everything i've found says this...
"CA Overtime Laws
For more than 8 hours in a day, an employee must be paid 1.5 times his or her usual rate, and for over 12 hours in a day must be paid twice the standard rate. In addition, if an employee works 7 consecutive days, they must be paid 1.5 times the usual rate for the first 8 hours, and doubletime for any hours over 8. The 7th consecutive day law applies regardless of how many hours an employee worked in the preceding six days. Also, any hours over 40 in a week must be paid at time and a half."
When does the 7days start? I haven't had a day off since april 11th... so does that mean the entire pay period of may 1st-may 15th is overtime? or does the 7days start over with each pay period.. meaning i'd get 1.5x pay for the first 8hrs begining may 7th?
I did the math calculating my hours with overtime from the start (1st 8 were 1.5, the rest were double) and the pay came out to about what I was taking home when the previous GM was doing payroll... I think the new GM just didn't include overtime. The owner was probably unaware we were getting paid overtime, and when I bring it to his attention, he's probably gonna put an end to it. lol But, he'll be up shit's creek if he lays me off, because nobody else will work the weekend front desk position. lol.
One trainer already has an interview with another training company run buy a guy who used to run our training company, and opperates in the gym the our old GM as well as my gf works at. Worst comes to worst, I hit them for back overtime (nothing was ever documented as overtime on my payroll/paystubs), and I go to work over at the other gym...
