages (like a get well note after she fell at home and suffered a concussion in December 2012), he also forwarded the Cabinet member a series of “Confidential” memos about foreign policy matters.

The “For: Hillary, From: Sid” memos, provided to TSG by “Guccifer,” address a wide range of topics in global flashpoints like Algeria, Turkey, Mali, and Libya. Blumenthal also provided Clinton with information about the European Central Bank, the Georgia elections, and German Chancellor Angela Merkel.

The memos to Clinton carried titles like “Comprehensive Intel Report on Libya,” and included all-cap warnings that, “THE FOLLOWING INFORMATION COMES FROM EXTREMELY SENSITIVE SOURCES AND SHOULD BE HANDLED WITH CARE.” Blumenthal has not held a public post since leaving his White House job in January 2001.

Each memo included a note on the sources of intelligence included in the document. One typical memo referred to “Sources with access to the highest levels of the Muslim Brotherhood in Egypt, the leadership of the Armed Forces, and Western Intelligence, diplomatic, and security services.”

A January 15, 2013 memo on “Libya internal government discussion,” reportedly relied on “Sources with direct access to the Libyan National Government.”

The memos offer no indication as to whether the intelligence gathered by Blumenthal was done at Clinton’s suggestion. Likewise, the hacked material does not include evidence of Clinton’s response to Blumenthal’s memos (which appear to have been prepared with input from Tyler Drumheller, a former Central Intelligence Agency official who ran covert operations in Europe).

While he rummaged through Blumenthal’s e-mail account, “Guccifer” sorted mail sent to Clinton’s hdr22@clintonemail.com address. He then took a screen grab showing more than two dozen e-mails sent over a two-month period ending in mid-February 2013.

Along with Valentine’s Day greetings and a mention of Clinton “walking in my neighborhood,” the subject lines of those Blumnethal e-mails include repeated references to “intel” shared with the Secretary of State. Other subject lines refer to “Q you raised” and “got your message a few days ago; I’m around whenev…” A February 17 e-mail included the subject line, “H: fyi, will continue to send relevant intel. March 3, 2015 Perhaps Hillary Rodham Clinton shouldn't run for president.

Maybe she should stay at the Bill, Hillary & Chelsea Clinton Foundation, where the former secretary of State could continue her life's work of building stronger economies, health care systems, and families. Give paid speeches. Write best-selling books. Spend time with Charlotte, her beloved granddaughter.

Because she doesn't seem ready for 2016. Like a blast of wintry air in July, the worst of 1990s-style politics is intruding on what needs to be a new millennium campaign: Transparent, inspirational, innovative, and beyond ethical reproach.

Two weeks ago, we learned that the Clinton Foundation accepted contributions from foreign countries. Assurances from the Obama administration and Clinton aides that no donations were made during her tenure as secretary of State were proven false.

I called the actions sleazy and stupid. Sleazy because any fair-minded person would suspect the foreign countries of trying to buy Clinton's influence. Stupid because the affair plays into a decades-old knock on the Clintons: They'll cut any corner for campaign cash. In the 1990s, Bill Clinton and his top aides used the White House as a tool to court and reward big donors.

Now The New York Times is reporting that Clinton used a personal email account to conduct government business as secretary of State, an apparent violation of federal requirements that her records be retained.

Exposed by a House committee investigating the Benghazi Consulate attack, Clinton brazenly dug in her heels. Advisers reviewed tens of thousands of pages of her personal email and decided which ones to release: Just 55,000 emails were given to the State Department.

Those are our emails, not hers. What is she hiding?

Transparency isn't the only issue. Clinton exposed confidential and potentially dangerous information to a nonsecure, commercial email system. She gave Chinese spies a better shot at reading her emails than U.S. taxpayers.

The Times quoted a former director of litigation at the National Archives and Records Administration who said there is only one scenario under which it's proper for Cabinet-level officials to use private rather than government email: "nuclear winter."

The rest of us are required to play by the rules. Why does Clinton think she's above them?

Clinton aides quickly funneled through friendly media channels examples of Republicans who used private emails, such as former Secretary of State Colin Powell and former Florida Gov. Jeb Bush. Powell operated under a different set of federal rules than Clinton. Bush was not a federal employee (yes, he should release all of his Florida emails, and not just self-selected documents).

This is another Clinton trope: Deflect attention from their wrongdoing by pointing fingers at others—as if two wrongs make a right and they had never promised to set a higher standard.

Clinton spokesman Nick Merrill told The Times that she has been complying with the "letter and spirit of the rules." No, she hasn't. But here again is a reminder of the 1990s: When cornered, the Clintons denied facts and demonized detractors.

The most obvious example is Bill Clinton's lying about his affair with a White House intern. "It depends on what the meaning of the word 'is' is," he said. Less remembered is an independent counsel's finding of "substantial evidence" that then-first lady Hillary Rodham Clinton lied under oath about her role in the 1993 White House travel office firings.

Many senior Democrats are angry, though not yet mad enough to publicly confront the Clintons. "This story has legs as long as the election," said a Democrat who has worked on Capitol Hill and as a presidential campaign manager. "She will be tripping over this crap until the cows come home."

Another presidential campaign veteran who held a Cabinet-level post in Bill Clinton's White House fretted out loud about the fact that the former first lady is breezing toward the Democratic nomination.

"We can't have a coronation when she's handing Republicans an inquisition," the Democrat said.

Put me in the same category. Like these two Democrats, I've known both Clintons for years. I admire their intelligence and passion and empathy. They've been good to my family. I've actually long thought that she has the potential to be a better president than he was.

But now I wonder whether there is a part of her that doesn't want to be president. She seems to be placing obstacles in her lane before the race begins. Is this sabotage or something else?

We've had sleazy and stupid—and, now, with these emails, suspicious. If she runs, are we going to have a full Seven Dwarfs?

Seedy.

Sanctimonious.

Self-important.

Slick.   

My concern is that Clinton does not see this controversy as a personal failing. Rather, she sees it as a political problem that can be fixed with more polls, more money, and more attacks. In a Politico story about the push to assemble a presidential campaign staff, a former senior Clinton aide said, "We have had our head up our ass. This stuff isn't going to kill us, but it puts us behind the eight ball."

Due respect, Clinton's problem isn't a lack of staff. It's a lack of shame about money, personal accountability, and transparency.

The White House today repeatedly declined to say whether it was appropriate for Hillary Clinton to use solely her personal email account while serving as secretary of state.

"Very specific guidance has been given to agencies all across the government, which is specifically that employees in the Obama administration should use their official e-mail accounts when they're conducting official government business," White House Press Secretary Josh Earnest told reporters at a livelier-than-usual press briefing.

