Nobody has a trademark on the color red. Unless he's copying the formulation or giving them similar names....there's simply no case.

Not for nothing, but I've been an attorney for over 22 years and thank you, I was already aware that "nobody has a trademark on the color red."
However, if you read what I wrote carefully, you will see that I wrote "trade dress infringement." Now, I am sure you will go to your Wikipedia and other
internet sources to increase your legal research acumen but when you are done with all that, please re-read what I wrote in that "trade DRESS infringement" (emphasis added)
is in fact, different than a "trademark."
