Our House In The Middle Of The Street
« on: November 22, 2012, 06:34:02 AM »
Since when China  become so respectful of individual freedom?
Here they would seize the property and evict the owner and demolish it , no question asked.

Elderly couple in Wenling, China refuse to sell house to government, so government builds highway around them.

Haven't those pesky commies not heard of such capitalist, freedom-loving concepts as "eminent domain"? ::)

This. My parents had 9 acres taken from them about 6 years ago for a road widening project that has yet to happen, and may not now. City can take what they want if they deem it for the better good.

Since it's China, it is only a matter of time before a truck crashes into the house and demolishes it, killing a few pedestrians along the way.

Wrong. They were offered $35,000 and acre when the property directly across the street was going for 800-900k and acre. They sued the city and got 100,000 an acre, which was shit compared to what it was going for. They refused to re zone it as commercial, that is, until they forcefully took it. Now it's theirs it's been rezoned.

How did a judge only award them 100K? That's just ridiculous... I would have appealed the ruling and tried to get more.

That's some bullshit.

At the time, it was zoned residential. The city would not let them rezone it. They wanted to put a gas station there and a strip mall. The city said no, that it could only be farmed or houses put there because they wanted to keep the integrity of the "rural" area when right across the street was a brand new Harris teeter, target, Walmart and a shit load of other places. Funny, then a year later the city forced them to sell to put a road through for a school and future road widening that six years later has still yet to be done.

DISGUSTING.

They should sue again saying that imminent domain wasn't imminent.

good idea. but the government might argue that it was "eminent" and not "imminent" or even "immanent."  about the "if it was rezoned" argument.... "if" - sounds like it was worth 100k w/o the rezoning and that's what they got paid.