In an exchange with ABC News, Earnest would not say whether or not Clinton violated that policy or broke the law by using only her personal account.

"I was not in a position to review Secretary Clinton's personal email. That was the responsibility of Secretary Clinton and her team," Earnest said. "They say that they turned over thousands of pages and thousands of emails ... and that is entirely consistent with the requirements of the Federal Records Act."

Earnest added that he could not say whether the White House was aware that Clinton was not conducting her business on an official email account.

"When there are situations in which personal email is used to conduct official U.S. business, those emails are official government records and should be turned over to the State Department, which is what I understand Secretary Clinton's team has done," he said.

Earnest said he did not know if any other Cabinet secretaries are using only their personal email accounts and referred reporters to the individual agencies.

On January 13, 2009, Hillary Clinton attended her first confirmation hearing as a Secretary of State nominee. The same day, with Bush officials still under fire for using private email accounts to circumvent public records laws, someone registered Clintonemail.com, a domain that now appears to be at the center of a scandal. "Mrs. Clinton did not have a government email address during her four-year tenure at the State Department," The New York Times reported in a story published late Monday. "Her aides took no actions to have her personal emails preserved on department servers at the time, as required by the Federal Records Act."

This was willful, flagrant disregard for public records rules.

What made her confident that she would get away with it?

Many of those emails "would not have been located in response to Freedom of Information Act requests, subpoenas or other document searches," Politico reported.

These revelations reflect poorly on Clinton and her excessively loyal aides. And they suggest that many in the Obama Administration, where her behavior was widely known to be verboten, did nothing upon getting official business emailed to them from Clinton's personal account. She was allowed to break the rules for years, much as Karl Rove was permitted to do so by his bosses in the Bush Administration.

What made her confident that she would get away with it? Perhaps she figured that if Sandy Berger could pilfer the National Archives and escape with probation, she could surely hide a few years worth of emails without any repercussions.

For those who've forgotten that jaw-dropping story:


According to reports from the Inspector General of the National Archives and the staff of the House of Representatives' Government Operations Committee, Mr. Berger, while acting as former President Clinton's designated representative to the commission investigating the attacks of September 11, 2001, illegally took confidential documents from the Archives on more than one occasion. He folded documents in his clothes, snuck them out of the Archives building, and stashed them under a construction trailer nearby until he could return, retrieve them, and later cut them up. After he was caught, he lied to the investigators and tried to shift blame to Archive employees.

Contrary to his initial denials and later excuses, Berger clearly intended from the outset to remove sensitive material from the Archives. He used the pretext of making and receiving private phone calls to get time alone with confidential material, although rules governing access dictated that someone from the Archives staff must be present. He took bathroom breaks every half-hour to provide further opportunity to remove and conceal documents... What could have been important enough for Berger to take the risks he did?

Or perhaps she was thinking farther back to the time when paperwork subpoenaed during the Whitewater investigation mysteriously disappeared for two years:


After nearly two years of searches and subpoenas, the White House said this evening that it had unexpectedly discovered copies of missing documents from Hillary Rodham Clinton's law firm that describe her work for a failing savings and loan association in the 1980's. Federal and Congressional investigators have issued subpoenas for the documents since 1994, and the White House has said it did not have them. The originals disappeared from the Rose Law Firm, in which Mrs. Clinton was a partner, shortly before Mr. Clinton took office.

Where were the records finally found? In the third-floor private residence at the White House.

Investigators have also been trying to determine whether Mrs. Clinton sought to block Justice Department lawyers from examining files in Mr. Foster's office in the days after his death. White House aides searched the office and brought files to the Clintons' private residence before allowing investigators to look at them.

There was also last year's delay in releasing papers that the public was entitled to see: 


A trove of Clinton White House records long processed for release remains hidden from public view at the Clinton Presidential Library in Little Rock — even though the legal basis initially used to withhold them expired more than a year ago. The papers contain confidential advice given to or sought by President Bill Clinton, including communications with then-first lady Hillary Clinton, and records about people considered for appointments to federal office.

One thing Hillary Clinton may have been hiding with her private email address was noted by John Cook a couple years ago when Sidney Blumenthal's email got hacked:


Blumenthal, a fierce Clinton partisan in the 1990s, was the orchestrator of a subterranean smear campaign against Obama during the Democratic primary and was specifically spiked by the White House as a potential staffer for Clinton when she became Secretary of State. And he was sending notes to Clinton at a private, non-governmental email address. Did Obama know Clinton was consulting with the guy who tried to kneecap him?

Blumenthal has long been a fomenter of dark whisper campaigns against Clinton enemies. He was famously accused in the 1990s by his former friend Christopher Hitchens of spreading the lie that Monica Lewinsky was a mere "stalker" who shouldn't be taken seriously. More recently, as Gawker reported, he was busy compiling scurrilous opposition research dossiers about Barack Obama's purported ties to unwholesome black preachers that ended up in Fox News chief Roger Ailes' inbox. That sort of behavior is, presumably, why the Obama White House put the kibosh on Clinton's attempt to hire Blumenthal at the State Department in 2009. But that apparently didn't stop Clinton from using him in an unofficial capacity.

There's no telling what other official or semi-official business Clinton conducted through the private email account that she seems to have begun using just before taking her cabinet job. The emails she has turned over were all chosen by Clinton and her aides, giving her an opportunity to hide whatever she wants hidden. But the episode already confirms what attentive observers have long known: If the Clintons return to the White House, we can expect more suspicious secrets, stonewalling, and opaqueness, much as we've seen in the past. Voters have been given ample warning.

 Hillary Clinton  hasn’t even begun her expected presidential candidacy, but already Americans are being reminded of the political entertainment they can expect. To wit, the normal rules of government ethics and transparency apply to everyone except Bill and Hillary.

Last week we learned that the Clinton Foundation had accepted donations from foreign governments despite having made a public display of not doing so. The Family Clinton had agreed not to accept such donations while Mrs. Clinton was serving as Secretary of State, with rare exceptions approved by State’s ethics shop.

But, lo, the foundation quietly began accepting such gifts from the likes of Qatar and Algeria after she left the State Department—though everyone in the world knew she was likely to run for President in 2016. The foundation didn’t announce the donations, which our Journal colleagues discovered in a search of the foundation’s online data base.

Then Monday the  New York Times  reported that Mrs. Clinton used a personal email account for official business as Secretary of State, despite a federal transparency law that requires officials to maintain emails on government servers. A former long-time litigation director at the National Archives & Records Administration told the paper he could “recall no instance” when a high-ranking official had solely used a personal email address for government business.

