No, not just for punching him.

But I have my doubts as to whether a guy getting punched in the face in his car by some big loser would ever be convicted at trial for using deadly force-my guess would be that the little guy could be charged-but would never get convicted under such circumstances.

   a small crowbar or heavy wrench to the forehead would probably not even get the little guy charged with anything.

Actually, in FL, Jeb Bush changed the law of 'castle doctrine' so that the attacked has NO duty to retreat if in the vehicle, an extension of your home/property.

Of course, common sense and simple civility/morality should tell you not to shoot someone unless you absolutely HAVE to.  I've gotten punched in the face and never drew my own piece. 

But in FL, the law is very much pro-victim.  It's very hard for the law to define exactly when the person being attacked feared for his/her life.  If Ronnie coleman is reaching in the window of a 88-pound, 88 year old woman's window and can cap him.... yes, she is indeed in fear of her life.  If an 88 year old woman is reaching in Ronnie's window, well, he's in zero threat.  The problem is all the close calls in between, where people might believe they're in danger, and you really never know what the guy has (knife, gun, or just a nice index finger fishook for your eye) until he uses it.

Down here it's the wild west sometimes.

Yeah, you woudl think not. It would depend on the local prosecutor. I can guarantee you if it were an on duty-or even off duty cop there owuld never be any charges.

In that situation, there was no law present, and the storeowner made no effort to enforce state laws on that property.

The big dude doing the punching was making the rules.

Other people need to realize that not all situations in life are moderated by law enforcement.  There are times and places (like cracked out Shop-Rite's in the middle of the ghetto at 1 AM) where assault laws aren't enforced.  The punchingbag behind the wheel should have realized that when pulling into that lot, and chosen to drive an extra 10 minutes to a 24-hour SuperWalmart in a nicer neighborhood, where he could rest assured that any effort to enforce parking spots by self-appointed assholes will result in 8 members of Walmart's security team (paid $7.25 hourly but ready to take a bullet for a pack of stolen gum) tackling him while calling 911 from their cell phones.

Lesson of story: Don't go to dangerous places at night unless you're prepared to get punched.

In the off duty bad cop shooting in San Diego, this guy wrote a good line about using deadly force (speaking of the idiot cop that blasted the Mom and 8 year old);


This guy should be in jail if only to make a statement to all the other undiciplined individuals who take on the demanding job of being a peace officer. I am an ordinary citizen who maintains concealed weapons permits in a few states, I understand that my right and decision to arm myself comes with great responsibility to act accordingly.

I am responsible for every shot I fire in an incident and understand that I had better have a very good reason to fire. I am required to avoid an incident by all means necessary and only fire when I cannot avoid the threat, in self defense. Was this cop "really" threatened? Could he not have distanced himself from this situation? This officer did what everyone fears the law-abiding public is going to do if they are allowed to carry concealed weapons, HE ESCALATED AN ENCOUNTER AND ACTED IN A WAY THAT HE WOULDN'T HAVE IF HE DIDN'T HAVE THAT GUN AVAILABLE. It appears to me that this guy is grossly irresponsible, the truth should come out in trial, bottom line though, he used DEADLY FORCE against two people. Deadly force is reserved for threats to your/other's lives that can't be avoided. He could have easily killed that lady and child. He fired those shots knowing that he was using a level of force that could cause serious injury or death to the victim. Was that level of force necessary? He should answer for his apparent irresponsibility and a message should be sent to the remaining CITIZENS who are entrusted with firearms in order to PROTECT AND SERVE US (aka police officers). This message should be, Just because you work to enforce the law, doesn't mean you don't have to abide by it and face the same penalties as every other citizen. Frankly, I know 18 year old teenagers in the military that I've served for 16 years that have more discipline, integrity, and control.. even in battlefield situations... than the so called police professionals walking our streets.

Totally.  In florida, you simply brandish that weapon - or let it show when your Tshirt blows in the wind - and you can get a year in jail.  Pull it out and point it at some prick, it's 5+ years.  Stupid bullies are separated from their weapons and their freedom very quickly in real life.  The smart good guys, you never know that have it.  I've carried quietly for 11 years now.  Most of my friends and family have no clue.  I don't brag, make threats, or show off.  I act like anyone else, I get outta dodge when shit looks dangerous.  But if I'm slopping down a triple-cheeseburger and some wacko decides to shoot up my Wendy's (as someone did in Palm Beach 2 weeks ago), you'd better believe I'm putting 15 rounds in him without hestitation.

I got a friend, total MMA fighter (for real, no TapOut fake shit here) that is on more shit than the CIBA factory produced. He's sitting in his car during Xmas time this past year, waiting for his parking spot. The spot is vacated and some homie drives around my friend and steals the spot. My friend calmly gets out, asks why he took his spot, and the ever so intelligent driver mouths off something like "it's mine now fucker." My friend, Jack, says to himself "hell no!" walks up to the guy and breaks his arm at the elbow. Throws two or three punches to the passenger knocking him out cold on the pavement, then proceeds to watch the third and final guy run away. Not so tough anymore, eh guys? After all that, Jack, didn't want to shop anymore so he got in his car and went home.
epic i have a badass MMA friend who could kill Bruce Lee/ChuckNorris/Mike Tyson/King Kong/Godzilla bullshit story. ::)
