Video also shows Slagel tossing an item next to the police officers feet. I should assume he was trying to frame the officer.. but wait.. same video shows Slagel picking UP the item and placing it his taser holster.. which has to be the worst "planting" job known to date

It was likely the taser. It was by the body, it was by the other cop, it was in a secured place. The fact he picked it up and holstered it would indicate to me lacking his report where he talks about it.. that it wasn't intended to be planted. In retrospect, unless there was a chance a bystander would have access to the taser, he should leave it in place. However he just shot someone and probably wasn't thinking "crime scene" at that point. Again.. if the report says anything about Scott having the taser near his body, or running off with the taser then clearly he was trying to set him up. But more likely he picked it up, brought it over.. tossed it towards the other officer and the body.. then thought "Shit I don't want it to look like he brought it here, or screw up the scene I better pick it up". Again... bad shoot.. no doubt, screwed the pooch... but there isn't enough information as we speak,to conclude he was trying to plant the taser. Again.. he picked it up and holstered it.. not really consistant with planting a weapon

At the time you shoot the person, regardless of prior actions during a struggle, if that person isn't posing an immediate threat of serious injury or bodily harm or death to you or someone else, then you have no legal right to shoot them. Whether they tried to take your taser, gun, nightstick etc. Even if Scott was holding the taser or gun in his hand but running away, it would not be legal shoot in the instance we saw in the video.