Clinton spokesman Nick Merrill says this is no big deal because Team Clinton is following “the letter and the spirit of rules” and has turned over to State some 55,000 emails in response to a formal request. Put another way, Mrs. Clinton is controlling which emails are divulged, and everyone should trust her judgment. We doubt Congress’s Benghazi investigators will be reassured. You also have to wonder about the judgment of America’s top diplomat exposing her official business on personal email to cyber hacking from China or Iran.

The real story here is that none of this is a surprise. This is how the Clintons roll. They’re a political version of the old Peanuts cartoon character who was always surrounded by a cloud of dirt. Ethical shortcuts and controversies are standard operating procedure. A brief 1990s roll call: The Riadys, Johnny Chung, Travelgate, the vanishing Rose billing records, a killing in cattle futures, the Marc Rich pardon.

The Clintons and Democrats want Americans to forget all of that. But as the email and foundation discoveries show, the Clintons haven’t changed. They still think they can do what they please and get away with it.

WASHINGTON –  The computer server that transmitted and received Hillary Clinton's emails -- on a private account she used exclusively for official business when she was secretary of state -- traced back to an Internet service registered to her family's home in Chappaqua, New York, according to Internet records reviewed by The Associated Press.

The highly unusual practice of a Cabinet-level official physically running her own email would have given Clinton, the presumptive Democratic presidential candidate, impressive control over limiting access to her message archives. It also would distinguish Clinton's secretive email practices as far more sophisticated than some politicians, including Mitt Romney and Sarah Palin, who were caught conducting official business using free email services operated by Microsoft Corp. and Yahoo Inc.










Most Internet users rely on professional outside companies, such as Google Inc. or their own employers, for the behind-the-scenes complexities of managing their email communications. Government employees generally use servers run by federal agencies where they work.

In most cases, individuals who operate their own email servers are technical experts or users so concerned about issues of privacy and surveillance they take matters into their own hands.

Clinton has not described her motivation for using a private email account -- hdr22(at)clintonemail.com, which traced back to her own private email server registered under an apparent pseudonym -- for official State Department business.

Operating her own server would have afforded Clinton additional legal opportunities to block government or private subpoenas in criminal, administrative or civil cases because her lawyers could object in court before being forced to turn over any emails. And since the Secret Service was guarding Clinton's home, an email server there would have been well protected from theft or a physical hacking.

But homebrew email servers are generally not as reliable, secure from hackers or protected from fires or floods as those in commercial data centers. Those professional facilities provide monitoring for viruses or hacking attempts, regulated temperatures, off-site backups, generators in case of power outages, fire-suppression systems and redundant communications lines.

A spokesman for Clinton did not respond to requests seeking comment from the AP on Tuesday. Clinton ignored the issue during a speech Tuesday night at the 30th anniversary gala of EMILY's List, which works to elect Democratic women who support abortion rights.

It was unclear whom Clinton hired to set up or maintain her private email server, which the AP traced to a mysterious identity, Eric Hoteham. That name does not appear in public records databases, campaign contribution records or Internet background searches. Hoteham was listed as the customer at Clinton's $1.7 million home on Old House Lane in Chappaqua in records registering the Internet address for her email server since August 2010.

In November 2012, without explanation, Clinton's private email account was reconfigured to use Google's servers as a backup in case her own personal email server failed, according to Internet records. That is significant because Clinton publicly supported Google's accusations in June 2011 that China's government had tried to break into the Google mail accounts of senior U.S. government officials. It was one of the first instances of a major American corporation openly accusing a foreign government of hacking.

Then, in July 2013, five months after she resigned as secretary of state, Clinton's private email server was reconfigured again to use a Denver-based commercial email provider, MX Logic, which is now owned by McAfee Inc., a top Internet security company.

The New York Times reported Monday that Clinton exclusively used a personal email account it did not specify to conduct State Department business. The disclosure raised questions about whether she took actions to preserve copies of her old work-related emails, as required by the Federal Records Act. A Clinton spokesman, Nick Merrill, told the newspaper that Clinton complied with the letter and spirit of the law because her advisers reviewed tens of thousands of pages of her personal emails to decide which ones to turn over to the State Department after the agency asked for them.

In theory but not in practice, Clinton's official emails would be accessible to anyone who requested copies under the U.S. Freedom of Information Act. Under the law, citizens and foreigners can compel the government to turn over copies of federal records for zero or little cost. Since Clinton effectively retained control over emails in her private account even after she resigned in 2013, the government would have to negotiate with Clinton to turn over messages it can't already retrieve from the inboxes of federal employees she emailed.

The AP has waited more than a year under the open records law for the State Department to turn over some emails covering Clinton's tenure as the nation's top diplomat, although the agency has never suggested that it didn't possess all her emails.

Clinton's private email account surfaced publicly in March 2013 after a convicted Romanian hacker known as Guccifer published emails stolen from former White House adviser Sidney Blumenthal. The Internet domain was registered around the time of her secretary of state nomination.

Rep. Trey Gowdy, R-S.C., chairman of the special House committee investigating the Benghazi attacks, said the committee learned last summer -- when agency documents were turned over to the committee -- that Clinton had used a private email account while secretary of state. More recently the committee learned that she used private email accounts exclusively and had more than one, Gowdy said.

President Barack Obama signed a bill last year that bans the use of private email accounts by government officials unless they retain copies of messages in their official account or forward copies to their government accounts within 20 days. The bill did not become law until more than one year after Clinton left the State Department.

The law requiring archiving of govt e-mails went into full effect in 2009. HRC knowingly violated the law from the moment she took office at State. All of the nation's top diplomat's e-mails were then run through a privately owned service, on servers far less secure than the State Dept's. In his latest piece, National Review’s Charles Cooke related a choice exchange he had with a former Clinton White House staffer who attempted to defend Hillary Clinton’s role in this latest scandal involving her determination to avoid using an official and secure email address, as is mandated by law.

“It’s ‘worth remembering,’ a former Clinton administration staffer assured me quickly on Twitter, ‘that Hillary didn’t have email until she was in her forties. She was clueless.’” Cooke wrote. “‘I just mean,’ he added, desperately, that “she’s no dummy — except possibly with computers — where she kinda is.’”

So the Democratic Party’s anointed 2016 nominee who, we are assured, possesses the intellect and the acumen of a transformative political figure born to shatter glass ceilings devolves into timid and irrational Neanderthal when confronted by technological marvels like electronic mail? It’s not especially convincing, but at least it is a defense.

