Donald Trump got imposed with a narrow gag order on him on Monday, barring the Republican former president from making statements targeting prosecutors, possible witnesses and the judge's staff.

The order from U.S. District Judge Tanya Chutkan marks a milestone moment in the federal case that accuses Trump of illegally conspiring to overturn his 2020 election loss to Democrat Joe Biden.

Chutkan said Trump is entitled to criticize the Justice Department generally and assert his belief that the case is politically motivated, but she said Trump can’t mount a “smear campaign” against prosecutors and court personnel.

“No other criminal defendant would be allowed to do so, and I’m not going to allow it in this case," Chutkan said.

Chutkan, who was appointed by President Barack Obama, said she would impose “sanctions as may be necessary” if the gag order is violated, but she wasn't more specific. Judges can threaten gag order violators with fines or jail time, but jailing a presidential candidate could prompt serious political blowback and pose logistical hurdles.

While ending the stream of Trump’s harsh language may make the case easier to manage, it could also fuel Trump’s claims of political persecution. Trump’s campaign had already seized on the proposed gag order in fundraising appeals, and Trump had falsely characterized it as an attempt to prevent him from criticizing Biden, who became president in January 2021.

The order could end a line of attack that Trump has made central to his campaign as he vies to win the GOP presidential nomination in 2024. But it may be only the beginning of an unprecedented fight over what limits can be a placed on the speech of a defendant who is also campaigning America's highest public office.

    The federal judge in Trump's election interference case issued a gag order against him on Monday.

    Another gag order was issued by the judge in Trump's New York civil fraud trial earlier this month.

    Here's the list of people Trump now has to be careful about insulting in public.

Thanks to a couple of gag orders against him, there's a bunch of people Donald Trump can't insult anymore — unless he wants to risk violating court orders.

Tanya Chutkan, the federal judge overseeing Trump's election interference case in Washington DC, issued a gag order on Monday after Trump raged against Special Prosecutor Jack Smith and his team. Earlier this month, Justice Arthur Engoron issued a gag order in Trump's New York civil fraud trial when Trump singled out one of Engoron's clerks online.

In total, the pair of gag orders bar Trump from insulting or disparaging the following people in public — whether that's in speeches on the campaign trail or in posts on social media:

    Members of Judge Chutkan's court staff

    Prosecutors, including Special Prosecutor Smith, in the DC election interference case

    Witnesses in the Washington DC case

    Any member of Justice Engoron's team in the New York fraud case

However, Chutkan's order does not ban Trump from criticizing the city of Washington, DC, the people who live there, the Justice Department, or the judge herself.

It also included a specific carve-out to let Trump keep attacking his political rivals, specifically citing former Vice President Mike Pence — who may be called as a witness in the case.

At a campaign rally soon after Chutkan's order, Trump attacked her, calling her ruling "unconstitutional" and saying "her whole life is not liking me."

Engoron's order also doesn't prevent Trump from attacking NY Attorney General Letitia James. So Trump called her a "lunatic" outside the courtroom on Tuesday.

With the former president's penchant for posting lengthy attacks against his rivals on social media, Trump will need to reign things in or risk facing consequences in court.

The lawsuit seeks to hold Trump liable for comments he made while president in 2019 after Carroll said publicly for the first time in a memoir that Trump sexually abused her in the dressing room of a Manhattan luxury department store in 1996. Trump has adamantly denied ever encountering Carroll in the store or knowing her.

The former president’s Secret Service agents were caught off guard and chased after him as he abruptly left the room, according toreporters who were present.

Trump exited the courtroom shortly after Cohen admitted that Trump had never asked him to inflate the numbers on his financial statements.

Once outside, Trump declared to reporters before walking away: “The witness just admitted that we won the trial. And the judge should end this trial immediately.”

One of Trump’s attorneys then asked Judge Arthur Engoron to declare a verdict in the trial, to which he replied, “Absolutely denied,” noting that there’s evidence “all over the place” supporting the New York attorney general’s $250 million lawsuit against Trump, three of his adult children and the Trump Organization.

Shortly before Trump’s outburst over Cohen’s remarks, Engoron handed down a $10,000 fine against the former president, ruling that he had violated a gag order banning him from discussing the judge’s staff when he spoke to reporters earlier during a break in the trial.

“This judge is a very partisan judge with a person who is very partisan sitting alongside him ― perhaps even much more partisan than he is,” Trump said. Engoron’s clerk was sitting next to him.

But when questioned on the witness stand, Trump claimed he was speaking about Cohen, who was sitting on the other side of Engoron in the witness box during his second day of testimony.

“Are you sure you didn’t mean the person on the other side?” Engoron asked, gesturing to his clerk.

“Yes, I’m sure,” Trump replied.

Engoron then dismissed Trump after about a minute of testimony and handed down the penalty despite Trump’s protests.

“I hereby fine you $10,000 ― which is on the liberal side ― to be paid within 30 days,” he ruled.

The fine comes in the fourth week of the trial.
