The press/reporters are usually invited to protests in advance to ensure media coverage. Protest organizers typically share planning details with trusted journalists only. Don't you suppose Lemon would be among trusted journalists? The prosecution must prove Lemon helped plan the event. Logistics such as what is expected of journalists and reporters on the day of the event. Contacts such as local reporters/media.

From everything I have read, whether or not he was wronged is a big 'if'. The leak was made by Littlejohn, a former contractor working for the IRS. Why not sue the contractor? Did Trump and family suffer $10 billion in damages and can they prove this? The lawsuit will determine if he was wronged and if he suffered financial damages. If he did, then what is the actual amount of those damages? I don't envy Judge Kathleen Williams, who has been assigned this case. because it forces the Department of Justice to defend the agencies under a president who controls them.