As reporters go digging into this most recent Clinton controversy, however, it turns out that that the former secretary of state may have possessed a touch more technological prowess than her supporters initially led the public to believe. At least, those around her were savvy in their pursuit of a parallel email system that was apparently designed to evade federal oversight.

“Hillary Clinton created her own private email system that she exclusively used as secretary of state, ignoring ‘very specific guidance’ from the White House by not even creating, let alone using, a government email account,” The Daily Beast revealed on Wednesday citing a bombshell Associated Press investigation.

America’s gentle but technologically enfeebled grandmother-in-chief was, in fact, operating email servers and an internet domain that were run out of her family home in Chappaqua, New York. “The highly unusual practice of a Cabinet-level official physically running her own email would have given Clinton, the presumptive Democratic presidential candidate, impressive control over limiting access to her message archives,” The AP reported. “It also would distinguish Clinton’s secretive email practices as far more sophisticated than some politicians, including Mitt Romney and Sarah Palin, who were caught conducting official business using free email services operated by Microsoft Corp. and Yahoo Inc.”

This little trick was not only evasive and quite probably illegal, but also unique to Clinton. It is going to prove increasingly difficult for the former secretary’s defenders to back her behavior while preserving their own integrity. When figures like Karl Rove and Sarah Palin ran afoul of the press as a result of lost emails or the use of private accounts to conduct official business, the reaction from the political class was anything but muted.


Operating her own server would have afforded Clinton additional legal opportunities to block government or private subpoenas in criminal, administrative or civil cases because her lawyers could object in court before being forced to turn over any emails. And since the Secret Service was guarding Clinton’s home, an email server there would have been well protected from theft or a physical hacking.

But homemade email servers are generally not as reliable, secure from hackers or protected from fires or floods as those in commercial data centers. Those professional facilities provide monitoring for viruses or hacking attempts, regulated temperatures, off-site backups, generators in case of power outages, fire-suppression systems and redundant communications lines.

It was unclear whom Clinton hired to set up or maintain her private email server, which the AP traced to a mysterious identity, Eric Hoteham. That name does not appear in public records databases, campaign contribution records or Internet background searches. Hoteham was listed as the customer at Clinton’s $1.7 million home on Old House Lane in Chappaqua in records registering the Internet address for her email server since August 2010.

Hillary Clinton had to know that this would someday come to light. She must have been aware that her scandalous behavior would one day jeopardize her political future and, as a result, her political party’s viability. Moreover, as the AP reported, her use of unsecure email servers might have endangered American diplomatic security had she ever communicated anything of a sensitive nature via email, though we may never know if she did for sure. And the most charitable claim one could make in Clinton’s defense is that all of this was done merely to preserve Clinton’s sense of privilege and self-entitlement.

Relax, the Clinton camp assures the public. We have all of the former secretary’s emails on file, and they can be provided at your request. According to The New York Times, that’s simply not true.


In 2012, congressional investigators asked the State Department for a wide range of documents related to the attack on the United States diplomatic compound in Benghazi, Libya. The department eventually responded, furnishing House committees with thousands of documents.

But it turns out that that was not everything.

The State Department had not searched the email account of former Secretary of State Hillary Rodham Clinton because she had maintained a private account, which shielded it from such searches, department officials acknowledged on Tuesday.

With the news growing rapidly worse for Team Clinton, Media Matters for America founder and former pro-Hillary Super PAC board member David Brock appeared on MSNBC to douse the flames of controversy lapping at Clinton’s heels. In that effort, Brock spent most of his time attacking the “sloppy” reporting at The New York Times, the credulity of Times’ reporters, and even the hosts of the program of which he was a guest.



This is a scandal, and the Clinton camp’s determination to dig in and avoid contrition at all costs is only making it worse. What makes this truly damaging for Clinton is that the media does not have to translate this controversy to the public. Every American understands plainly what conditions might lead someone to conduct official business on a private email account that is free from oversight, and none of them are virtuous. The public understands intuitively the ramifications of this disreputable behavior, and Clinton’s defenders are only throwing gasoline on the fire by attacking the integrity of those responsible for investigating this episode.

A House investigative committee is preparing to send out subpoenas later today to gather a deeper look into former Secretary of State Hillary Clinton’s nearly-exclusive use of personal e-mails to do her official business as the government’s top diplomat, according to people familiar with the probe.

The House Select Committee on Benghazi , which first discovered Clinton’s use of a personal e-mail based on a home server in its inquiry into the fatal terrorist attack on the State Department’s Benghazi consulate, is asking for all e-mails relating to the attack from all Clintonemail.com accounts and any other staff members’ personal accounts.

The subpoenas are expected to go out to the State Department later today. The move escalates the panel’s conflict with Clinton, and could complicate her expected run for president.

Numerous federal records and legal experts have questioned Clinton’s use of a personal e-mail for government business and whether it violated the Federal Records Act. Her practice was first reported by the New York Times on Monday.

Committee staff learned of the Clintonemail.com domain name in reviewing records they obtained this summer, according to one person familiar with deliberations. Staffers later discovered evidence suggesting that “at least a small group of Clinton staffers” were using personal e-mails,to conduct government work and correspond with the secretary, the person said.

The White House on Tuesday said Clinton appeared to have operated in violation of “very specific guidance” from the West Wing that members of the Obama administration use government e-mail accounts to carry out official business.

The House Oversight and Government Reform Committee said it would also look into what its chairman, Rep. Jason Chaffetz (R-Utah), said was a frequent violation of the law. Chaffetz said his inquiry would look at whether Clinton viewed classified or sensitive matieral on a personal account.

“Do you really believe that the secretary of state never reviewed classified information on her e-mail?” Chaffetz said.

A State Department spokeswoman said this week there was no indication Clinton used her private e-mail for classified information.

Its strictly against regs according to government rules. Private email can be easily hacked and you can imagin the rest. The real thing here is what I've been saying all along...the idea of hil is better then hil her self. She's just unlikeable. WASHINGTON — The revelation that Hillary Rodham Clinton conducted government business entirely on a private email account as secretary of state has blindsided the Democratic establishment.

It was a bracing reminder of the risks entailed in the party’s all-but-all-in bet on Mrs. Clinton so early in the presidential nominating process. And it left Democrats contemplating the prospect of yet another long cycle of dramatic Clinton flare-ups — the type that President Obama obliquely campaigned against in 2008.

The report on Mrs. Clinton’s emails, published by The New York Times late Monday night, left many Democrats privately expressing wonder as late as Wednesday morning that Mrs. Clinton and her aides had not anticipated the political problems that this could create.

