I have the owners (2) names, addresses and phone numbers at work, shall i post it and thus many let the two leaders of this company know what they think?

Their products are sold in GNC Franchise stores and over radio ads besides the Net.

i remeber seeing those ads a while back in muscle magazines. i would see it and think "huh, i thought jay is sponsered by muscletech?". well now the truth comes out

I couldn't care less whose pictures they use. Neither could anyone else except the "blue stars".

I am very familiar with the company. It is highly unlikely that they have an insurance policy that extends beyond General Product Liability. That policy won't cover that type of claim, only damages caused by use of the product, not misrepresentations of the product by the company (such as an illegal use of an image to market the product).

If Jay is able to get a "Cease and Desist" order from the court, they will have to pull all of the product with the contested image. This will cause the company major damage. They are sold exclusively at GNC stores. Corporate GNC will probably not allow them to bring the product back until after the lawsuit, regardless of whether they create new labels or not. This company is already having "issues" with Corporate GNC, so this could be devastating.

It will probably be a percentage of sales of the products with his image on them.

If that box pic is the issue then it's unlikely there's much of a claim. You know the company will come back with some excuse how they got the rights to the pic as it's unlikely they would eggregiously violate his trademark. I'm sure GNC demands indemnity and that they be additionally insured so no big dollars from them. The insurance companys will hammer out some settlement and I'd doubt he can expect any huge payday. I've never even heard of that company so how much biz could they be doing..

I heard that they did somewhere in the area of $16 million last year.

They're obviously using his image to sell the product. His image makes up 50% of the box.
