It just won't be 2 years. His lawyer may make him make a plea deal, but if it goes to court and hes found guilty, he will probably do more than 2 years. I am not saying he will do 50 years, but he will do more than 2. Mark my words. If I am wrong, I will admit it!

Justi Carr Chuck Lerant I can see that someone here took the 50 cent law classes instead of the full priced ones. The man did attempt to retreat, as clearly showed in the video; the female continued towards him while he was backing away and hit him in the face. His response to was to hit her exactly once.
The duty to retreat deals with use of deadly force (it's even put in its very own subsection of the statute, subsection 'b', which reads "Limitations on justifying necessity for use of force".
Reading down the statute, one finds subsection (2), which deals with use of deadly force. The duty to retreat is in (2)(b) and reads, "The actor knows that he can avoid the necessity of using such force with complete safety by retreating or by surrendering possession of a thing to a person asserting a claim of right thereto or by complying with a demand that he abstain from any action which he has no duty to take..."
Here "such force" refers to the type of force that is being discussed in that section, which is deadly force. And in any event, the obligation does not lie unless the person knows he can withdraw in complete safety. He attempted to withdraw and female pursued him and hit him while he was making such attempt. So, even if the duty to retreat were to lie outside of deadly force situations, being attacked while attempting to withdraw is a sufficient ground upon which to use force in response because one then knows he cannot withdraw "in complete safety".