In a testament to Mrs. Clinton’s political strength — and underscoring the scarcity of other potential White House hopefuls — senior Democrats spoke in her defense without fully explaining why she had avoided using a government account during her four-year tenure in the Obama administration.

“I don’t think there’s any ill intent in this,” Senator Dianne Feinstein, Democrat of California, said Tuesday. “I just don’t know how the State Department functions with regard to this.”

An array of leading Democrats echoed Ms. Feinstein’s view, defending Mrs. Clinton broadly while sidestepping questions about transparency and ethics. Some even went to great lengths to dismiss the report.

“People have different ways of communicating,” said Senator Benjamin L. Cardin, Democrat of Maryland. “I have a granddaughter who does nothing but text. You’ll never find a letter written with her. So everybody’s different.”

The chorus of confident, if less-than-fully briefed, supporters was perhaps the most vivid illustration yet that, unlike when Mrs. Clinton ran eight years ago, Democratic officials are overwhelmingly supportive of her, invested in her success and unwilling to offer even mild public criticism.

Indeed, even from the safety of anonymity, Democrats quickly shifted on Tuesday from the basic facts about Mrs. Clinton’s email practices to grousing over the initial lack of an aggressive response by her advisers and her allies.

That seemingly flat-footed reaction, several Democratic strategists said, illustrated how Mrs. Clinton’s decision to delay a formal start to her campaign had left her vulnerable. She has waited until recent weeks to begin hiring staff and creating the sort of sprawling infrastructure a presidential bid demands. She also only recently hired researchers to start reviewing her paper trail from the State Department, the Clinton Foundation and the past two years as a private citizen, to identify potential trouble spots that might need to be addressed later in the campaign.

The allied groups that are devoted to defending her, meanwhile, are mostly constrained to following her lead. Mrs. Clinton’s aides did not alert officials with the Democratic National Committee or outside liberal groups such as American Bridge that the Times article was coming, according to Democrats briefed on the matter, leaving her would-be defenders scrambling and hastily searching for similar transgressions by Republicans that could at least muddy the issue.

The episode also crystallized the difficulty Democrats are experiencing at a time when Mr. Obama is still the head of the party, but Mrs. Clinton, an undeclared candidate with no campaign apparatus, is the one being scrutinized by the news media and attacked by Republicans.

“Our nominee is not going to be named Barack Obama, and we better get prepared for that and do it fast,” said Bill Carrick, a veteran Democratic strategist. Part of the problem, Mr. Carrick noted, is that Mr. Obama created a parallel political infrastructure outside the Democratic National Committee.

“That’s fine when you have a president in the White House to respond to things on daily basis,” he said. “But that’s not going to work in terms of the campaign coming up. And it has started — there’s no way of getting around that. The Republicans are out there trash-talking her.”

Edward G. Rendell, a former Pennsylvania governor and chairman of the Democratic National Committee during the 2000 election, said Mrs. Clinton needed a more robust political organization to defend her.

“I assume when there’s a campaign, there will be a better effort,” he said. “I assume this will get rectified.”

Some Democrats expressed confidence that the email issue would eventually melt away like the season’s snow. It is “a chattering class issue that means nothing for her long-term prospects to win the election,” said Steve Elmendorf, a longtime Washington strategist and lobbyist.

Still, several Democratic operatives, including some former aides to Mr. Obama, privately expressed amazement about what they called an unforced error — one that played into Republican depictions of the Clintons as secretive.

They also noted that the report on Mrs. Clinton’s emails surfaced because of a congressional investigation of an issue that has long dogged Mrs. Clinton: the deaths of four Americans, including the United States ambassador to Libya, in Benghazi on Sept. 11, 2012.

New interest in Mrs. Clinton’s email practices, Democrats warned, could prompt congressional Republicans to expand their inquiries into Mrs. Clinton’s entire tenure as the nation’s chief diplomat.

Indeed, Representative Trey Gowdy, Republican of South Carolina and chairman of a special panel investigating the response to the Benghazi attack, indicated at a news conference on Tuesday that he might call Mrs. Clinton to testify. And Representative Jason Chaffetz, a Utah Republican who is chairman of the House Oversight and Government Reform Committee, said his group would work with Mr. Gowdy’s panel “to further explore Hillary Clinton’s use of personal emails while at the State Department.”

Associated Press Threatens Legal Action Over Request for Hillary Clinton Information

The Associated Press said Wednesday that it was considering legal action over unfulfilled Freedom of Information Act requests for government documents covering Hillary Rodham Clinton’s tenure as secretary of state.

In its requests, the AP asked for her full schedules and calendars and for details on the State Department’s decision to grant a special position to a longtime Clinton aide, Huma Abedin, among other documents. The oldest request, the news organization said, was made in March 2010.

“We believe it’s critically important that government officials and agencies be held accountable to the voters,” said AP’s general counsel, Karen Kaiser. “In this instance, we’ve exhausted our administrative remedies in pursuit of important documents and are considering legal action.”

The statement comes after the revelation this week that Mrs. Clinton used a personal email account for her government business, an unusual practice that some have suggested insulated her correspondence from the eyes of investigators and the public.

In 2012, U.S. Ambassador to Kenya Scott Gration abruptly stepped down from his post. According to a Foreign Policy report by Josh Rogin (now a reporter for Bloomberg), Gration was the subject of a whithering evaluation from the State Department:


The impending release of a highly critical report by the State Department’s Inspector General’s office prompted the sudden resignation Friday of U.S. Ambassador to Kenya Scott Gration, according to administration and congressional sources.

The report was described to The Cable by multiple people briefed on its contents as one of the worst reviews of an ambassador’s performance written by the IG’s staff in several years.

While Gration was fired for a myriad of reasons, one passage of the damning report leaps out in light of recent events:



Very soon after the Ambassador’s arrival in May 2011, he broadcast his lack of confidence in the information management staff. Because the information management office could not change the Department’s policy for handling Sensitive But Unclassified material, he assumed charge of the mission’s information management operations. He ordered a commercial Internet connection installed in his embassy office bathroom so he could work there on a laptop not connected to the Department email system. He drafted and distributed a mission policy authorizing himself and other mission personnel to use commercial email for daily communication of official government business. During the inspection, the Ambassador continued to use commercial email for official government business. The Department email system provides automatic security, record-keeping, and backup functions as required. The Ambassador’s requirements for use of commercial email in the office and his flouting of direct instructions to adhere to Department policy have placed the information management staff in a conundrum: balancing the desire to be responsive to their mission leader and the need to adhere to Department regulations and government information security standards.

