I still think it should be against the law though, most people aren't aware of the dangers and therefore don't meet the "fully aware of the risk" criterion. If people are fully aware, then the law should be changed.

That's my belief, that a lot of this stuff over the years gets designed to have that outcome as a benefit to the big companies.  It's a long argument to go through all of that but yes, that case can really be made for the new food saftey shit coming soon.

I was saying imagine a homeless person who has no other food and will certainly starve to death unless he can get raw milk. I would say that the law saying "It is illegal to sell (or give) raw milk" would not be justified.  If the Hypothetical homeless person A said "I know I might get sick, but damnit I'm about to die so I want raw milk", then the law saying it was impermissible would not be justified.

In the USA the FDA in it's infinite wisdom has decided that the almost negligible risk of absorbing parasites should be totally eliminated. Fish that is intended to be consumed in its raw form, has to be deep-frozen first, by law, while freezing does not kill nematodes. Luckily, the FDA has no jurisdiction over the retail operation in general; "the serving of sushi does not fall under their purview". Also see the FDA on seafood
Strangly, the FDA does not mind that the risk of absorbing mutagenic HCA from cooked fish is 100%; cooked fish always contains mutagenic HCA

Yep, totally.  The FDA does a poor job regulating our food as it is.  The last thing they need to worry about is real food products.  Fu*k they allow 30% cellulose into 'food' there is no basis for them to even begin to say you can not eat something natural and raw.
