Burglary Suspect Was On ProbationKirby Homeowner Opens Fire On 3 Teenagers
KIRBY, Texas -- A homeowner in Kirby who opened fire on three teenagers during a burglary attempt, killing one of them, is distraught over the incident, the police chief said Wednesday.
"I kind of got the sense he wasn't happy having to do what he did, but I strongly feel he was put in one of those situations where he felt he needed to protect himself, and he took appropriate action," said Kirby Police Chief Kevin Bois.
Bois said that at around noon Tuesday, the homeowner heard some noise coming from his sliding glass door, grabbed his handgun and fired multiple rounds.
Alex Aleman, 17, was shot four times in the chest and died. Justin Rivera, 19, was wounded.
Oscar Alatorre, 17, who Bois said was the getaway driver, was not hurt. Alatorre and Rivera were arrested and will face felony burglary charges, Bois said.
Aleman was on probation for burglary at the time of the incident, Bois said.
Aleman's family told KSAT 12 News that their loved one didn't deserve to be shot "like a dog" and question where a homeowner draws the line for self-defense.
Bois said that a grand jury will review the case, but charges probably won't be filed against the homeowner.
"They're kind of tired of it," Bois said. "They work hard for their property, that's their home and they're getting tired of folks kicking in the door and helping themselves."The three suspects had ties to gangs, Bois said.
"We're looking into the possibility they had staked the house out before and heard there might be electronics and weapons in the house," he said.