In other words, State Department policy was very clear. Using a private email outside the State Department's secure system was completely unacceptable. If this applied to ambassadors, one would think it was sensible policy for the Secretary of State as well.

The House Select Committee on Benghazi has subpoenaed former Secretary of State Hillary Clinton for all communications related to its investigation.

The committee said in a statement:


“The Select Committee on Benghazi today issued subpoenas for all communications of former Secretary of State Hillary Clinton related to Libya and to the State Department for other individuals who have information pertinent to the investigation. The Committee also has issued preservation letters to internet firms informing them of their legal obligation to protect all relevant documents.”

Earlier this evening, Greta Van Susteren spoke to select committee chairman Trey Gowdy on whether he would issue subpoenas – and then he did.

“We’re gonna gain access to them, or do our best to gain access to them,” he said of Clinton’s emails.

Gowdy said that many lawmakers have work and private email accounts, but none of them have “just private email.”

Gowdy said that the State Department had to ask Clinton for its public records back.

“If she was doing it the right way […] why did we have to ask for the records back?” he asked.

she broke the law.   I see Jeb did this as well... critizied hilary for it, but 500,000 of his 3,000,000 emails as governor were on a private account also.  NEITHER of them should be eligible for president.

The scandals surrounding Hillary Clinton are the surface tremors of a far greater disturbance. To many, Hillary embodies a stern but kind, hard-working, wronged wife and mother. To others she is a consummately corrupt politician who has used her image and connections to reach the very top of American politics. Hillary’s underlying character must be understood if we are to gauge the veracity of the scandals and allegations that haunt her.

To that end, this article will explore the findings of Wikileaks, her voting record, her presidential campaign ads, the sordid history of donations to her election campaigns, her connections to the health insurance industry and Zionism, the Benghazi scandal, and her secretive email practices. As a European observer who has more in common with the Democrats, it is hoped that this largely condemnatory article will be an objective investigation of the real Hillary Clinton.

Hillary stonewalled and has now outsourced her problem to attack-dog subordinates and Democratic stalwarts who, she believes, have Hillary—or no one—for 2016.

I guess the message is “I’m lying, so what?”

Remember Richard Nixon’s vain attempt to keep Watergate tapes because he alone had determined that some were only private in nature and did not relate to government business or subpoenas—and the subsequent reaction to his “gaps.” That is Hillary Clinton’s absurd line of something like “secretary of state privilege,” and thus her press conference could only end in disaster.

After all the obfuscation, the only thing that one can take away from this embarrassing performance is that Hillary Clinton envisioned her own personal server for just such contingencies: to trash a large percentage of her incoming and outgoing e-mails after becoming the sole arbitrator of what constituted her own, and her government’s, business, and thus the preserver or destroyer of all her communications.

Some depressing details: Hillary used a U.N. forum as a prop to address a private scandal, largely because she assumed the press pool might be a little different and she could suggest that the e-mail scandal was incidental rather than essential to her more important global messaging.

But in typical Clinton fashion that gambit proved counter-productive: She inappropriately used the U.N. prop, and the reporters were not necessarily D.C. pets, as she learned when she abruptly cut off their questions. Then she reviewed her feminist credentials, omitting her own role in gender-pay inequalities, the misogynist nature of the benefactors to her foundation, and, of course, her husband’s recent troubles in regard to feminist issues.

Then she accused Republican senators of either wishing to help the Iranians or to undermine their commander-in-chief. That was a warm-up to her defiant replies:

1) She confuses device and account: Many people have one device and two e-mail accounts. In the private sphere, one does not need two devices to have two different e-mail accounts. Teenagers can set up two in 30 seconds. If not, Hillary should make the case that one cannot do that with government accounts and that the problem affected her alone and not others of similar status.

When her fable of the one phone/two phone dilemma is reviewed, her veracity will be again questioned, as it will when we learn she still probably used multiple phones like most D.C. grandees do.

2) She seems to think that her dilemma was unique and no other high government official faced the same private/public quandary that required her special solution; if she were correct, then almost any other cabinet member would have had only a personal account with his own private server to conduct all government business. No one apparently has ever had a BlackBerry with a separate government and a private account without a private server.

3) There will be no third-party adjudicator to determine which of her e-mails were private and which non-private, and those she determined were private are now apparently already destroyed.

4) She confused, again deliberately, State Department rules. When Hillary refers to “my practice was” that is not the same as the law demands: She seems to think not turning over all her e-mails on her sole account when she left office was okay because the State Department and / or the government in theory could always spend thousands of hours to hunt down all the recipients of her supposedly purely government e-mails. Try that with the government, as for example not paying your taxes on April 15 on the theory that you can always pay when and if the government hunts you down and comes after you and fills out your 1099 for you.

Her final message? It’s over; get over it; and the messages are destroyed even if you had wanted to have determined that I lied about the private/public divide. What are you going to do—hound the likely next president of the United States?

What’s next? We are back to 1998–99 where the law does not apply to the Clintons; and if it did, it pales in importance to their progressive efforts on our behalf; and if you doubt it, there are plenty of hirelings who can make life miserable for you right-wing conspiracists and disbelievers.

WASHINGTON (AP) — How Hillary Rodham Clinton’s statements about her exclusive use of private email instead of a government account as secretary of state compare with the known facts:

CLINTON: “Others had done it.”

THE FACTS: Although email practices varied among her predecessors, Clinton is the only secretary of state known to have conducted all official unclassified government business on a private email address. Years earlier, when emailing was not the ubiquitous practice it is now among high officials, Colin Powell used both a government and a private account. It’s a striking departure from the norm for top officials to rely exclusively on private email for official business.



CLINTON: “I fully complied with every rule I was governed by.”

THE FACTS: At the very least, Clinton appears to have violated what the White House has called “very specific guidance” that officials should use government email to conduct business.

Clinton provided no details about whether she had initially consulted with the department or other government officials before using the private email system. She did not answer several questions about whether she sought any clearances before she began relying exclusively on private emails for government business.

Federal officials are allowed to communicate on private email and are generally allowed to conduct government business in those exchanges, but that ability is constrained, both by federal regulations and by their supervisors.

Federal law during Clinton’s tenure called for the archiving of such private email records when used for government work, but did not set out clear rules or punishments for violations until rules were tightened in November. In 2011, when Clinton was secretary, a cable from her office sent to all employees advised them to avoid conducting any official business on their private email accounts because of targeting by unspecified “online adversaries.”



CLINTON: “I did not email any classified material to anyone on my email. There is no classified material.”

THE FACTS: The assertion fits with the facts as known but skirts the issue of exchanging information in a private account that, while falling below the level of classified, is still sensitive.

The State Department and other national security agencies have specified rules for the handling of such sensitive material, which could affect national security, diplomatic and privacy concerns, and may include material such as personnel, medical and law enforcement data. In reviewing the 30,000 emails she turned over to the State Department, officials are looking for any security lapses concerning sensitive but unclassified material that may have been disclosed.



CLINTON: “It had numerous safeguards. It was on property guarded by the Secret Service. And there were no security breaches.”

THE FACTS: While Clinton’s server was physically guarded by the Secret Service, she provided no evidence it hadn’t been compromised by hackers or foreign adversaries. She also didn’t detail who administered the email system, if it received appropriate software security updates, or if it was monitored routinely for unauthorized access.

Clinton also didn’t answer whether the homebrew computer system on her property had the same level of safeguards provided at professional data facilities, such as regulated temperatures, offsite backups, generators in case of power outages and fire-suppression systems. It was unclear what, if any, encryption software Clinton’s server may have used to communicate with U.S. government email accounts.

Recent high-profile breaches, including at Sony Pictures Entertainment, have raised scrutiny on how well corporations and private individuals protect their computer networks from attack.



CLINTON: “When I got to work as secretary of state, I opted for convenience to use my personal email account, which was allowed by the State Department, because I thought it would be easier to carry just one device for my work and for my personal emails instead of two. Looking back, it would’ve been better if I’d simply used a second email account and carried a second phone, but at the time, this didn’t seem like an issue.”

THE FACTS: If multiple devices were an inconvenience in the past, they may be something of an obsession now. Clinton told an event in California’s Silicon Valley last month that she has an iPad, a mini-iPad, an iPhone and a BlackBerry. “I’m like two steps short of a hoarder,” she said. She suggested she started out in Washington with a BlackBerry but her devices grew in number.

Smartphones were capable of multiple emails when she became secretary; it’s not clear whether the particular phone she used then was permitted to do so under State Department rules.

A PARAMOUNT test for those running for president is how they make decisions — how they absorb information, what principles they carry and how it is all processed to a final choice. This is highly subjective, often lost in the hurly-burly of campaigning, but crucial. Hillary Rodham Clinton, who is expected to announce her candidacy soon for the Democratic nomination, is at one of those revelatory moments and so far seems not to have recognized it. On Monday, people in her circle suggested that she will soon answer questions about her e-mail account. We hope she seizes the opportunity to be forthcoming.

A week has passed since the disclosure that Ms. Clinton used a private account for all of her e-mail messages while serving as secretary of state, contrary to the administration’s instruction that officials should use government e-mail accounts and contrary to what the State Department — on her watch — was telling its ambassadors and other officials to do. Ms. Clinton did not turn in the e-mail records to the government when she left office. Since then, she has given the department 55,000 pages of messages in response to a request, but those were selected by her and her staff, not by government archivists or officials. All of this reveals a cavalier attitude to the public’s legitimate claim on government records.

In the past week, Ms. Clinton has said exactly this, in a tweet: “I want the public to see my email. I asked State to release them. They said they will review them for release as soon as possible.”


 



 


 

This perfunctory statement is even less helpful than it sounds. Ms. Clinton must know that the State Department will follow the Freedom of Information Act process to release her e-mails, requiring that they be scrutinized for sensitive information and that other agencies be consulted — a lengthy process, not likely to result in release any time soon.

The tweet also does not address a number of questions that Ms. Clinton should answer: Why did she use a private account? What discussions did she have with advisers and other State Department or White House officials about it? How many messages, if any, have been omitted from those turned over to the department? Will she permit a neutral arbiter — say, from the National Archives — to examine any withheld messages?





Some have portrayed the e-mail story as a conflict between Ms. Clinton and members of Congress who are investigating the attack on a U.S. mission in Benghazi, Libya, while she was secretary. But this is not primarily about Benghazi. Instead, it is about how Ms. Clinton responds to legitimate questions about her judgment and her record; it is about how she would function as president. Dispatching friendly politicians and former aides to television news shows to dismiss the issue as just politics does not help her cause. If she is elected president, can Americans expect a similar response when she faces difficult questions — one 26-word tweet and a cloud of obfuscation from her friends?

If she wants to demonstrate the strength of character and judgment required to be president, Ms. Clinton should hold a news conference and answer all the unanswered questions about her e-mails.

Stephen F. Hayes reported on Fox News that Hillary Clinton's top two aides, Huma Abedin and Cheryl Mills, used personal emails while working for the secretary of state at the State Department:



"Two of Hillary Clinton's top aides used personal email while they were employed at the State Department, Huma Abedin and Cheryl Mills. Hillary Clinton's chief of staff. The State Department has evidence of this.

"And the question I think become: were they emailing with Hillary Clinton from their personal email addresses to her personal email address about State Department business, about Benghazi, including sensitive classified information?Those are questions that I think that Trey Gowdy and the House Benghazi committee is going to want to look at very carefully."

Hayes went on to explain, "This is the key point. Yesterday, she said look, when I was doing State Department business I was emailing to people who on the receiving end of her emails had .gov email addresses and therefore the emails, the documents would have been retained. What this suggests is that others were using non-.gov emails, their personal emails, and if they communicated with her in that manner those emails with her will be lost unless they're compelled to provide them."

The Obama administration will soon find itself in court having to explain to federal judges why it never told anyone former Secretary of State Hillary Rodham Clinton used a secret email address, potentially spoiling dozens of open records requests, experts said Wednesday. And Mrs. Clinton could face up to three years in prison per message if she is found to have broken her word and handled classified information on the secret account, one open records expert told The Washington Times.

The legal challenges have already begun, with The Associated Press filing a federal lawsuit saying the State Department has foiled five years’ worth of requests for Mrs. Clinton’s emails, but never told them or the court that she kept her own server — meaning that her emails weren’t being searched. Meanwhile, the White House tried to keep Mrs. Clinton at arm’s length, insisting she alone can answer questions about what she did, and saying that none of Mr. Obama’s aides were involved in helping her decide which emails to turn over to the State Department and which to delete.

Mrs. Clinton’s office remained silent a day after the former first lady and potential 2016 presidential candidate held a press conference admitting she kept a private email server out of “convenience,” belatedly went through and found public records among her emails and then deleted nearly 32,000 emails she and her lawyers deemed private.

Former counsel to vice president Dick Cheney and contributing editor to National Review Shannen Coffin said there’s “no doubt” that, if Hillary Clinton signed the usual exit form claiming she turned over all relevant records to the State Department, she “knowingly and willfully” violated federal law and could face fines or imprisonment.

On Fox News’s “Megyn Kelly” on Wednesday, Coffin explained that all State Department employees — including the Secretary of State — must sign a form OF-109, which declares that he or she has turned over all official records to the State Department as they leave their government position.

But Hillary did not turn over her e-mails, stored on a private home server, until after being asked by the State Department in late 2014.

“There’s no doubt, looking at that, that wherever the secretary had those records — if she had them in her Chappaqua home, if she had them in her office, if she had them somewhere else — she’s got to bring all of the records to the table, and turn over any official records at the time of her departure,” Coffin said. “Not — most definitely not — two years later.”

Kelly asked Coffin if Hillary broke the law if she did, in fact, sign form OF-109 upon leaving the State Department.

“If that’s the case, there’s no question,” he said. “The form itself says, ‘Hey, before you sign this, understand that you are certifying something that we can prosecute you for. Making a false statement in this context, knowingly and willfully’ — which, I can’t imagine anything more knowing and willful than knowing you have 55,000 records sitting in your home — ‘if you do that, it is a felony.’”

State Department spokeswoman Jen Psaki couldn’t tell reporters on Thursday if Hillary Clinton signed an official records form presented to all employees as they leave the department — a crucial question in determining whether the former Secretary of State committed a felony by failing to turn over government e-mail records.

Former Department of Justice lawyer and National Review contributing editor Shannen Coffin noted this week that Clinton should have signed form OF-109 as part of her standard exit from the department. That form declares that she turned over all relevant records at the time of her departure — and stipulates that any failure to do so could result in felony fines and jail times.

Clinton did not turn over her government communications to the State Department until asked for them late last year.

“A former DOJ attorney has asked if, under department policy, Secretary Clinton — like all officials here in this building, when they depart or separate from this office, has to sign something called a form OF-109,” a reporter asked Psaki on Thursday. “It’s a separation statement declaring that when you leave office, you turn over not just classified materials, but any documents for official purposes. Did she sign –”

“I think this has been asked,” Psaki interrupted. “It was more than two years ago. I don’t have an update on that specific question at this point.”

As Hillary Clinton took questions from the media about the personal email account she used as secretary of state, I felt a flashback coming on. She said she simply chose to use a personal account with a personal server "for convenience." I felt I had traveled back in time to 1998. Washington was screaming across the aisle. First lady Hillary Clinton charged that a "vast right-wing conspiracy" was behind stories that her husband had an affair with Monica Lewinsky. President Bill Clinton denied that he ever had "sexual relations" with the former intern.

Deep down, everyone knew that Bubba was lying. And he was lying. Judge Susan Webber Wright eventually would fine Clinton for giving "intentionally false" testimony during depositions with attorneys representing plaintiff Paula Jones, whose sexual harassment lawsuit nonetheless tanked.

Up until the president was forced to admit that he had lied about Lewinsky, partisans who surely suspected otherwise vehemently argued that Clinton had been truthful. When that ruse crumbled, the knee-jerk defenders used cable news as a nonstop forum for odd debates meant to distract from the core issue.

Did "real people" really care?

Was oral sex sex?

Why should the public care about what the president did if his wife stood by him?

On Tuesday, Hillary Clinton said she set up a private email account simply because it seemed more convenient than carrying two phones -- which in her world probably translates into having an aide carry two phones. She said she deleted private emails only. By the way, half of the 60,000-plus emails on the account were personal. Oh, and she deleted them. If she had it to do all over again, she would not have used a private account with a private server, but when she made the decision, the onetime Rose Law Firm attorney said, "this didn't seem like an issue."

Some Clintonistas may feign belief, but they know, contrary to what she told the media, Clinton did not go "above and beyond" what she "was requested to do." We all know why she set up a private account. She didn't want to leave a paper trail. She didn't want the media to get ahold of documents that might require explanation during her inevitable run for the White House in 2016. She didn't want to provide ammunition to rival campaigns. She wanted the prestige of having been secretary of state without having to stick to the documentation rules that applied to administration officials, including the White House.

Everyone knows the "convenience" excuse is a ruse, but to admit as much is to admit that the Clintons have a strained relationship with candor. So let the faux debates begin.

Do "real people" really care?

Was there an enforceable law broken?

Why shouldn't the former Cabinet member be able to delete emails about her yoga routines?

The Clintons have learned that when they decide they are above the truth, there are always apologists who will say anything to defend them. Or at least there always used to be.

Hillary Clinton lied. She knew Donald Trump was not a Russian spy. Trump knew she was lying. The FBI knew she lied but went after Trump anyway. The CIA knew she lied. President Barack Obama knew she lied. Joe Biden knew she lied. The FBI covered up for her. The CIA covered up for her. The DOJ covered up for her. Barack Obama covered for her and so did Joe Biden.

He was describing life and imprisonment under Stalin. But it’s an apt description for the Democrats’ reign at Main Justice and the FBI. There’s justice and then there’s just us. America has sunk to new depths of political depravity, treating members of one political party differently from another, as pointed out in the Durham Report.

Durham wrote the “Clinton Plan” was conceived to distract from her very real and very illegal destruction of evidence — her emails — which were under a preservation order. “According to the declassified Clinton Plan intelligence, on July 26, 2016, Clinton allegedly approved a proposal from one of her foreign policy advisors to tie Trump to Russia as a means of distracting the public from her use of a private email server.”

Clinton’s apparatchiks, including Jennifer Palmieri, John Podesta, and Jake Sullivan, told the Special Counsel they knew nothing of the plan to distract from Hillary’s email scandal, describing such a plan as ridiculous. Durham found their protestations ridiculous.

Mortgage applications decreased 5.7 percent from one week earlier, according to data from the Mortgage Bankers Association’s (MBA) Weekly Mortgage Applications Survey for the week ending May 12, 2023.

The Market Composite Index, a measure of mortgage loan application volume, decreased 5.7 percent on a seasonally adjusted basis from one week earlier. On an unadjusted basis, the Index decreased 6 percent compared with the previous week. The Refinance Index decreased 8 percent from the previous week and was 43 percent lower than the same week one year ago. The seasonally adjusted Purchase Index decreased 4.8 percent from one week earlier. More to the point, it's amazing that anyone thought Hillary Clinton was actually good at politics. Her entire oeuvre is as an incessant scold. Whether it's as explicit as "basket of deplorables" or not, Clinton stands for the elites and demands fealty from the serfs on the basis of privilege at all times. Her sense of entitlement is as breathtaking as it is unearned.
